R-02-05 A RESOLUTION OF THE CITY OF SEBASTIAN, INDIAN RIVER COUNTY, FLORlDA, AUTHORIZING THE CITY MANAGER TO APPLY FOR A WATERWAYS ASSISTANCE PROGRAM GRANT FROM THE FLORIDA INLAND NAVIGATION DISTRICT; PROVIDING FOR CONFLICT; PROVIDING FOR EFFECTIVE DATE. WHEREAS, the City of Sebastian is interested in implementing more marine oriented law enforcement initiatives in the community; and WHEREAS, the Mayor and City Council desire improvements to be initiated via respective enforcement efforts, and supports administration in programming necessary tools and equipment to achieve results; and WHEREAS, the Mayor and City Council of the City of Sebastian wish to authorize the City Manager to apply for a Waterways Assistance Program Grant from the Florida Inland Navigation District. NOW THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF SEBASTIAN, as follows: Section 1. AUTHORIZATION. The Mayor and City Council of the City of Sebastian hereby authorize the City Manager to apply for a Waterways Assistance Program Grant from the Florida Inland Navigation District. Section 2. The City Manager's Office of the City of Sebastian is hereby directed to send copies ofthis Resolution to the Florida Inland Navigation District and all other persons as directed by the Mayor and City Council. Section 3. CONFLICTS. All resolutions or parts of resolutions in conflict herewith are hereby repealed. Section 4. EFFECTIVE DATE. Tills resolution shall take effect immediately upon its adoption. A motion to adopt the foregoing Resolution was made by Councilmember Majcher . The motion was seconded by Councilmember Coniglio and, upon being put to a vote, the vote was as follows: Mayor Walter Barnes aye Councihnember Joe Barczyk aye Councilmember Raymond Coniglio aye Councilmember James Hill aye Councilmember Edward 1. See First Page AND, Florida Inland Navigation District financial assistance is required for the program mentioned above, NOW THEREFORE, be it resolved by the City of Sebastian (Name of Agency) that the project described above be authorized, AND, be it further resolved that said the City of Sebastian (Name of Agency) make application to the Florida Inland Navigation District in the amount of 50 % of the actual cost of the proj ect in behalf of said the City of Sebastian (Name of Agency) AND, be it further resolved by the City of Sebastian (Name of Agency) that it certifies to the following: 1. That it will accept the terms and conditions set forth in Fll\ID Rille 66B-2 F.A.C. and which will be a part of the ProjectAgreement for any assistance awarded under the attached proposal. 2. That it is in complete accord with the attached proposal and that it will carry out the Program in the manner described in the proposal and any plans and specifications attached thereto unless prior approval for any change has been received from the District. Form No. 90-11 (Rev. 10-14-92) (1) 3. That it has the ability and intention to finance its share of the cost ofthe project and that the project will be operated and maintained at the expense of said the City of Sebastian (Name of Agency) for public use. 4. That it will not discriminate against any person on the basis of race, color or national origin in the use of any property or facility acquired or developed pursuant to tbis proposal, and shall comply with the terms and intent of the Title VI of the Civil Rights Act of 1964, P. L. 88-352 (1964) and design and construct all facilities to comply fully with statutes relating to accessibility by handicapped persons as well as other federal, state and local laws, rules and requirements. 5. That it will maintain adequate financial records on the proposed project to substantiate claims for reimbursement. 6. That it will make available to FIND if requested, a post-audit of expenses incurred on the project prior to, or in conjunction with, request for the final 1 0% of the funding agreed to by FIND.
