AN ORDINANCE OF THE CITY OF SEBASTIAN, FLORIDA, AMENDING
THE COMPREHENSIVE LAND USE PLAN MAP BY:
l)
CHANGING THE LAND USE DESIGNATION OF A PRARCEL OF LAND
CONSISTING OF APPROXIMATELY 6/10TH OF AN ACRE OF LAND
LOCATED NORTH OF COUNTY ROAD 512, SOUTH OF THE FORMER
RIGHT-OF-WAY OF THE TRANS-FLORIDA CENTRAL RAILROAD
RIGHT-OF-WAY, AND NEAR THE NEW SEBASTIAN ELEMENTARY
SCHOOL FROM INDIAN RIVER COUNTY LOW DENSITY TO GENERAL
COMMERCIAL (CO);
2)
PROVIDING A LAND USE DESIGNATION OF INDUSTRIAL (IND) OF
A PART OF THE CITY OF SEBASTIAN MUNICIPAL AIRPORT THAT IS
IN SECTIONS 22, 28 AND 29 OF THE FLEMING GRANT, WHICH LAND
AREA COMPROSED THE LAND INSIDE OF THE EXISTING RUNWAYS
OF THE AIRPORT AND THAT PART OF THE AIRPORT NORTH OF
RUNWAY 13;

CHANGING THE LAND USE DESIGNATION OF ALL OF GOVERNMENT LOT
2, SECTION 6, TOWNSHIP 31 SOUTH, RANGE EAST, EXCEPT TWO SMALL
PARCELS THEREOF FROM INSTITUTIONAL (INS) AND MEDIUM DENSITY
(MD) TO COMMERCIAL OFFICE RESIDNETIAL (COR), SAID LAND IS
LOCATED NORTH OF THE BASEBALL FIELD NEXT TO THE CITY HALL;

CHANGING THE LAND USE DESIGNATION OF A PARCEL OF LAND CON-
SISTING OF APPROXIMATELY 1.4 ACRES OF LAND SITUATED SOUTH
OF THE POST OFFICE AND EAST OF POWERLINE ROAD FROM COUNTY
AGRICULTURAL TO GENERAL COMMERCIAL (CG);

WEST OF U.S. HIGHWAY NO. 1, EAST OF AND ADJACENT TO OLD
DIXIE HIGHWAY, AND IMMEDIATELY NORTH OF AND ADJACENT TO
THE PARCEL OF LAND DESCRIBED IN PARAGRAPH 6, ABOVE, FROM
COUNTY LOW DENSITY (LD 2) TO INDUSTRIAL (IND); AND,

CHANGING THE LAND USE DESIGNATION OF BLOCKS 6~7,8, AND 9,
OCEAN BREEZE HEIGHTS SUBDIVISION, LOCATED NORTH OF 9TH
STREET, EAST OF THE FLORIDA EAST COAST RAILROAD RIGHT-OF
WAY; BLOCK 7, 8, AND 9 ARE WEST OF U.S. HIGHWAY NO. 1
AND BLOCK 6 IS EAST OF U.S. HIGHWAY NO. 1 AND SOUTH OF THE
CITY CEMETERY~ FROM COMMERCIAL OFFICE RESIDENTIAL (COR)
TO LIMITED COMMERCIAL (CL).
10) PROVIDING AN EFFECTIVE DATE.
WHEREAS, the Planning and Zoning Commission has recommended
and the City Council has determined that certain changes in the
City of Sebastian Comprehensive Land Use Plan Map are needed in
order to either designate a City of Sebastian Land Use Designation
to annexed parcels of land or to amend the land use designations
at the request of the land owners or the request of the Planning
and Zoning Commission; and,
WHEREAS, The Planning and Zoning Commission in concert with
the City Council and sevaral Joint Workshops, or at two public
hearings held in August of 1985, after due and diligent consideration
proposed the amendments herein to the Comprehensive Land Use Plan; and
WHEREAS, for various reasons such as lack of timely notice to
the respective landowners, the timing of the requests before the
Planning and Zoning Commission in relation of the amendments to the
Land Use Plan enacted in August of 1985, the changes contained in
this Ordinance could not be included in the Ordinance enacted on
August 28, 1985 without delaying said Ordinance, and
WHEREAS, the City Council finds and determines that the combined
land area of the nine changes in this Ordinance comprise less than
five (5) percent of the land area of the City; and
WHEREAS, The City Council finds and determines that the adoption
of the changes to the land use plan is in the best interests of the
City of Sebastian;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
SEBASTIAN, FLORIDA, AS FOLLOWS:
SECTION I
THAT THE FOLLOWING DESCRIBED PROPERTY SITUATED IN THE CITY OF
SEBASTIAN, INDIAN RIVER COUNTY, FLORIDA, to-wit:
Ail that part of the Northwest 1/4 of the Northwest 1/4 of
Section 7, Township 31 South, Range 39 East, being more
particularly described as follows:
Ail that land lying South of the Trans Florida Central Railroad
right-of-way, North of the North right-of-way of County Road
CR-512, west of the east boundary line of the Northwest 1/4 of
the Northwest 1/4, and east of the Northwesterly extension of
a radius through the point of curvature of a curve having a cen-
tral angle of 25° 16' 13", with the intersection of the Southerly
right-of-way of said Trans Florida Central Railroad right-of-way,
said curve lying between lots 48 through 55, Block 490, Sebastian
Highlands Unit No. 12, as recorded in Plat Book 7, Page 57,
Public Records of Indian River County, Florida. "'
Be and the same is hereby changed from Indian River County Low Density
(LD) to General Commercial (CG).

SECTION II
THAT THE FOLLOWING DESCRIBED PROPERTY SITUATED IN THE CITY OF
SEBASTIAN, FLORIDA, INDIAN RIVER COUNTY, to-wit:
A parcel of land comprrising all of the runways at the City
of Sebastian Municipal Airport, all of the land inside of said run-
ways, a parcel South of of runway 13-31 and North of the Golf Course;
and a parcel land North of Runway 22 and runway 13; said land comprising
parts of Sections 22, 28, and 29 of the Fleming Grant.
Be and the same is hereby designated Industrial (IND) as the said land
has not previously has a land use designation applied thereto.
SECTION III
THAT THE FOLLOWING DESCRIBED PROPERTY SITUATED IN THE CITY OF
SEBASTIAN, INDIAN RIVER COUNTY, FLORIDA, to-wit:
Ail of Gevernment Lot 2, Section 6, Township 31 South, Range
39 East, except the following two parcels of land: Parcel #1: Begin
at the SE corner of said Government Lot 2, run North 248.7 feet,
thence West 417.4 feet, thence South 248.7 feet, thence East 417.4
feet to the point of beginning. Parcel #2: Begin 237.6 feet South
of the NE corner of said Lot 2, Section 6, which is also the inter-
section of the SE line of the Fleming Grant and the East line of
said Government Lot 2, thence run South 245.5 feet, thence West to
the SE line of the Fleming Grant Line, thence Northeasterly along
said Fleming Grant Line to the intersection of asid line with the
East line of said Government Lot 2 which is the point of beginning.
This land which is located North of the baseball field near the
City Hall building be and the same is redesignated from Institutional
(INS) and Medium Density (MD) to Commercial Office Residential (COR).
SECTION IV
THAT THE FOLLOWING DESCRIBED PROPERTY SITUATED IN THE CITY OF
SEBASTIAN, FLORIDA, INDIAN RIVER COUNTY, to-wit:
Begin at the Northwest corner of the Southwest 1/4 of SEction
6, Township 31 South, Range 39 East, run south 209 feet to a point,
thence run East 291 feet to a point, thence run North 209 feet to
a point, thence run West 291 feet to the point of beginning.
Be and the same is hereby redesignated from Indian River
County Agricultural to General Commercial (CG). Said land consists
of approximately 1.4 acres situated South of the Post Office and east
of Power Line Road.
SECTION V
THAT THE FOLLOWING DESCRIBED PROPERTY SITUATED IN THE CITY OF
SEBASTIAN, INDIAN RIVER COUNTY, FLORIDA, to-wit:
The West 291 feet of the Northwest 1/4 of the Southwest 1/4,
less the North 209 feet and less the South 534.5 feet thereof, in
SEction 6, Township 31 South, Range 39 East.
Be and the same is hereby redesignated from Medium Density (MD)
to Commercial Office Residential (COR). Said land is situtated
South of the Post Office and East of Power Line Road. It consists
of approximately 3.93 acres.

THAT THE FOLLOWING DESCRIBED PROPERTY SITUATED IN THE CITY
OF SEBASTIAN, INDIAN RIVER COUNTY, FLORIDA, to-wit:
A piece of land being:
Parcel No. 1: From the N.W. corner of Section 17, Twp 31 S,
Range 39E, run Easterly along the North line of Section 17,
a distance of 682.17' to a point on the East R/W of the
Old Dixie Highway for P.O.B.; thence continue Easterly
along said section line a distance of 369.68' to a point;
thence run Southeasterly and parallel to the West R/W of
U.S. 91 Highway a distance of 496.40' to a point; thence
run Southwesterly a distance of 84.0' to a point; thence
run Southeasterly a distance of 226.71' to a point on the
North R/W of the Old Dixie Highway; thence run Southwesterly
along the said North R/W of the Old Dixie Highway a distance
of 297.99' to a point on the East R/W of said Old Dixie
Highway; thence run Northwesterly along the said East R/W
of Old Dixie Highway and parallel to the East R/W of the
F.E.C. Railroad a distance of 860.75' to the P.O.B.; all
lying within Section 17, Township 31 South, Range 39 East
and comprising an area of 5.92 acres;
Parcel No. 2: From the NW corner of Section 17, Twp 31 S,
Range 39 E, run Easterly along the North line of Section
17 a distance of 1263.88' to a point on the West R/W of
U.S. No. 1 Hwy; thence run Southeasterly along the said
West R/W of U.S. No. 1 Hwy a distance of 404.34' to a
point on said West R/W for P.O.B.; thence continue South-
easterly along said West R/W of U.S. No. 1 Hwy a distance
of 264.11' to a point on the North R/W of Old Dixie Hwy;
thence run Southwesterly along said North R/W of Old
Dixie Hwy a distance of 119.31' to a point; thence run
Southwesterly along a line bearing to the left and having
a deflection angle of 07 26' a distance of 175.01' to a
point; thence run Northwesterly a distance of 226.71' to
a point; thence run Northeasterly a distance of 275.0' to
P.O.B. all lying within Section 17, Township 31 South,
Range 39 East and comprising an area of 1.57 acres.
Be and the same is hereby redesignated from County Low
Density (LD-2) to Commercial Office Residential (COR). Said
land consists of approximately 7.49 acres and is located west
of U.S. Highway No. 1, east of the Florida East Coast Railroad
right-of-way, and North and east of Old Dixie Highway.
SECTION VII
THAT THE FOLLOWING DESCRIBED PROPERTY SITUATED IN THE CITY
OF SEBASTIAN, INDIAN RIVER COUNTY, FLORIDA, to-wit:
Commencing at the Southeast corner of Government Lot 3,
Section 8, Township 31 South, Range 39 East, run North 89° 36'
19" West a distance of 48.93 feet to a point on the present
West right-of-way line of U.S. Highway No. 1, said point being
the point of beginning of the following description: From
said point of beginning, run North 89° 36' 19" West on the
South line of said Government Lot 3 a distance of 217 feet to
a point, thence run northwest 470 feet, more or less, to a
point that is 344.19 feet west of the right-of-way of said
U.S. Highway No. 1, thence run South 89° 35' 15" East 344.19 feet,
more or less to a steel pin on the aforesaid West right-of-way
line of U.S. Highway No. 1, thence run South 25° 57' 59" East
along said right-of-way line 370 feet to the point of beginning.
Be and the same is hereby redesignated from County Low
Density (LD-2) to Commercial Office Residential (COR). Said
land contains 1.82 acres, more or less.

SECTION ~III
THAT THE FOLLOWING DESCRIBED PROPERTY SITUATED IN THE
CiTY OF SEBASTIAN, INDIAN RIVER COUNTY, FLORIDA, to-wit:
Commencing at the Southeast corner of Government Lot 3,
Section 8, Township 31 South, Range 39 East, run North 89°
36' 19" West a distance of 48.93 feet to a point on the present west
right-of-way line of U.S. Highway No. 1, said point being
217 feet, more or less, east of following described property:
From said point of beginning, run North 89° 36' 19" West
on the South line of said Government Lot 3 a distance of 217
feet, more or less, to the true point of beginning of the
following described parcel, thence continue on said line a
further distance of 369.68 feet to a point on the East right-
of-way line of a county road (Old Dixie Highway), said right-
of-way being 30 feet East of and parallel to the East right-
of-way of the Florida East Coast Railroad, thence run North 21°
42' 19" West and parallel to the aforesaid East right-of-way
of the railroad a distance of 358 feet to a point; thence
run South 89° 35' 15" East 230 feet, more or less, thence
run Southeast 470 feet, more or less along the West edge of
the parcel described in Section VII, above, to the true point
of beginning of the within described parcel.
Be and the same is hereby redesignated from County Low
Density (LD-2) to Industrial (IND). Said land consists of
2.52 acres, more or less.
SECTION IX
THAT THE FOLLOWING DESCRIBED PROPERTY SITUATED IN THE CITY
OF SEBASTIAN, INDIAN RIVER COUNTY, FLORIDA, to-wit:
Blocks 6, 7, 8 and 9, Ocean Breeze Heights Subdivision.
Be and the same is hereby redesignated from Commercial
Office Residential (COR) to Limited Commercial (CL).
SECTION X
The provisions of this Ordinance shall become effective
upon receipt from the Secretary of State of Official acknow-
ledgment that this Ordinance has been filed with the Department
of State.
I HEREBY CERTIFY that the foregoing Ordinance was finally
passed by the City Council of the City of Sebastian, Florida,

I HEREBY CERTIFY THAT this Ordinance, passed first reading
on the 25th day of September, 1985.
I HEREBY CERTIFY that Notice of Public Hearing on the
foregoing Ordinance was given in accordance with Florida
Statutes, that the other notice requirements required as a
prerequisite to a change of less than five (5) percent of
a land use element have been complied with; that a public
hearing was held on the foregoing Ordinance before the City
Council of the City of Sebastian, Florida, on the /3/~ day
of ~m ~8,%F~, 1985, and that following said public
hearing on the foregoing Ordinance was passed by the City
Council of the City of Sebastian, on the ;3~day of ~,
