R-26-12 A RESOLUTION OF THE CITY OF SEBASTIAN, INDIAN RIVER COUNTY, FLORIDA, ADOPTING THE CITY OF SEBASTIAN BROADCAST, USE OF FACILITIES, AND WEBSITE POLICY; SUPERSEDING RESOLUTION NO. R-19-15; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; PROVIDING FOR SCRIVNERS ERRORS AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City Council, by adoption of Resolution No. R-05-09 in 2005, approved a "City of Sebastian Public Broadcast Policy" governing the use of audiovisual equipment, the government access cable channel (COStv), and the City website; and WHEREAS, the City Council, by adoption of Resolution No. R-19-15, adopted a revised "City of Sebastian Public Broadcast and Use of City Facilities Policy" to establish parameters for the use of City facilities and City Media Platforms; and WHEREAS, since the adoption of Resolution No. R-19-15, the City's digital presence has expanded to include additional public -facing platforms, event sponsorship programs, City -operated facilities including the Sebastian Municipal Airport and Sebastian Golf Course, and a broader range of public information services administered through the City website and COStv; and WHEREAS, the City Council finds that a comprehensive revision of the existing policy is necessary to address current City operations, clarify departmental responsibilities for content management, establish express exemptions for event sponsorships and facility -specific content for the Sebastian Golf Course and Sebastian Police Department, ensure compliance with Florida's Public Records Act (Chapter 119, Florida Statutes) and applicable accessibility requirements, and provide for the adoption of a fee schedule for authorized non -City use of Council Chambers; and WHEREAS, the City Council finds that the adoption of this Resolution and the Broadcast, Use of Facilities, and Website Policy attached hereto as Exhibit `A' is in the best interest of the residents of the City of Sebastian. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SEBASTIAN, INDIAN RIVER COUNTY, FLORIDA, as follows: SECTION 1. RECITALS INCORPORATED. The foregoing recitals are hereby incorporated by reference as if fully set forth herein. SECTION 2. ADOPTION OF POLICY. The City of Sebastian Broadcast, Use of Facilities, and Website Policy, attached hereto and incorporated herein by reference as Exhibit `A' (the "Policy"), is hereby adopted. The Policy shall govern the City's use of its government access cable channel (COStv), audiovisual facilities, and all websites owned and operated by the City of Sebastian, as well as the recognition of qualifying event sponsors, Golf Course vendors and brands, and Sebastian Police Department community programs on City Media Platforms. SECTION 3. SUPERSESSION. Resolution No. R-19-15, and any prior resolutions or parts of resolutions adopting or amending the City of Sebastian Public Broadcast Policy or the City of Sebastian Public Broadcast and Use of City Facilities Policy, are hereby superseded in their entirety and shall be of no further force or effect upon the effective date of this Resolution. SECTION 4. POLICY REVISIONS. Revisions to the Policy that do not materially alter its substantive standards or express exemptions may be adopted administratively by the City Manager without further action by the City Council. Revisions that materially alter the Policy's substantive standards or exemptions shall require adoption by Resolution of the City Council. SECTION 5. CONFLICT. All resolutions or parts of resolutions in conflict herewith are hereby repealed to the extent of such conflict. SECTION 6. SEVERABILITY. If any section, subsection, sentence, clause, or phrase of this Resolution is for any reason held to be unconstitutional or invalid, such decision shall not affect the validity of the remaining portions of this Resolution. SECTION 8. SCRIVENER'S ERRORS. Sections of this Policy may be renumbered or re - lettered, and corrections of typographical errors which do not affect the intent may be authorized by the City Manager, or the City Manager's designee. SECTION 8. EFFECTIVE DATE. This Resolution shall take effect immediately upon adoption.
