R-82-// A RESOLUTION ADOPTING RULES FOR APPLICATIONS FOR VOLUNTARY ANNEXATION TO THE CITY; APPROVING APPLICATION FORM AND INFORMATION SHEET; SETTING FEE AT $75.00 WHEREAS, the Council wishes to approve procedures for consideration of petitions for voluntary annexation and also approve an application and information sheet; NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF SEBASTIAN, FLORIDA, AS FOLLOWS: 1. Ail applications for Voluntary Annexation under the provisions of Section 171.044, Florida Statutes, shall be submitted to the City Clerk, who shall forward the Petition with all attachments to the Planning and Zoning Board for review and comments, and then to the City Council for action. 2. The Information Sheet, attached hereto, is approved and shall be distributed to each applicant requesting a voluntary annexation. 3. An application fee for a petition for voluntary annexation is hereby established. Said fee shall be Seventy- five and no/100 Dollars ($75.00), and shall be non-refundable. This Resolution was duly passed and adopted by the Council of the City of Sebastian, Florida, this day of ~~ , 1982. Mayor ATTEST: ~ity ~lert~/ · INFORMATION SHEET VOLUNTARY ANNEXATI ON This information sheet has been prepared to assist those who wish to come before the City Council seeking to have property annexed to the City of Sebastian. For complete details, please consult the Section 171.044 Florida Statutes. The City Council is authorized to grant the petition only in cases which satisfy the requirements of State Law, and is in the best interests of the City as proven to the satisfaction of the Council. PROCEDURE FOR FILING: Applications must be filed with the City Clerk. The Clerk will then submit applications to the Planning and Zoning Commission for review and comment. The Commission will then refer the application to the City Council for action. MEETINGS The City Council meets the Second Monday and Third Wednesday of each month, in City Hall Council Chambers at 7:00 p. m. Dates can be verified by the City Clerk's Office. FEE REQUIRED A fee of $7S.00 is required to cover costs. FORMS MUST BE COMPLETED Application forms may be obtained from the City Clerk. Application forms must be filled out completely, and the following documents attached thereto: A. Copy of duly recorded warranty deed showing petitioner as grantee, and which also contains the description of the property sought to be voluntarily annexed; (Advertisement in paper, etc.) An accurate boundary survey of said property, signed and sealed by a Florida Registered Surveyor, The survey shall have distances and bearings of all boundary lines; a scale not less than 1'"~200 feet~ all road and drainage right-of-way's, easements, and other pertinent topographic information such as major lakes, canals, streams and/or rivers~ within and immediately adjacent to said property clearly, and accurately shown. The acreage of said property shall be shown on the survey to * O.1 acres; the existing zoning of said property shall be shown on the survey or as a separate statement. C. An accurate location map with a scale of not less than 1"=1000 feet shall be provided showing the said property distinctly outlined and identified and its proximity to the present City limits of Sebastian. D. The most recent copy of an aerial photograph Scale 1"=200 feet, available from the County Tax Assessor"s office in Vero Beach, Florida, for the said property. A letter of intent from the Petitioner which shall state one or more reasons why the Petitioner wishes to have his property annexed into the City of Sebastian and what type of development he will propose for it in the future. The letter shall be either handwritten or typed and shall bear the Petitioner's address and phone number, the date written, the Petitioner's signature and his printed or typed name. It shall be properly addressed to the City Council, City of Sebastian, P. O. Box 127, Sebastian, Florida 32958. APPEARANCE AT TWO MEETINGS IS REQUESTED Meeting #1 is to appear before the Council for first reading of the Annexation Ordinance and to request a Public Hearing. Application with complete facts is required. Approval may be granted if application meets the requirements of State Law and the approval of the Council. Meeting #2 is the Public Hearing which means the application is published in the newspaper so the general public may comment. The Council will render its decision after hearing all the facts. Applicant may present his/her request to the Council personally, or by an attorney or other representative. -2- PETITION FOR VOLUNTARY ANNEXATION TO TIlE CITY OF SEBASTIAN INDIAN RIVER COUNTY, FLORIDA Petitioner rs) , petitions the City of Sebastian, Florida, for voluntary annexation of the following described real property: 1. This is a petition for voluntary annexation in accordance with Section 171.044 of Chapter 171, Florida Statutes, 1975. ~ 2. Said property sought to be voluntarily annexed lies completely within the same county as the City of Sebastian, to-wit: Indian River County, Florida. 3. Said property is situate in an unincorporated area of Indian River County, Florida, and does not lie within the corporate limits of any other municipal, ity. 4. Said property is contiguous to the corporate boundaries and city limits of the City of Sebastian, such that a substantial part of the boundaries of said property are coterminous with the corporate boundary and city limits of said city. 5. Annexation of said property will be a reasonably compact addition to the incorporated territory of the City of Sebastian and will not create enclaves, pockets or finger areas in serpentine patterns. 6. Petitioner(s) ha(s)(ve) a fee simple estate in and to the land described in said deed and ha(s)(ve) full power and authority to convey, grant, and encumber both the legal and beneficial interests in the real property described in said deed, and therefore and furthermore this Petition bears the signature of the owner of the property proposed to be annexed. WHEREFORE, Petitioner(s) requests tile City Council of the City of Sebastian, Florida, at a regular meeting to adopt a non-emergency ordinance to annex the property in this petition, and to redefine the corporate boundaries and City Limits of the City of Sebastian, Florida, to include said property, and, that upon proper publication once a week for four (4) consecutive weeks, said ordinances be passed and adopted and thereafter filed with the Clerk of the Circuit Court of Indian River County, Florida, and with the Department of State of the State of Florida.
