HomeMy WebLinkAboutO-98-17ORDINANCE NO. O-98-17 AN ORDINANCE OF THE CITY OF SEBASTIAN, INDIAN RIVER COUNTY, FLORIDA, AMENDING SECTION 20A-10.2.H.6.i. OF ARTICLE X OF THE LAND DEVELOPMENT CODE OF THE CITY OF SEBASTIAN RELATIVE TO MATERIAL SPECIFICATIONS FOR CULVERTS AND STORM SEWERS; PROVIDING FOR REPEAL OF ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH; PROVIDING FOR SEVERAB1LITY; PROVIDING FOR CODIFICATION; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS,; the City Council of the City of Sebastian deems it in the best interest of the public health, safety and welfare to specify materials for culverts and storm sewers; and NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SEBASTIAN, INDIAN RIVER COUNTY, FLORIDA, as follows: SECTION L Section 20A-10.2.H.6.i. of Article X of the Land Development Code is hereby amended to read as follows: "i. Material specifications for culverts and storm sewers. The following pipe materials are acceptable: (i) Reinforced concrete pipe; aluminum pipe; aluminum pipe arch; and corrugated high density polyethylene pipe (HDPE). Corrugated metal pipe and PVC pipe shall be acceptable only for installations in a privately maintained system and only if it is comprised of an appropriate wall thickness for the intended use. (ii) Workmanship and pipe materials shall conform to Florida Department of Transportation (DOT) Standard Specifications, latest edition. (iii) Only concrete, aluminum and I-ff)PE pipes shall be used under City right-of-way pavement and/or into salt water outfalls. Concrete for reinforced concrete box culverts shall conform to DOT's Standard Specifications, latest edition". ~,~..I~. CONFLICTS: All Ordinances and Resolutions or parts thereof in conflict herewith are, to the extent of such conflict, superseded and repealed. ~C, II!~L3_. SEVERABILITY. If any section, provision, clause, phrase, or application of this Ordinance is held invalid or unconstitutional for any reason by any court of competent jurisdiction, the remaining provisions of this Ordinance shall be deemed severable therefrom and shall be construed as reasonable and necessary to achieve the lawful purposes of this Ordinance. SECTION 4. CODIFICATION. It is the intention of the City Council and it is hereby ordained that the provision of this Ordinance shall become and be made part of the Land Development Code of the Code of Ordinances, City of Sebastian, Florida. ~ EFFECTIVE DATE: This Ordinance shall take effect within thirty days of its adoption.
