HomeMy WebLinkAboutR-82-02RESOLUTION A RESOLUTION ADOPTING RULES FOR APPLICATIONS FOR VARIANCES FROM BOARD OF ADJUSTMENT; APPROVING APPLICATION FORM AND INFORMATION SHEET; SETTING FEE AT $60. WHEREAS, the Board of Adjustment has requested the Council approve procedures for granting variances and also approve an application form and information sheet; NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF SEBASTIAN, FLORIDA, AS FOLLOWS: 1. All applications for Variance or a Special Exception under the terms of the Zoning Ordinance shall be submitted to the City Council for review and comments and then to the Board of Adjustment on the approved form attached hereto. 2. The Information Sheet, attached hereto, is approved and shall be distributed to each applicant re- questing a variance or special exception. 3. The Application fee for a variance or special exception is hereby established. Said fee shall be Sixty ($60.00) Dollars. Please return this application to the City Clerk with a check for $60.00 payable to the City of Sebastian, for public notice and clerical costs. INFORMATION SHEET BOARD OF ADJUSTMENT This information sheet has been prepared to assist those who wish to come before the Board of Adjustment, seeking a variance, special ex- ception or appeal. For complete details and precise instructions, please consult the City Zoning Ordinance, as amended. The Board of Adjustment is authorized to grant relief only in cases of special and unique hardship, which must be real and proven to the satisfaction of the Board. PROCEDURE FOR FILING: Applications must be filed with the City Clerk. The Clerk will then submit applications to the City Council for review and comment. The Council will then refer the application to the Board for action. MEETINGS The Board meets the of each month, in City Hall Council Chambers at� p.m. Dates can be verified by Building Dept., or by the City Clerk's office. FEE REQUIRED A fee of $60.00 is required to cover costs. (Advertisement in paper, etc.) FORMS MUST BE COMPLETED Application forms may be obtained from the City Clerk. Application forms must be filled out completely, and the following documents attached thereto: 1. Boundary survey of the property by a Florida Registered Surveyor showing the dimensions of lot (s), legal description, easements, location of structures, adjacent street and drainage rights of way, and other pertinent information. 2. Floor plan of the structure(s), if one or more structures exist on the property, properly dimensioned and/or drawn to scale. 3. Date when the structure(s) was completed and the builder's name and current address. 4. An elevation view or dimensional print of the proposed structure(s), (if applicable) showing length, height and width,and material composition of structure (such as Wood Frame, CBS, Frame and Block, Brick, etc.) S. A list of each adjacent, surrounding property owner (not tenants) within 100 feet or 2 lots of the applicant's property, showing their names, addresses and telephone numbers. Names may be obtained by the most recent Tax Roll. APPEARANCE AT TWO MEETINGS IS REQUIRED Meeting R1 is to appear before the Board to request a Public Hearing. Application with complete facts is required. Approval may be granted if case is within the jurisdiction of the Board. Meeting #2 is the Public Hearing which means the application is published so the general public may comment. The Board will render its decision after hearing all the facts. Applicant may present his/her request to the Board personally, or by an attorney or other representative.
