HomeMy WebLinkAboutO-86-25ORDINANCE NO. ~' ~_~__~__~__ AN ORDINANCE OF THE CITY OF SEBASTIAN, FLORIDA, ENACTING A NEW SECTION 2-65 AND THEREBY PROVIDING PROCEDURES FOR THE SALE OR ABANDONMENT OF REAL AND PERSONAL PROPERTY OWNED BY THE CITY; PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SEBASTIAN, FLORIDA, AS FOLLOWS: SECTION I That a new Section 2-65 of the Code of Ordinances of the City of Sebastian, Florida, reading as follows: "Sec. 2-65. ~1~ or Abandonment ~ Qik~ R~R~[~ (a) Personal ProR~[~. If upon recommendation of the res- pective Department Head, the Chief Administrative Officer has determined that personal property owned by the city is no longer needed or is obsolete the property may be sold by bid or by auction. Notice of sale shall be published once in a newspaper of general circulation in the city. The Chief Administrative Officer shall establish a price, or sale by auction; however, if the depreciated value of any personal property is in excess of $4,000.00 aproval of the city council is required prior to sale. (b) Real ProR~. When the city council has determined that any real property which is owned by the city is no longer needed the property may be sold by bid or by auction with reserve. Notice of sale shall be published once a week for at least 2 weeks in a newspaper of general circulation in the city calling for bids and specifying the terms of purchase, including the minimum price, if any. If a suitable offer to purchase is not received the city may terminate the sale procedure and may reinitiate such procedures if desired. (c) Abandonment of interest in real 9R~k~. The city may abandon any city-held easement or other city interest in real property by adopting an ordinance declaring the interest abandoned. In the case of utility easements or lot easements the abandonment may be by adopting a resolution to abandon the easement(s). (d) Biddin~ Procedures. The bidding procedures set forth in Section 2-64, above, for purchasing items shall apply to paragraphs (a) and (b) of this section 2-65 if the item is offered for sale by bid." IS HEREBY ENACTED. SECTIQN II This Ordinance shall be effective immediately upon final passage.
