ORDINANCE NQ, Q-87-22
AN ORDINANCE OF THE CITY OF SEBASTIAN, FLORIDA,
AMENDING PARAGRAPH B OF SECTION 20A-6.1 OF ARTICLE VI
OF THE CITY OF SEBASTIAN LAND DEVELOPMENT CODE AND
THEREBY CODIFYING THE NOTICE REQUIREMENTS AS A
PRECONDITION FOR APPROVAL OF ANY CONDITIONAL USE; PRO-
VIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SEBASTIAN,
FLORIDA, AS FOLLOWS:
SECTION
That Paragraph B of Section 20A-6.1 of Article VI of the
Land Development Code of the City of Sebastian, now reading as
follows:
"B. General Provision regulating conditional uses.
to approval, a conditional use must be found to:"

applicant desiring approval of a conditional use shall
supply the City Clerk with the names and addresses of all
owners of parcels of real property within two hundred (200)
feet of the parcel to be considered for the requested
conditional use and shall prepay the City Clerk the postage
needed to mail written notices to said property owners. The
City Clerk shall by regular mail send a written notice to
all owners of real property within 200 feet of the parcel of
land to advise the owners of the request for the conditional
use. Such notice shall advise all such owners, in simple
terms, the proposed change and the time, date and place of
the public hearing before the Planning and Zoning Board, and
that they are invited to attend and express their views
thereon. These provisions for mailing are directory only.
Failure to mail such notices shall not affect any action
taken by the Board on such application. The notices shall
be postmarked at least 14 days prior to the hearing date for
all owners whose address as shown on the then existing tax
assessment roll is not in the State of Florida, and at least
10 days prior to the hearing date for those owners who have
a Florida address as shown on said assessment roll.

Subparagraphs 1 through 4 of Paragraph B remain unchanged.
SECTION Iii
This Ordinance shall become effective immediately upon final
passage but shall not affect any now existing applications for
conditional uses presently pending with the City.
