A RESOLUTION OF THE CITY OF SEBASTIAN, INDIAN RIVER
COUNTY, FLORIDA, PERTAINING TO THE RENEWAL OF A LEASE
FOR SOVEREIGNTY SUBMERGED LAND; PROVIDING FOR RENEWAL
OF THE LEASE WITH THE BOARD OF TRUSTEES OF THE INTERNAL
IMPROVEMENT TRUST FUND FOR THE USE OF SOVEREIGNTY
SUBMERGED LANDS AT THE EASTERN END OF MAIN STREET,
LYING IN SECTION 06, TOWNSHIP 31 SOUTH, RANGE 39 EAST;
DIRECTING THE MAYOR TO EXECUTE THE LEASE ON BEHALF OF
THE CITY; DIRECTING THE CITY CLERK TO RECORD THE LEASE
IN THE OFFICIAL RECORDS OF INDIAN RIVER COUNTY;
PROVIDING FOR TERMINATION; PROVIDING FOR REPEAL OF
RESOLUTIONS OR PARTS OF RESOLUTIONS IN CONFLICT
HEREWITH; AND PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the

NOW, THEREFORE, BE IT
under authority of License %31-39-
RESOLVED BY THE CITY COUNCIL OF THE
CITY OF SEBASTIAN, INDIAN RIVER COUNTY, FLORIDA, that:
SECTION 1. LEASE DESCRIBED. The City of Sebastian
hereby accepts Sovereignty Submerged Lands Lease #310031934,
together with the terms and conditions stated therein, as offered
by the Board of Trustees of the Internal Improvement Trust Fund
of the State of Florida, attached hereto as Exhibit "1" and made
a part of this Resolution, for the use of sovereignty lands
generally described as:
A parcel of sovereignty submerged land in Section 06,
Township 31 SOUTH, Range 39 EAST, in Indian River
County, Florida, containing 2,000 square feet, more or
less, of sovereignty lands.
SECTION 2. EXECUTION. The Mayor of the City of
Sebastian is hereby directed to execute this Lease as agent for
Lessee.

facilities, without sewage pump-out facilities, and without live-
aboards; and
WHEREAS, Chapter 18-21 of the Florida Administrative Code
provides that construction licenses shall be converted to
Submerged Lands Leases; and
WHEREAS, License #31-39-3193 expired on June 17, 1986 and
has not been converted to a Submerged Lands Lease; and
WHEREAS, the City of Sebastian desires to maintain the pier
SECTION 3. RECORDING. The Clerk of the City of
Sebastian is hereby directed to record this executed Lease in the
Official Records of Indian River County, Florida, within ten (10)
days after its execution. The Clerk shall further provide the
Board of Trustees of the Internal Improvement Trust Fund with a
copy of the recorded Lease indicating the book and page at which
the Lease is recorded.
SECTION 4.
DURATION. The City shall have the use of the
premises described in the Lease for a period of five (5) years
from June 17, 1986, the effective date of this Lease.
SECTION 5. CONFLICT. Ail resolutions or parts of
resolutions in conflict herewith are hereby repealed.
SECTION 6.
EFFECTIVE DATE. This Resolution shall take
effect immediately upon final passage.
