AN ORDINANCE OF THE CITY OF SEBASTIAN, INDIAN
RIVER COUNTY, FLORIDA, AMENDING THE LAND
DEVELOPMENT CODE RELATING TO THE OFFICIAL
ZONING MAP AND LAND USE CLASSIFICATIONS BY
SUBSTITUTING COMMUNITY DEVELOPMENT DIRECTOR
FOR CITY CLERK AND BUILDING OFFICIAL; PROVIDING
FOR CODIFICATION; PROVIDING FOR CONFLICTS;
PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN
EFFECTIVE DATE.
WHEREAS, the City Council of the City of Sebastian, Florida, desires to amend
the Land Development Code relating to the official zoning map and land use classifications
by substituting Community Development Director for City Clerk and Building Official; and
WHEREAS, the City Council of the City of Sebastian, Florida, believes that it is in
the best interests of the health, safety, and general welfare of the community to do so,
NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF
THE CITY OF SEBASTIAN, FLORIDA, THAT:
Section 1. Section 20A-2.2.B. of the Land Development Code, City of Sebastian, Florida
is hereby amended to read as follows:
Section 20A-2.2. Official zoning map and district boundaries.
Map amendment. No changes or amendments to the official zoning map shall
be made except in compliance and conformity with all procedures set forth in
this code. If changes or amendments are made to district boundaries or other
subject matter portrayed on the official zoning map, such changes or
amendments shall be made promptly after official adoption of the change or
amendment as provided for herein. The Community Development Director
shall be responsible for the physical updating and amendment of the official
zoning map.
Section 2. Section 20A-2.5.D. of the Land Development Code, City of Sebastian, Florida is
hereby amended to read as follows:
Section 20A-2.5. Land use classifications.
3. Mam~acturing activities, including assembly and distribution of goods,
maintenance, repair, reconditioning, cleaning, transportation, utilities,
printing, cooking, fruit and vegetable packing and/or processing,
general packaging and processing activities, testing and research and
development industries, ice plants, commercial laundries, stone shops,
machine shops, agricultural research laboratories, vocational and trade
schools, and accessory uses.
Other manufacturing uses approved by the Community Development
Director based on similarity of use, excluding metal fabrication,
chemical or petroleum manufacturing, rubber or plastics manufacturing,
or other use generating potentially harmful nuisance impacts such as
noise, vibration, glare, dust, explosive or fire hazard, offensive odors
beyond the property line or causing air or water pollution in violation
of performance standards contained herein or in violation of applicable
state or federal standards; and based on absence of any characteristic
dissimilar and incompatible with the uses identified herein.
Truck or bus terminal facilities, including motor freight transportation,
and moving and storage facilities.
Manufacturing service establishments, such as heavy machinery repair
and service; heavy machinery or heavy equipment rental or other
service uses approved by the Community Development Director based
on similarity of use, excluding services which may generate potentially
harmful nuisance impacts; and based on absence of any characteristic
dissimilar and incompatible with the uses identified herein.
Section 3. CODIFICATION. It is the intention of the City Council of the City of
Sebastian, Florida, that the provisions of this Ordinance shall become and be made a part of
the Land Development Code of the City of Sebastian, Florida, and that the sections of this
Ordinance may be renumbered, relettered, and the word "ordinance" may be changed to
"Section", "Article", or such other word or phrase in order to accomplish such intention.
Section 4. CONFLICT. All other Ordinances or parts of Ordinances, Resolutions or
parts of Resolutions in conflict herewith are hereby repealed to the extent of such conflict.
Section 5. SEVERABILITY, If any clause, section, or other part or application
of this Ordinance shall be held by any Court of competent jurisdiction to be
unconstitutional or invalid, such unconstitutional or invalid part or application shall be
considered as eliminated, in no way affecting the validity of the remaining portions or
applications, which shall remain in full force and effect.
Section 6. EFFECTIVE DATE. This Ordinance shall become effective on July 1,
1997.
