HomeMy WebLinkAboutR-88-38RESOLUTION NO. R-88-38 A RESOLUTION OF THE CITY OF SEBASTIAN, FLORIDA, ADOPTING A WRECKER ROTATION POLICY FOR THE SEBASTIAN POLICE DEPARTMENT. WHEREAS, the Sebastian Police Department recommends to the City Council that a written policy established by the Police Department be adopted by Resolution by the City Council pursuant to the Code of Ordinances, Section 2-4 (b) (2), as adopted by Ordinance No. O-84-16, and WHEREAS, the City Council agrees with the recommendation of the Police Department and hereby folows that recommendation; NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SEBASTIAN, FLORIDA, AS FOLLOWS: 1. That the Wrecker Rotation Policy attached hereto, con- sisting of Procedural Manual No. 77, page 1 through 7, and a 3 page contract form setting specific rates, is hereby adopted as the Police Department's Rules regarding this subject. 2. This Resolution shall be effective upon final passage by the City Council. This Resolution was passed by City Council on the~day of May, 1988. CITY OF SEBASTIAN, FLORIDA Richard B. Regulate the use of the Sebastian Police Department Wrecker Rotation List. B. Define the requirements for participation on the Wrecker Rotation List. C. Identify the wrecker classifications and the related equipment required with each classification. d. Regulate the activities of those tow services whichparticipate on the Wrecker Rotation List. II. III. POI.ICY: The Policy of the Sebastian Police DEpartment will be that Procedures and Rules sh~ll be established to regulate the activities of those tow services which participate on the Wrecker Rotation List. Wrecker operators, including owners if they will be operating wreckers, must be certified as a wrecker driver operator by the Sebastian Police Department Uniform Co~ander. For the purposes of these regulations, certification shall mean beinG familiar with the operation of the equipment to be used. b. Wrecker operators are requ_ ired to know and comply with the Florida Uniform Traffic Control Law, Chapter 316, S.S. c. The wrecker operator on duty must have ready access to the wrecker and be available 24 hours. d. 77]e wrecker operator must be of good moral character. e. The wrecker operator must have an acceptable drivinG record and must have his driver's license recorded at the Police Department, Identification Unit. - 1- Sebastian Police Dept. Wreckers shall be inspected by the Traffic Coordinator before being placed on the rotation list and thereafter be inspected annually, or at other times that warrant the maintenance of these standards. b. Sirens on wreckers are prohibited.. c. Wreckers shall be maintained in reasonable states of appearance and repair, with equipment properly painted. The name of the establishment must be lettered in a professional manner on both sides of the wrecker, let- tering to be no smaller than four (4) inches in height. d. Wreckers are not required to be 'commercially manufac- tured. Wreckers. must be 'equipped with fenders, engine hood, doors and bumpers. Wreckers must meet or exceed commercially manufacture specifications. e. There shall be a minimum of one rotor light beacon or "strobe" type light mounted on. top of the wrecker in such a manner that it can be Seen from the front, rear and both. sideS. These light~.), shall be AMBER in color. (]1). Unless authorized by the Sebastian Police Depart- ment, this light(is)shall not be used in proceeding to a call. (~) This light(~) w%ll be used at the scene and when towing from the scene~ f. Amber lights shall be installed on the front of the wrecker with amber reflectors on the front fenders. g. Red lights and reflectors shall be installed on the rear and rear fenders or platform of the wrecker. h. Dollies, except class "C" wreckers (See III.B (Classifi- cations). i. Six (_6) 30" high. traffic cones,. S_torage Fa'c'ilit'i'es a. Outside storage 'facilities must be fenced or guarded and locked for protection of vehicles, and property. Storage facilities may be located off the operator,s premises. The facility must be 'professional in appea- rance and must be staffed from 8:00 AM to 5:00 PM, Monday through Friday. Ail storage facilities shall be within the confines of the City of Sebastian, b. The fence must be of adequate size, at least six feet high, to discourage theft of any vehicle 'or any property being stored inside. c. Inside storage must be available when weather or other conditions require inside storage 'for protection of vehicles or personal property. If the inside storage is not on the wrecker establishment premises, the tablishment must provide 'an address to the Sebastian Police Department of the inside storage facility and have it staffed with same 'conditions. as section a. d. Hold orders placed by the Sebastian Police Department on vehicles stored for any reason shall be honored by, the wrecker establishment as instructed by Sebastian Police Department. No property of any kind shall be released to' anyone without authority of the Homicide Investigator. Any wr~ler establishment that violates any instruction from the Homicide Investigator or this section will be automatically taken off the ro- tation list and an investigation wil~l be conducted. e. Wrecker establishments will be held responsible for parts and contents taken from vehicles while under their pro~ tection. f. Any deviation from these rules must be approved by the Chief of Police of the Sebastian Police Department. 4. Rates a. Wrecker rates shall be posted at their places of business and inside of each wrecker being used on the rotation list. A wrecker rate sheet shall be supplied by each es- tablishment and all rates charged will be in accordance with the rate list. b. All rates must be within the prices established in the Chilton Flat Rate Manual. c. Any increase in rates must be agreed upon by all wrecker establishments on the 'rotation list [majority vote)and the Chief of Police before it can be posted. d. No hourly rates will be established until after the first hour that the wrecker driver is at the scene. The hourly rates will be rated to the type of wrecker class. 5. General a.' By signing the wrecker ,towing rate sheet, the owner will establish use 'of these rates on all rotation calls fromt the Sebastian Police 'Department. b. The Tow Service will be held responsible 'for any items listed on the vehicle ~mpound form as being with the vehicle when it was placed in the care and custody of the wrecker driver, - 4 - Sebastian Police Dept. The Tow Service will be held responsible for any damages to the vehicle which are not listed on the vehicle im- pound form at the time it was. placed in the care and cus- tody of the wrecker driver. d. The Notice of Impoundment will not be removed from the vehicle until it is released. e. Release of impound vehicles. (1) No vehicle which has been impounded by the Sebastian Police Department will be released until the owner presents a completed Vehicle Release Form to the Tow Service. (2) The Tow Service will forward the Notice of Impound- ment and the Vehicle Release to the Sebastian Police Department Records Section within three (3) days of the release of the vehicle to its owner. f. Any complaints of a service charge nature will be investi- gated by Sebastian Police Department. In an investigation being conducted by Sebastian Police Department for any violation of these rules or regulations, the wrecker es- tablishment may be suspended as set forth in section (D-l) or may be removed from the rotation list. ' Violations of these regulations'will be cause for suspen- sion from the rotation list by the Chief of Police. Penal- ties for violations are as' follows: (~1) First violation - Thirty (30) days suspension from the rotation list. (2) Second violation- Sixty (60) days suspension from the rotation list. (.3) Third violation - Ninety (~.0) days suspension from the rotation list. (4) Fourth violation - Removal from the rotation iist. g. Owner requests shall be recognized if practical, each incident will be determined individually. 6. Service a. Only certified wrecker operators will be dispatched on wrecker calls. A letter to the Sebastian Police Depart- ment with company name, from'the owner of the wrecker service stating the driver is certified and signed by owner will suffice. The operator must be familiar with the working capabilities and limitations of his wrecker. - 5 - Sebastian Police Dept. Wreckers shall be prohibited from "chasing or "running" wrecks without bona-fide calls from officers handling inves tigations. d. Any call received by a wrecker company requesting towing service, shall be cleared through Sebastian Police De- partment before a wrecker proceeds to the scene, even if the disabled vehicle's owner calls the wrecker direct. Any wrecker establishment that tows in a damaged or wrecked vehicle without the incident having been investi- gated or reported to a proper police agency, will be re- moved from the rotation list for a period of time to be determined by investigation. c. Soliciting at the scene is prohibited by the owner, ope- rator or representative of any wrecker establishment. f. Wrecker operators shall sweep glas. s from the roadway and remove all debris from scene. Any wrecker establishment that leaves the scene and does not remove all debris will be removed from the rotation list for a period of time to be determined by investigation. g. Rotation will be~ weekly or monthly, as conditions require. . h. Wrecker establishments must submit a proo~f of liability form from their respective insurance company when inspec- ted showing liability insurance ~of at least $100,000; $206,000' $50,000. This proof of liability form must show name of establishment, amount of insurance and the effective and expiration date. It shall be the responsi- bility of the wrecker establishment to furnish the Sebas- tian Police Department a copy of the liability form and/or a renewal proof of liability form each. time the company changes policy or the present policy expires. Any wrecker establishment that does not comply with this' procedure will be automatically taken off Sebastian Police Depart- ment rotation until owner shows proof of liability insu- rance. Wrecker operators, who arrive to service a call, and are identified by the Police Officer in charge of the scene as having the odor of alcohol on or about their person - 6 - Sebastian Police Dept. A wrecker operator ('establishment) who fails to answer a call will lose the c~ll and h.e wiil be rotated to the bottom of the rotation list. If the wrecker establishment misses three (3) calls in the period of three (3) months,, the wrecker establishment will be automatically taken off the rotation and an investi.gatCon w-ill be 'condudted as to the inability of the wrecker establishment to respond. k. A wrecker establishment that fails to respond promptly to calls, response longer than twenty ~0). minutes, will lose the call and he will be rotated to the bottom of the 'rota- tion list. If the wrecker establishment does. not respond promptly, on a continual basis, the establishment wi. ll be automatically taken off the. rotation list and an investiga- tion will be conducted to determine ability to respond timely. 1. A wrecker establishment that refuses a call without just reason will be automatically removed from the rotation list, and investigation will be conducted and removal from the rotation list may result. Classification 1. Class A a. Tow truck shall have a mini.mum manufacturer capacity of 10,000 pounds, Gross Vehicle Weight. b. Boom capacity of not less than four C41 tons, Power winch pulling capacity of not less than four (4)tons. d. Minimum of one hundred feet Clfl0')of 3/8 inch. cable/minimum manufacturer specification. e. Cradle or tow place or tow sling to pick up vehi. cles. Cradle or tow plate, to be equipped with safety chains and so con- structed that no further damage 'will occur when picking up vehicle. To include M/C slings. - 7 - Sebastian Police Dept. Electric winches are not allowed. a. Tow truck shall have a minimum manufacturer capacity of 15,000 pounds, Gross Vehicle Weight. b. Boom capacity of not less than six (6) tons. c. Two (2)power winches, pulling capacity of not less than four (4) tons each. Minimum of one hundred feet (100') of 3/8 inch cable/mini- mum manufacturer specification. e. Single boom hydraulic elevated and extendable. f. Cradle tow or tow sling to pick up vehicles. Cradle or tow plate to be equipped with safety chainsl. Dual rear wheels. h. Two (2) Snatch Blocks. 3. Class Tow truck shall have a minimum manufacturer capacity of not less than 25,000 pounds, Gross Vehicle Weight. Boom capacity of not less than twelve and one-half (12 5) tons. · Power winch pulling capacity of not less than twenty-five (.2 5 ). tons. Minimum of two hundred feet (200') of 9/16 inch cable/ minimum manufacturer specification on each drum. Double boom so constructed to permit splitting.
