9. PROVIDING AN EFFECTIVE DATE.
WHEREAS, the C~ty Council of the City of Sebastian, Florida, has adopted a
Comprehensive Land Use Plan, Ordinance No.0-81-25, pursuant to Florida Statute
163; and
WHEREAS, Florida Statute 163 requires that all future development be con-
sistent with the County's adopted Comprehensive Land Use Plan; and
WHEREAS, the existing zoning of the below described parcels within the City
are not in conformance with the City's adopted Comprehensive Lande Use Plan; and
WHEREAS, the Council has held a public hearing on the proposed re-zonings; and
WHEREAS, the Counci~ finds and determines that the zoning changes made herein
are i~'~ the best interest of the City of Sebastian;
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF SEBASTIAN, FLORIDA:
SECTION I
THAT THE FOLLOWING DESCRIBED PROPERTY SITUATED IN THE CITY OF. SEBASTIAN,
INDIAN RIVER COUNTY, FLORIDA, to-wit~
All that part of the Northwest 1/4 of the Northwest 1/4 of Section 7,
Township 31 South, Range 39 East, being more particularly described as
follows:
All that land lying South of the Trans Florida Central Railroad right-of-way,
North of the North right-of-way of County Road CR-512, west of the east
boundary line of the Northwest 1/4 of the Northwest 1/4, and east of the
Northwesterly extension of a radius through the point of curvature of a
curve having a central angle of 25° 16' 13", with the intersection of the
Southerly right-of-way of said Trans Florida Central Railroad right-of-way,
said curve lying between lots 48 through 55, Block 490, Sebastian Highlands
Unit No. 12, as recorded in Plat Book 7, Page 57, Public Records of Indian
River County, Florida.
Be and the same is hereby re-zoned from INDIAN RIVER COUNTY AGRICULTURAL (AG)

except the following two parcels of land: Parcel #1: Begin at the SE
corner of said Government Lot 2, run North 248.7 feet, thence West 417.4
feet, thence South 248.7 feet, thence East 417.4 feet to the point of
beginning. Parcel #2:Begin237.6 feet South of the NE corner of said
Lot 2, Section 6, which is also the intersection of the SE line of the
Fleming Grant and the East line of said Government Lot 2, thence run
South 245.5 feet, thence West to the SE line of the Fleming Grant Line,
thence Northeasterly along said Fleming Grant Line to the intersection of
said line with the East line of said Government Lot 2 which is the point
of beginning
This land which is located North of the baseball field near the City Hall
building be and the same is re-zoned from RM-8 (MEDIUM DENSITY MULTIPLE
FAMILY RESIDENTIAL) TO COMMERCIAL OFFICE RESIDENTIAL (COR).
SECTION III
THAT THE FOLLOWING DESCRIBED PROPERTY SITUATED IN THE CITY OF SEBASTIAN,
FLORIDA, INDIAN RIVER COUNTY, to-wit:
Begin at the Northwest corner of the Southwest 1/4 of Section 6, Town-
ship 31 South, Range 39 East, run south 209 feet to a point, thence run
East 291 feet to a point, thence run North 209 feet to a point, thence
run West 291 feet to the point of beginning.
Be and the same is hereby re-zoned from INDIAN RIVER COUNTY AGRICULTURAL(AG)
TO GENERAL COMMERCIAL (CG). Said land consists of approximately 1.4 acres
situated South of the Post Office and east of Power Line Road.
SECTION IV
THAT THE FOLLOWING DESCRIBED PROPERTY SITUATED IN THE CITY OF SEBASTIAN,
INDIAN RIVER COUNTY, FLORIDA, to-wit:
The West 291 feet of the Northwest 1/4 of the Southwest 1/4, less the
North 209 feet and less the South 534.5 feet thereof, in Section 6, Town~

3.93 acres.

Easterly along the North line of Section 17, a distance of 682.17' to a
point on the East R/W of the Old Dixie Highway for P.O.B.; thence continue
Easterly along said section line a distance of 369.68' to a point; thence
run Southeasterly and parallel to the West R/W of U. S. Highway No. 1 a
distance of 496.40' to a point; thence run southwesterly a distance of
84.0' to a point; thence run Southeasterly a distance of 226.71' to a point
on the North R/W of the Old Dixie Highway; thence run Southwesterly along
the said North R/W of the Old Dixie Highway a distance of 297.99' to a point
on the East R/W of said Old Dixie Highway; thence run Northwesterly along
the said East R/W of Old Dixie Highway and parallel to the East R/W of the

17, Township 31 South, Range 39 East and comprising an area of 5.92 acres;

approximately 7.49 acres and is located west of U.S. H~ghway No. l, east
of the Florida East Coast Railroad right-of-way, and North and east of
.Old Dixie Highway.

Commencing at the Southeast corner of Government Lot 3, Section 8, Township 31,
South, Range 39 East, run North 89° 36' 19" West a distance of 48.93 feet to
a point on the present West right-of-way line of U.S. Highway No. 1, said
point being the point of beginning of the following description: From said
point of beginning, run North 89° 36' 19" West on the South line of said
Government Lot 3 a distance of 217 feet to a point, thence run northwest
470 feet, more or less, to a point that is 344.19 £eet west of the right-
of-way of said U.S. Highway No. 1 thence run South 89° 35' 15" East 344.19
feet, more or less to a steel pin on the aforesaid West right-of~way line
of U.S. Highway No. 1, thence run South 25° 57' 59': East along said right~
of-way line 370 feet to the point of beginning.
Be and the same is hereby re-zoned from COUNTY C-1 (COMMERCIAL)TO COMMERCIAL
OFFICE RESIDENTIAL (COR). Said land contains 1.82 acres, more or less.
SECTION VII
THAT THE FOLLOWING DESCRIBED PROPERTY SITUATED IN THE CITY OF SEBASTIAN,
INDIAN RIVER COUNTY, FLORIDA, to-wit:
Commencing at the Southeast corner of Government Lot 3, Section 8, Township
31South~ Range 39 East, run North 89° 36' 19" West a distance of 48.93 feet
to a point on the present west right-of-way line of U.S. Highway No. 1,'said
point being 217 feet, more or less, east of following described property:
From said point of beginning, run North 89° 36' 19" West on the South
line of said Government Lot 3 a distance of 217 feet. more or less, to
the true point of beginning of the following described pareel, thence
continue on said line a further distance of 369.68 feet to a point on the
East right-of-way line of a county road (Old Dixie Highway), said right-of-
way being 30 feet East of and parallel to the East righ-of-way of the Florida
East Coast Railroad, thence run North 21° 42' 19" West and parallel to the
aforesaid East right-of-way of the railroad a distance of 358 feet to a point;
thence run South 89° 35' 15" East 230 feet, more or less, thence run South-
east 470 feet, more or less along the West edge of the parcel described in
Section VII, above, to the true point of beginning of the within described
parcel .
Be and the same is hereby re-zoned FROM COUNTY B-i (PLANNED BUSINESS DISTRICT)
TO INDUSTRIAL (IND). Said land consists of 2.52 acres, more or less.
SECTION VIII
THAT THE FOLLOWING DESCRIBED PROPERTY SITUATED IN THE CITY OF SEBASTIAN,
INDIAN RIVER COUNTY, FLORIDA, to-wit:
Blocks 6, 7, 8, and 9, Ocean Breeze Heights Subdivision.
Be and the same is hereby re-zoned FROM COMMERCIAL OFFICE RESIDENTIAL (COR)
TO LIMITED COMMERCIAL (CL).
SECTION IX
The provisions of this Ordinance shall become effective upon receipt from
the Secretary of State of Official acknowledgment that the Ordinance amending
the Comprehensive Land Use Plan enacted on the same date as this Ordinance
has been filed with the Department of State.
I HEREBY CERTIFY that the foregoing Ordinance was finally passed by the
City Council of the City of Sebastian, Florida, on the /~/~ day of

I HEREBY CERTIFY that Notice of Public Hearing on the foregoing Ordinance was
given in accordance with Florida Statutes; that a public hearing was held on
the foregoing Ordinance before the City Council of the City of Sebastian,

said public hearing on the foregoing Ordinance was passed by the City Council
of the City of Sebastian, on the / D ~ day of ~/~ ~r~[~ , 1985,
