AN ORDINANCE ANNEXING A PARCEL OF LAND
SITUATE IN THE NW QUARTER OF SECTION 17,
TOWNSHIP 31 SOUTH, RANGE 39 EAST,
KNOWN AS "FISCHER'S CORNER," LYING
WEST OF U. S. HIGHWAY #1, EAST OF THE
FLORIDA EAST COAST RAILWAY, SOUTH OF
OLD DIXIE HIGHWAY, AND NORTH OF SEBASTIAN
HIGHLANDS, UNIT 7.
WHEREAS, the sole owner of that certain parcel
of property described hereinafter has petitioned the City
of Sebastian to voluntarily annex this property; and
WHEREAS, the City Council finds and determines
that the petition bears the signatures of all owners of
property in the area proposed to be annexed; and
WHEREAS, the City Council finds and determines
that the area proposed to be annexed is contiguous to
the City of Sebastian, and will not result in the creation
of an enclave; and
WHEREAS, the City Council finds and determines
that the area proposed to be annexed constitutes a reasonably
compact addition to the incorporated territory of the City
of Sebastian; and
WHEREAS, the City Council finds and determines that
the annexation of said property is in the best interests
of the City of Sebastian.
NOW, THEREFORE, BE IT ORDINAED BY THE CITY
COUNCIL OF THE CITY OF SEBASTIAN, FLORIDA, AS FOLLOWS:
SECTION I.
That the following described property now lying
and being in the unincorporated area of Indian River County,
Florida, is hereby annexed to the City of Sebastian, Florida,
and the boundary lines of said City are hereby redefined to
include said property, which is described as follows:
A parcel of land situate in the Northwest quarter
of Section 17, Township 31 South, Range 39 East,
Indian River County, Florida, being more particularly
described as follows: Beginning at the intersection
of the West right of way line of US Highway No. One
(a 120 foot right of way), and the North line of
Sebastian Highlands Unit 7, as recorded in Plat
Book 6, page 6, Public Records of Indian River County,
Florida; thence run N 89° 20' 25" W along said
North line a distance of 734.07 feet to the East
right of way of the Florida East Coast Railway; thence
run N 21° 06' 39" W along said East right of way
a distance of 602.41 feet to a Point of Curve;
thence along said curve to the Southeast having a
radius of 85.0 feet, a delta angle of 89° 51' 30"
an arc distance of 133.31 feet to the Point of
Tangency; thence run N 69° 01' 51" E along the
South right of way of Old Dixie Highway (a 50 foot
right of way) a distance of 415.47 feet; thence
run N 76° 26" 37" E a distance of 125.01 feet to the
West right of way of US Highway No. One, thence
run S 25° 22' 17" E along said right of way a
distance of 774.34 feet to the Point of Beginning.
Containing 9.75 acres, more or less, and subject
to easements and road rights of way of record.
SECTION II.
This Ordinance shall take effect immediately upon
becoming law, and said property shall be subject to all laws,
ordinances and resolutions now in force, or hereafter
adopted, by the City of Sebastian, in accordance with
Florida law.
SECTION III.
A copy of this Ordinance shall be filed with the
Clerk of the Circuit Court of Indian River County and the
Florida Department of State.
I HEREBY CERTIFY that the foregoing Ordinance was
finally approved and passed by the City Council of the

of the foregoing Ordinance was given in accordance with
Chapter 171.044 of the Florida Statutes, on the
