AN ORDINANCE OF THE CITY OF SEBASTIAN, INDIAN RIVER
COUNTY, FLORIDA, ESTABLISHING A BUDGET REVIEW ADVISORY
BOARD; PROVIDING DUTIES AND RESPONSIBILITIES; PROVIDING
FOR REPEAL OF ORDINANCES OR PARTS OF ORDINANCES IN
CONFLICT HEREWITH; PROVIDING FOR CODIFICATION; PROVIDING
FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the City Council of the City of Sebastian, Florida
("City Council") had by Resolution R-98-27, established a budget
advisory committee, and
WHEREAS, the City Council has determined that a permanent
budget advisory committee will be a valuable resource in the
development of the City's budget;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF SEBASTIAN, INDIAN RIVER COUNTY, FLORIDA, as follows:
Section 1. There is hereby established a Citizens' Budget
Review Advisory Board. The Board shall be composed of seven
residents of the City.
Section 2. The Board shall assist in the City's budget review
process and shall make recommendations to the City Council prior
to the first budget hearing for each fiscal year. In order to
effectively advise the City Council, the Board shall become
familiar with the City's budget process and shall review the City's
proposed budget and all reports submitted by City staff concerning
the proposed budget.
Section 3. The City Manager or his designee shall be an ~
officio member of the Board and shall provide the Board with all
financial documents and materials which reasonably relate to the
budget advisory responsibilities of the Board. Each City Council
member shall appoint one member of the initial board, and each
initial member's term shall end at the same time as the term of the
council member making the appointment. The City Council shall
appoint two additional members, who will serve until the next
election. Thereafter, each newly elected or re-elected City
Council member shall, at the first regular meeting after taking
office, appoint one board member, who shall serve for a two-year
term. The City Council, at the first regular meeting after each
election, shall appoint two additional board members, who shall
serve for one year terms.
Section 3. COA~FLICTS. All ordinances or parts of ordinances
in conflict herewith are hereby repealed.
Section 4. CODIFICATION. It is the intention of the City
Council of the City of Sebastian, Indian River County, Florida, and
it is hereby provided that the provisions of this ordinance.shall
become and be made a part of the Code or Ordinances of the City of
Sebastian, Florida; that the sections of this ordinance may be
renumbered or relettered to accomplish such intention; and the word
"Ordinance" may be changed to "Section," "Article" or other
appropriate designations.
Section 5. SEV~RABILiTY. In the event a court of competent
jurisdiction shall hold or determine that any part of this
ordinance is invalid or unconstitutional the remaining provisions
of this ordinance shall not be affected and it shall be presumed

that the City Council of the City of Sebastian did not intend to
enact such invalid or unconstitutional provision. It shall further
be assumed that the City Council would have enacted the remainder
of this ordinance without said invalid and unconstitutional
provision, thereby causing said remainder to remain in full force
and effect.
Section 6. Effective Date. This Ordinance shall become
effective on March 10, 1999. The Fiscal Year 1998-1999 Citizens'
Budget Review Advisory Committee shall continue to serve until
appointment of the Citizens' Budget Review Advisory Board.
