HomeMy WebLinkAboutO-85-20ORDINANCE N' AN ORDINANCE OF THE CITY OF SEBASTIAN, FLORIDA, · ADDING A NEW SECTION 7-17 TO THE CODE OF ORDINANCES, AND THEREBY ADDING LOCAL REQUIREMENTS FOR FOUNDATIONS AND TIE DOWN FOR ALL PERM~NE. NT BUILDINGS, INCLUDING RESIDENCES: PROVIDING AN EFFECTIVE DATE. WHEREAS, Subsection (3) of Section 553.73, Florida Statutes, authorizes municipalities to provide more stringent standards then those specified in the state Minimum Building Codes if local con- ditions justify more stringent requirements for the protection of life and property, provided the additional requirements are not discriminatory against materials, products, or construction tech- niques of demonstrated capabilities; and WHEREAS, the Construction Board of the City of Sebastian, pur- suant to Section 7-92.2(b) of the City Code, has requested that the City Council enact an ordinance which enacts specific local require- ments which apply to all permenant construction, conventional or manufactured, without discrimination; and, WHEREAS, the City Council has considered the recommendations of the Construction Board, and agrees with the recommendations; NOW, THEREFORE, BE IT RESOLVED BY THE CiTY COUNCIL OF THE CITY OF SEBASTIAN, FLORIDA, AS FOLLOWS: SECTION I That a new Section 7-17 of the Code of Ordinances of the City of Sebastian (presently reserved) be added to the code of the City, which new Section reads as follows: "Sec. 7-17. Local Requirements. Notwithstanding anything that might appear or be construed to the contrary in the Standard Building Code adopted by the City by Section 7-16, above, the following requirements shall apply to all construction except mobile homes, and travel trailers. (a) Ail buildings, including residences, except mobile homes and travel trailers, shall meet all requirements which, classify and tax such structures as real estate. (b) Ail buildings with elevated grades shall have the same grade, or higher, beneath the structure as the grade outside of the structure to avoid any cavity or void under the structure except a conventional basement, if provided. (c) If piers or columns are used then all buildings utilizing piers or columns shall meet all requirements regarding footings, foundations, and ratproofing as specified in the Standard Building Code. (d) An equal amount of load must be supported by a perimeter stem wall with footings or a -perimeter footing that uniformly supports all exterior loads. Every building shall have such a perimeter stem wall with footings or a perimeter footing, which shall be a "foundation wall" as defined in C-haPter One of the Standard Building Code. (e) Ail tie down systems shall be permanently attached to the foundation by anchoring devices to resist all loads listed in the Standard Building Code, including resistance to ground movement, potential shearing, overturning, and uplift loads caused by wind, etc.. No ~mbedded screw type earth anchor shall be used to anchor any building except a mobile home or house' trailer. (Refer to Article IX of this Chapter 7 of the Code for local requirements which apply to mobile homes and-house trailers)." SECTION II This Ordinance shall become effective immediately upon final passage by the City Council. ALL DWELLING UNITS UNLESS SPECIFICALLY EXEMPTED SHALL COMPLY WITH THE FOLLOWING: An equal amount of load must be supported by the perimeter footing, specifically there must exist a perimeter stem wall or footing that is strictly the cause for support and supports uniformly all exterior loads. Any .intermediate footings or foundations that are incidental to the perimeter supporting footings must be distributed uniformly and proportionality to the total load. 2) All tie down systems must be permanently attached to that foundation (Item ~1) by anchoring devices adequate to resist all loads .identified in the Standard Building Code. (This .includes resistance to ground movements, potential shearing, overturning and uplift loads caused by wind, etc. ) If piers or columns are used, then all dwelling units utilizing piers and columns must satisfy all requirements concerning footing, foundations and rat proofing for single family detached homes as per the Standard Building Code. In no case shall the imbedded screw type earth anchor be used as a method by which any dwelling unit may be secured. Structures with elevated grade floors shall have the same grade or higher beneath the structure as the outside of the structure. The structure shall also meet all requirements by the Standard Building Code concerning venting, rat proofing, etc. The intent of the paragraph is to avoid a cavity or void under this type of structures, Conventional basements are excluded from this requirement. NOTE: Mobile homes are exempt from these requirements and should be regulated by the latest addition of the Standard Building Code and HUD requirements. (H-83-23 (HUD)). NOTE: it ,is not the intention of this article to limit the use of any engineered roof truss system, or the use of engineered floor trusses where the design is such that the load may be carried on per.~meter bearing footings and foundations.
