HomeMy WebLinkAboutO-96-08ORDINANCE NO. 0- ~-~ AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SEBASTIAN, FLORIDA, AMENDING SECTION 20A- 15.5 OF THE CODE OF ORDINANCES REGARDING TEMPORARY SIGNS; PROVIDING FOR SEVERABILITY, PROVIDING FOR CONFLICTS, AND PROVIDING FOR AND EFFECTIVE DATE. WHEREAS, the City Council of the City of Sebastian, Florida, has enacted Ordinance No. 0-95-2--1, providing for temporary use permits, and WHEREAS, said Ordinance provides that activities or events for which a temporary use permit has been obtained shall not be counted toward the three (3) event maximum for temporary signs for special events as provided in Section 20A-15.5{P) (1), and WHEREAS, the City Council of the City of Sebastian, Florida, desires to amend Section 20A-15.5 (F) to reflect said provision. NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SEBASTIAN, FLORIDA, THAT: SECTION 1. Section 20A-15.5 (F) of the Code of Ordinances of the City of Sebastian, Florida is hereby amended to read as follows: F. Public, charitable, educational, religious, short term special sales promotion, or special event signs. Temporary signs announcing any public, charitable, educational, religious or other special event or function may be installed subject to compliance with the following conditions: 1. Timing of placement and removal. Such signs shall be placed not more than fourteen (14) days prior to the event and must be removed not later than twenty-four (24) hours after termination of the event. A maximum of three 3) separate occasions or special events may be permitted within any three hundred sixty-five-day period, provided, however, that any activity or special event for which a temporary use permit has been obtained shall not be counted toward said maximum. Exception: Any new business or relocation of an existing business within the City of Sebastian shall be allowed grand opening signs not to exceed thirty (30) days. These signs shall not count as a special event sign as described above. 2. Character of signs. Such signs shall not exceed the following requirements: (a) Properties with less than one hundred (100) feet of frontage shall be permitted a total of thirty-two (32) square feet of sign area. (b) Properties of more than one hundred (100) feet of frontage shall be permitted a total of sixty-four (64) square feet of sign area. (c) Banners are permitted to be utilized as a temporary promotional sign. 3. Waiver from requirement of subsection. The building official shall advise any applicant desiring relief from subsection 20A-15.5(F) of his right to approach the city council to request a waiver of such requirements. Upon request of an applicant, the city council may alter or waive the requirements of subsection 20A- 15.5 (F) of this article. SECTION 2. All other Ordinances or parts of Ordinances, Resolutions or parts of Resolutions in conflict herewith are hereby repealed to the extent of such conflict. SECTION 3. If any clause, section, or other part or application of this Ordinance shall be held by any Court of competent jurisdiction to be unconstitutional or invalid, such unconstitutional or invalid part or application shall be considered as eliminated, in no way affecting the validity of the remaining portion or applications, which shall remain in full force and effect. SECTION 4. This Ordinance shall become effective thirty (30) days after its passage and adoption.
