AN ORDINANCE OF THE C I TY COUNC I L OF THE C I TY OF
SEBASTIAN, INDIAN RIVER COUNTY, FLORIDA, AMENDING THE
CODE OF ORDINANCES TO REQUIRE TERMITE SHIELDS ON ALL NEW
CONSTRUCTION OF WOOD FRAME BUILDINGS AND STUCCO STOPS ON
ALL NEW CONSTRUCTION OF STUCCO BUILDINGS, PROVIDING FOR
CODIFICATION, PROVIDING FOR CONFLICTS, PROVIDING FOR
SEVERABILITY, AND PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the City Council of the City of Sebastian, Florida
desires to amend Section 26.32 of the Code of Ordinances to add the
requirement that termite shields be installed on all new wood frame
buildings and stucco stops be installed on all new masonry block
buildings; and
WHEREAS, the Construction Board at its regular meeting of
February 11, 1997, recommended an amendment to the Code of
Ordinances to require termite shields be installed on all new wood
frame buildings and stucco stops be installed on all new masonry
block buildings; and
WHEREAS, the City Council of the City of Sebastian, Florida,
believes that it is in the best interests of the health, safety,
and general welfare of the community to so amend Section 26.32.
NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF SEBASTIAN, INDIAN RIVER COUNTY, FLORIDA, as follows:
Section 1. Section 26.32 (7) . Section' 26.32 (7) is hereby
added to the Code of Ordinances as follows:
(7) All new construction of wood frame buildings using
either siding or stucco shall be required to install termite
shields approved by the Building Department on the exterior walls
between the bottom plate and the slab. All new construction of
masonry block buildings using stucco shall be required to have
stucco stops installed six inches (6") above finish grade.
Section 2. CODIFICATION. It is the intention of the City
Council of the City of Sebastian, Florida, that the provisions of
this Ordinance shall become and be made a part of the Code of
Ordinances of the City of Sebastian, Florida, and that the sections
of this Ordinance may be renumbered, relettered, and the word
"ordinance" may be changed to "Section", "Article", or such other
word or phrase in order to accomplish such intention.
Section 3. CONFLICT. Ail other Ordinances or parts of
Ordinances, Resolutions or parts of Resolutions in conflict
herewith are hereby repealed to the extent of such conflict.
Section 4. SEVERABILITY. If any clause, section, or
other part or application of this Ordinance shall be held by any
Court of competent jurisdiction to be unconstitutional or invalid,
such unconstitutional or invalid part or application shall be
considered as eliminated, in no way affecting the validity of the
remaining portions or applications, which shall remain in full
force and effect.
Section 5. EFFECTIVE DATE. This Ordinance shall become
effective immediately upon its adoption.
