AN ORDINANCE OF THE CITY OF SEBASTIAN, iNDIAN RIVER COUNTY,
FLORIDA, LEVYING OCCUPATIONAL LICENSE FEES ON BUSINESSES,
PROFESSIONS AND OCCUPATIONS; PR0VIDING FOR REPEAL OF CHAPTER
14 AS IT PRESENTLY APPEARS AND CREATING A NEW CHAPTER 14,
PROVIDING FOR ISSUANCE OF LICENSES FOR BUSINESSES,
PROFESSIONS AND OCCUPATIONS IN THE CITY OF SEBASTIAN,
FLORIDA; TO INCREASE LICENSE FEES ON CERTAIN BUSINESSES,
PROFESSIONS AND OCCUPATIONS; PROVIDING FOR THE PAYMENT
THEREOF; REGULATING THE CONDUCT OF THE SAME; PRESCRIBING A
PENALTY FOR THE VIOLATION OF THIS ORDINANCE AND FOR OTHER
PURPOSES; PROVIDING FOR PAYMENT OF ATTORNEY'S FEES;
PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the City Council desires to make substantial amendments
to Chapter 14, Sebastian Code of Ordinances; and
WHEREAS, the City Council has determined it would be simpler to
handle such amendments by repealing said Chapter 14 and creating a new
Chapter 14.
BE IT ENACTED BY THE CITY COUNCIL OF THE CITY OF SEBASTIAN, INDIAN
RIVER COUNTY, FLORIDA, as follows:
SECTION 14-1 ~ O~ Present Ordinance. Chapter 14, Code of
Ordinances as it appears prior to the effective date of this Ordinance
is hereby repealed and a new Chapter 14, Code of Ordinances, is hereby
created to contain the provisions set forth in this ordinance.
SECTION 14-2 Definitions.
(a) Applicant shall mean any person desiring to obtain a license
under the provisions of this Ordinance.
(b) Business shall mean any activity, enterprise, profession or
occupation, performed or engaged in by any person or persons for gain,
benefit, advantage or livelihood, and shall include all such activi-
ties or enterprises whether performed in one or more establishments by
one or more organizational units including departments of an establish-
ment operated through leasing arrangements. For purposes of this
Ordinance, a business not-for-profit shall be included within the
terms of this definition unless otherwise exempted.
(c) "City" shall mean the City of Sebastian, Florida.
(d) "Chief Executive Officer" shall mean the Mayor of the City
of Sebastian, Florida, and/or his designee or the city manager if
the city has a city manager.
(e) "Classification" shall mean the business a person has been
designated to fall within under the Schedule provided for in this

(f) "Contractor" shall mean any person accepting or offering to
accept orders or contracts for doing any work on or in any building or
structure requiring the use of building materials or accepting or
offering to accept orders or contracts to do any paving or curbing on
sidewalks or streets, public or private property, requiring the use of
appropriate materials or any compositions; or accepting or offering to
accept orders or contracts to excavate earth, rock or material for
foundations or any purpose; or accepting or offering to accept orders
or contracts for building, remodeling, repairing, wrecking, razing or
demolishing any structure; or moving any building, or for the
installation, maintenance or repair of signs, air conditioning
apparatus or equipment; shall be deemed a contractor, whether such
work is done or offered to be done by day labor, general contractor or
subcontractor. Every person engaged in the business of accepting or
offering to accept orders for contracts for doing any work on or in
building or premises involving erection, installing, altering,
repairing, servicing or maintaining of lines, shall be deemed to be an
electrical contractor. Every person engaging in the business of
plumber or steam fitter shall be deemed to be a contractor.
(1) Every person engaged in the business of creating a
building or buildings for the purpose of selling or renting the same,
and making no contract with a duly licensed contractor for the
erection of said building, whether or not such person contracts with
one or more duly licensed contractors for one or more portions but
does not contract with any one person for all the work of erecting any
one of said buildings, shall be deemed to be a contractor if he shall
build more than one house in any one year.
(2) No license shall be issued to any contractor, general
or otherwise, unless the applicant therefore shall first present to
the City a Certificate showing said applicant to be insured for
general tort liability in the amount of not less than One Hundred
Thousand Dollars ($100,000.00) to any one person, Three Hundred
Thousand Dollars ($300,000.00) for any one accident, and Twenty-five
Thousand Dollars ($25,000.00) property damage per accident.
(g) "Farmer" shall mean those described in S205.064, Florida
Statutes, and any successor thereto.

(h) "Fee" shall mean those charges established by the City
Council of Sebastian, Florida contained within the Schedule of this
Ordinance, and as such charges may be amended from time to time, and
promulgated pursuant to the authority conferred upon the City by
Ch. 205, Florida Statutes or any successor thereto, for the privilege
of doing business in the City.
(i) "Finance Director" shall mean the finance director for the
City of Sebastian, Florida or his/her designee.
(j) "License" shall mean the document granted by the City under
the provisions of this Ordinance and required of any person before
such person can engage in any business within the City.
(k) "Persons," for the purposes of this Ordinance, shall mean
any individual, firm, partnership, joint venture, syndicate or other
group or combination acting as a unit, association, corporation,
estate, trust, business trust, executor, trustee, administrator,
receiver or other fiduciary and shall include the plural as well as
the singular.
SECTION 14-3 Persons Subject to ~i~R~. A fee for the
privilege of engaging in or managing any business, within the City is
hereby levied on:
(a) Any person who maintains a business location or branch
office within the City for the privilege of engaging in or managing
any business within its jurisdiction;
(b) Any person who maintains a business location or branch
office within the City for the privilege of engaging in or managing
any profession or occupation within its jurisdiction; and
(c) Any person who does not qualify under the provisions of (a)
and (b) above and who transacts any business or engages in any
occupation or profession in interstate commerce where such license fee
is not prohibited in Section 8 of Article 1 of the United States
Constitution.
SECTION 14-4 ~i~ ~i~. No person shall engage in the
activities for which a license is required without first procuring
a license from the City, and before issuance of said license, paying
the amount of the fee required for any business as provided herein.
SECTION 14-5 DisagIg~9~ as to Classification~ A~peal. If
there is a disagreement between the applicant and the City on the

question of proper classification for any person or business licensed
or to be licensed, the City Clerk shall decide the proper classifi-
cation with the right of the applicant to appeal the decision to the
Chief Executive Officer, whose decision upon the point shall be final.
SECTION 14-6 ~ ~ ~i~B~i ~hen Fee Duel Half-Year License
for New Businesses[ Delinquencies.
(a) The fiscal year for all licenses shall begin October 1st. No
license shall be issued for more than one year.
(b) For each license obtained by new business after April 1st of
any year, one-half (1/2) of the fee for one year shall be paid, however,
all seasonal, transitory, intermitent or businesses or professions of
short term duration shall pay the full fee irrespective of the date of
application. For example, circuses, road shows, traveling salesman,
etc.
(c) All fees required to be paid by this Ordinance shall be
deemed delinquent if not paid and renewed by October 1st and all
persons delinquent in the payment of such fees shall be required
to pay a penalty of an additional ten percent (10%) of the fee for the
month of October plus an additional five percent (5%) penalty for each
month or part thereof that such person is delinquent. However, the
total delinquency penalty shall not exceed fifty percent (50%) of the
fee.
(d) Violations of this ordinance are under the jurisdiction of
the Code Enforcement Board.
SECTION 14-7 ~R~[~[9 Lice~9 for Each Business. A separate
license shall be obtained for each place of business conducted,
operated, maintained or carried on by every person engaged in any
business for which a license is required by the Ordinances of the
City, even though such separate business is conducted within or upon
the same premises.
SECTION 14-8 Chan~ ~ ~i~£ ~. Upon written request and
presentation of the original license, any license may be transferred
from one location in the City to another location within the City upon
payment of a transfer fee of three dollars ($3.00).
SECTION 14-9 Transf~ ~ ~i~ ~ ~ Q~n~ ~. A license
may be transferred to a new owner when there is a bona fide sale of a
business upon payment of a transfer fee of the three dollars ($3.00)
and presentation of evidence of the sale and the original license.
SECTION 14-10 Fi~iD~ ~i~a~i~n ~ ~proval of ~hief
Executi~ Qfficer Req~i~9~. All applicants for licenses requiring
approval of the Chief Executive Officer of the City shall submit
applications to the City Clerk not less than two (2) weeks prior to
commencement of the proposed activity/function.
SECTION 14-11 Evidence o~ ~a~ia~ in ~ai~. The
advertisement of any business by sign, newspaper, magazine, telephone
listing, or other public notice shall be conclusive evidence of the
engaging in and carrying on the business in the City so advertised.
SECTION 14-12 ~9~ptions. Any persons entitled to exemption
under the laws of the State of Florida shall be exempt from payment of
fee to the City. In the event a fee exemption provision applies, a
license must still be applied for and approved.
(a) Veterans must be at least ten percent (10%) disabled to
qualify for exemption. However, in no case shall a person be exempt
from payment of a fee in excess of fifty dollars ($50.00).
(b) Nothing in this Ordinance shall be construed to require any
farmer to procure a license to sell vegetables or fruits within the
City, if such vegetables or fruits are the produce of his own farm
located within the State of Florida.
(c) No license shall be required of any charitable, religious,
fraternal, youth, civic, service, or other such organization when the
proceeds are used exclusively for the organizations.
SECTION 14-13 Renewal ~ki~9~i ~~ipt of ~otice ~ Defense.
The City Clerk shall send out annual renewal notices to all businesses
that hold a license at the end of each Fiscal Year. Failure to
receive such notice will not be considered a justifiable defense for
nonpayment of any fee or late fee.
SECTION 14-14 Duti 9~ Q~i~9~a~ A~n~ 9~ ~~a~i~
Individual Liability. It shall be the duty of all officers and agents
of any corporation to ensure that such corporation complies with the
provisions of this Ordinance, and all officers or agents of any
corporation required by this Ordinance to be licensed shall be
personally subject to the penalties imposed by this Ordinance where
any corporation fails to pay the fee and obtain a license required by
this Ordinance. It shall be the responsibility of any real estate

agency, brokerage house, or other firm of any description to ensure
that each agent, salesman, or broker affiliated with such firm
complies with timely payment of the individual tax as specified in
this chapter. Failure to do so will subject the firm to fines as may
be imposed by the Code Enforcement Board of the City.
SECTION 14-15 Du~ of Ci~ ~lerk to Kee~ R9~9~. The City
Clerk shall keep a complete record of all licenses issued, showing the
nature of the license, the date of issuance, the date of expiration
and to whom it was issued.
SECTION 14-16 ~a~i~ ~i~ &~!i~i~. The City Clerk is
authorized to require updated license applications.
SECTION 14-17 ~~i~ a~ ~ia~%a~ ~ ~i~na~a. All
licenses granted by the City shall be carefully preserved and
displayed in a conspicuous place in the place of business authorized
to be conducted by said license.
SECTION 14-18 Issuanc~ 9~ ~i~gRa9 ~ot Prima Facie Evidence of
Abilit~ to Conduct Business. All businesses are subject to City
zoning restrictions. The issuance of a license hereunder does not
constitute the only authorization required to conduct a business in
the City. It shall not give a person the legal right and authority to
conduct any business in violation of any law, and in such event, no
refund of the fee shall be authorized.
SECTION 14-19 ~ Refund of ~ ~R~i~B. No portion of any
fee herein assessed shall be refunded except when such fee is
collected by mistake or error. Refunds shall not be made after the
license period from October 1 through September 30 for which the
erroneous payment was made has expired.
SECTION 14-20 ~i~n~e for ~a~ ~ A~~i~ ~a~. Licenses
for the sale of intoxicating liquor, beer and wine shall be issued,
suspended, revoked, etc., in accordance with the Florida Statutes and
said Statutes shall govern the licensing thereof.
SECTION 14-21 ~~ ~ ~9~R~i~ hX ~£ Q~a~u~ki~ 9~
Streets= ~idewalks= Public Places. Nothing in this Ordinance shall be
construed to interfere with the regulation or taxation of any person
in business against whom the right of taxation has been preempted by
the State of Florida or as giving to any person the right to obstruct
the streets, sidewalks, or other public places in the City.

SECTION 14-22 ~Dlawful to QR~ ~i59~ ~i~ ~i~9~a~. It
shall be unlawful for any person, firm or corporation to engage in any
business or in keeping or maintaining any institution, establishment,
article, utility or commodity, without first procuring and paying for
a license to do so or to knowingly make a false statement in the
application for license as to conditions or factors upon which the fee
is or shall be based.
SECTION 14-23 Pena~ ~Q~ QR~a~i~ ~ ~i~ ~i~ ~i~nse.
Any person engaging in or managing any business, occupation or
profession without first obtaining a license, if required hereunder,
shall be subject to a penalty of twenty-five percent (25%) of the
license determined to be due, in addition to any other penalty
provided by law or ordinance. The business must cease operation in
the City until this license is obtained.
SECTION 14-24 Rg~a!~ ~ Yi~!~i~- Any person, firm or
corporation violating any of the provisions of this Ordinance shall,
upon Hearing thereof, be subject to a fine as may be imposed by the
Code Enforcement Board of the City.
SECTION 14-25 ~i~ ~ Liable for ~ama~9~ for ~a~ga ~m
Revg~kigR. The City shall not be liable for any loss, monetary or
otherwise, due to the revocation of a license. Revocation of license
shall require the business to cease operation in the City. The
revocation of license shall continue until such time as the
violation(s) that caused the revocation are certified by the Chief
Executive Officer as having been corrected. The following shall
constitute grounds for revocation of a license:
(a) A determination by the Chief Executive Officer that any
statement contained in the application for a license is false.
(b) The licensee has violated City or County ordinances or laws
of the State of Florida in the practice of business for which such
license is issued.
(c) The licensee fails to comply with the zoning, fire
prevention and code enforcement ordinances of the City after
reasonable notice shall have been given to the licensee to eliminate
or correct any condition in violation of such ordinances of the
licensed premises.

SECTION 14-26 Special Requireme~ for ~ Circuses and
Qther s~ik~l~R~ ~ttraction~. A carnival, circus, or any amusement
attraction shall meet the additonal requirements listed herein before
a license will be issued:
(a) File with the City Clerk a sworn affidavit from the owner or
lessee of the property upon which the attraction is to be held stating
that permission has been granted to use the property for such purpose.
(b) Furnish a bond, collateral or other security in the amount
of Fifteen Hundred Dollars ($1,500.00) for an expense the City may
incur in cleaning all rubbish and debris from the premises used by the
attraction.
(c) Obtain approval in writing of the zoning, fire prevention
and code enforcement divisions of the City.
(d) File with the City Clerk a written statement from the Indian
River County Health Department that the facilities for selling food,
food stuffs or drinks for human consumption are satisfactory.
(e) File with City Clerk proof of active liability insurance in
'the amount of One Hundred Thousand Dollars ($100,000.00).
(f) Furnish the City of Sebastian Police Department a list of
names of all managers, employees, and all other persons connected or
working with all or any portion of the attractions, their permanent
addresses, social security numbers and any other information requested
by the Police Chief of the City.
SECTION 14-27 Fee for Business Not Specifically Included in
Schedule. Every business, fixed or temporarily engaged in by any
person, whether in a building or tent, or upon a street, vacant lot,
or anywhere within the City not herein specifically designated shall
pay a fee of thirty dollars ($30.00).

SECTION 14-29 ATTORNEY'S FEES. If the City initiates legal
proceedings against any persons to enforce any provision of this
Ordinance, including appellate proceedings, the City shall be entitled
to recover reasonable attorney's fees, court costs, and such
additional costs the court shall deem appropriate.
SECTION 14-30 ADOPTION SHALL NOT P_R~ ALTERNATION OF LICENSE
FEE SCHEDULe. The adoption of the Schedule contained herein shall not
abridge the right of the City Council to change, alter, increase or
decrease, any of the fees provided for herein at any time; or to pass
other Ordinances providing for the excise or license taxes of other
license assessments whether pertaining to any of the subjects
contained or provided for in this Ordinance or not, and the same shall
not affect any of the matters or provisions of this Ordinance unless
specifically so stated.
SECTION 14-31 ~ CLAUSE. If any portion, clause, phrase,
sentence or classification of this Ordinance is held or declared to be
either unconstitutional, invalid, inapplicable, inoperative or void,
such declaration shall not be construed to affect other portions of

the Ordinance; it is hereby declared to be the express opinion of the
Mayor and the City Council of the City of Sebastian that any such
unconstitutional, invalid, inapplicable, inoperative or void portion
or portions of this Ordinance, did not induce it's passage, and that
without the inclusion of any such portion or portions of this
Ordinance, the Mayor or the City Council would have enacted the valid
constitutional portions thereof.
SECTION 14-32 .~FECTIVE DATE. This Ordinance shall become
effective upon passage by the City Council.
