SEC. 2.0S BY STATING THAT TIlE MAYOR AND COUNCIL
RECEIVE COMPENSATION, NOT SALARY, AND PERMITS
REIMBURSEMENT FOR EXPENSES INCURRED WHILE ON
CiTY BUSINESS WHEN APPROVED BY MAJORITY VOTE
OF THE COUNCIL; PLACING QUESTION ON BALLOT FOR
MARCH 13 , 1984; ESTABLISHING .AN EFFECTIVE
DATE; AND STATING SEVERABILITY CLAUSE.
WHEREAS, a majority of the Council have expressed
their opinion that the language in Sec. 2.05 of the Charter
should be clarified to show that the members of the council
receive compensation for their services, and not a salary; and
WHEREAS, a majority of the Council feel that a
unanimous vote of the Council need not be required to approve
reimbursement for expenses as presently provided in Sec. 2.05
of the Charter; and
WHEREAS, the Council desires to submit the
question to the voters in order to determine whether a majority
of the electors of the City are in favor of approving such
a change; and. in order to be bound by said change; and
WHEREAS, the Council desires to comply with the
requirements of Section 166.031, Florida Statutes, pertaining
to amendments of a City's Charter.
NOW, THEREFORE, THE COUNCIL OF THE CITY OF
SEBASTIAN, FLORIDA, HEREBY ORDAINS:
SECTION i.
That Section 2.05 of the Charter of the City of
Sebastian, Florida, is hereby amended to read as follows:
Sec. 2.05. Compensation; Expenses.
(a) Compensation. The compensation of the
mayor, vice-mayor and other members of the Council shall
be as follows:
(1) The Mayor shall be compensated
at the rate of $800.00 per month;
(2) The vice-mayor shall be compensated
at the rate of $250.00 per month;
(3) The members of the Council shall be
compensated at the rate of $150.00 per month.
(b) Expenses~ Remuneration of any expenses
incurred by the mayor or other members of the Council while
on city business shall be subject to approval by the council
and, when approved, reimbursed in accordance with the
provisions of Sec. 112.161, Florida Statutes, as presently
constituted or hereafter amended.
SECTION II.
The ballot at the general municipal election to
be held within the City on Marchl 13 7,1984, shall contain a
referendum for the purpose of allowing the electors of the
City of Sebastian to approve or reject this amendment to
the Charter of the City of Sebastian, Florida.
SECTION IIiI.
If a majority of the electors voting in this
referendum vote for the amendment to the Charter, the Council
shall file said amendment with the Clerk of the Circuit Court
and with the Department of State, and said amendment shall
take effect upon the filing, unless otherwise provided by
law; otherwise, no part of this ordinance shall become law.
SECTION IV.
If any section, subsection, sentence, clause,
phrase or word of this ordinance is for any reason held
unconstitutional or invalid for any reason, such ruling shall
not affect the validity or constitutionality of any of the
remaining portions of this ordinance.
I HEREBY CERTIFY that the foregoing Ordinance
was finally passed by the Council of the City of Sebastian,

I HEREBY CERTIFY that Notice of Public Hearing
of the foregoing Ordinance was given in accordance with
Section 166.041 of the Florida' Statutes, that said public
hearing was held in the City Hall of the City of Sebastian,

was duly passed and adopted by the City Council of the City
