HomeMy WebLinkAboutR-86-65RESOLUTION NO. ~' ~/~-~' / A RESOLUTION OF THE CITY OF SEBASTIAN, FLORIDA, REQUESTING THAT THE FLORIDA LEGIS~ATURE ENACT INTO LAW EACH OF THE TWO (2) SPECIAL LOCAL ACTS ATTACHED HERETO: THE FIRST RELATING TO THE DEANNEXATION OF THE RIVER EDGE SUBDIVISION AND THE SECOND RELATING TO THE DISINCORPORATION OF THE TOWN OF ORCHID. WHEREAS, Charles Vitunac, Attorney for Indian River County has drafted two (2) proposed special local acts that apply to the deannexation of the River Edge Subdivision from the City of Sebastian into unincorporated Indian River County, Florida, and the other to disincorporate the Town of Orchid, in Indian River County, and, WHEREAS, the City Council is aware of the intent and purposes for such proposed special acts and if informed as the the underlying reasoning behind said proposed acts, and WHEREAS, the City Council of the City of Sebastian, Florida, after considering these two matters is convinced that it is in the interest of the City of Sebastian, Indian River County, and the inhabitants within the two (2) land areas involved, that said pro- posed bills be enacted by the State Legislature, NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SEBASTIAN, FLORIDA, AS FOLLOWS: 1. The City of Sebastian requests the Florida Legislature to enact into law the two proposed bills prepared by County Attorney Charles Vitunac, attached hereto as Exhibits A and B. 2. The City Clerk is hereby instructed to cause to be delivered a copy of this Resolution and its exhibits to Rep. Dale Patchett, to Rep. Tim Deretany, and to Governor Martinez. ..' A) AN ACT RELATING TO THE CiTY OF SEBASTIAN, INDIAN RIVER COUNTY; PROVIDING FOR THE DEANNEXATION OF THE RIVER'S EDGE SUBDIVISION FROM THE CORPORATE LIMITS; PROVIDING AN EFFECTIVE DATE. BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF FLORIDA: Section 1. Contraction of Boundaries. The corporate limits of the City of Sebastian, Indian River County, are hereby contracted to exclude the following described lands and territory lying within indian River County, Florida: Lots 28, 45 and 46, in Section 22, Township 30 South, Range 38 East, said land being in Indian River County, Florida, and known as the "Fleming Grant"; together with all existing riparian rights to said real property except and reserving therefrom for the private use and ownership of the Florida Audubon Society the existing islands fronting on said real property to be held and used by it exclusively forever or to and until such time as said Florida Audubon Society releases and conveys its said interest and ownership in same to the upland owner as to said islands. Section 2. Effective Date. This act shall take effect upon becoming law. (~x. Bi ACT RELATING TO THE TOWN OF ORCHID, INDIAN RIVER COUNTY; DISINCORPORATING AND ABOLISHING THE TOWN; PROVIDING FOR ASSUMPTION OF DEBTS AND PROPERTY BY COUNTY; PROVIDING FOR EFFECTIVE DATE. BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF FLORIDA: Section 1. Disincorporation. The Town of Orchid, Indian River County, as created by Chapter 65-2021, Laws of Florida, and as existing pursuant to subsequent amendments, is hereby disincorporated and abolished in its entirety. Section 2. Provision for Assumption of Public Debt and Property. Indian River County shall assume all public debts of the Town and shall become the owner of all the Town property and shall make arrangements through a municipal service taxing district or other similar method for the proper payment of such debts, if any, from taxes or other charges imposed in the land which was formerly the Town of Orchid. Section 3. Effective Date. This act shall take effect upon becoming law.
