O-98-11 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SEBASTIAN, INDIAN RIVER COUNTY, FLORIDA ADOPTING A MILLAGE RATE OF 6.5000 FOR THE CITY'S GENERAL OPERATING FUND FOR THE FISCAL YEAR BEGINNING OCTOBER 1, 1998 AND ENDING SEPTEMBER 30, 1999; PROVIDING FOR SEVERABILITY; PROVIDING FOR CONFLICTS; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, a budget has been prepared estimating expenses and revenues of the City of Sebastian, Indian River County, Florida, for the ensuing fiscal year, with detailed information, including revenues to be derived from sources other than ad valorem levy, and the administrative staff of the City has made recommendations as to the amount necessary to be appropriated for the ensuing fiscal year; and WHEREAS, the City Council has met and considered the recommendations, the suggested budget, and the proposed millage necessary to be levied to carry on the government of the City for the ensuing year; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SEBASTIAN, INDIAN RIVER COUNTY, FLORIDA, THAT: Section 1. The millage rate necessary to be levied against ad valorem valuation of property subject to taxation in the City of Sebastian, Indian River County, Florida, to produce a sufficient sum which together with departmental and other revenues will be sufficient to pay for appropriations made in the budget for the fiscal year is hereby set at 6.5000 mills. Section 2. A copy of the budget was published in one issue of a newspaper published in Indian River County, Florida, at the same time the public was notified of a public hearing to be held on the 22nd day of September, setting a final tax levy and final budget. If any clause, section, or other part of this Ordinance shall be held by any Court of competent jurisdiction to be unconstitutional or invalid, such unconstitutional or invalid part shall be considered as eliminated and shall in no way affect the validity of the other provisions of this Ordinance. Section 5. All Ordinances or pans of Ordinances in conflict herewith are hereby repealed to the extent of such conflict. Section 6. This Ordinance shall become effective on October 1, 1998. Section 7. This Ordinance was advertised by a "TRIM" notice for a public hearing to be held on September 10, 1998, and was advertised in the Vero Beach .Press Journal on the 11th and the 18th days of September, 1998, for a public hearing to be held on the 22nd day of September, 1998, at which time it was moved for adoption by Councilmember The motion was seconded by Councilmember and, upon being put to a vote, the vote was as follows: 2 Mayor Ruth Sullivan Vice Mayor Martha S.
