AN ORDINANCE OF THE CITY OF SEBASTIAN, FLORIDA, CREATING A NEW SECTION 18-4, AND THEREBY PROHIBITING PERSONS FROM SWIMMING IN A BODY OF WATER IN SEBASTIAN HIGHLANDS SUBDIVISION, UNIT 1, WHICH BODY OF WATER HAS COMMONLY BEEN CALLED SEBASTIAN SWIM LAKE; PROVIDING AN EFFECTIVE DATE. WHEREAS, there exists a body of water in the Sebastian Highlands Subdivision, Unit 1, commonly called the "Sebastian Swim Lake", and, WHERE~, Chapter lOD-5 of the Florida Administrative Code and Chapter 514, Florida Statutes, require that a permit be issued by the Department of Health and Rehabilitative Services as a prerequisite to allow people to swim in said body of water, and WHEREAS, no such permit has ever been issued to allow swimming in said body of water because the quality of the water does not qualify for a permit due to close proximity to sanitary hazards, poor bacteriological water quality and lack of circulation flow, NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SEBASTIAN, FLORIDA, AS FOLLOWS: SECTION I. That a new Section 18-4 is hereby added to Chapter i8 of the Code of Ordinances of the City of Sebastian, which new Section reads as follows: "Sec. 18-4. Swimming Prohibited. No person shall swim in that body of water situated in Sebastian Highlands Subdivision, Unit 1, and commonly known as Sebastian Swim Lake. Appropriate signs shall be posted around that body of water to advise persons that swimming in that body of water is prohibited." SECTION II. This Ordinance shall take effect immediately upon final passage. I HEREBY CERTIFY that the foregoing Ordinance was finally passed by the ATTEST: City Clerk
