A RESOLUTION OF THE CITY OF SEBASTIAN, INDIAN RIVER
COUNTY, FLORIDA~ APPROVING AN EXTENSION OF TIME FOR THE
SUBMISSION OF A PRELIMINARY DEVELOPMENT PLAN FOR THE ST.
SEBASTIAN PUD(R) RESIDENTIAL PLANNED UNIT DEVELOPMENT
WHICH CONSISTS OF A PARCEL OF LAND APPROXIMATELY 316
ACRES IN SIZE LOCATED IN THE NORTH CENTRAL AREA OF THE
CITY, APPROXIMATELY ONE-QUARTER MILE WEST OF US HIGHWAY
1, ALSO DESIGNATED AS STATE ROUTE 5, NORTH OF MAIN
STREET, EAST OF AIRPORT DRIVE EAST, AND WEST OF GIBSON
STREET~ PROVIDING FOR REPEAL OF RESOLUTIONS OR PARTS OF
RESOLUTIONS IN CONFLICT HEREWITH~ PROVIDING FOR
SEVER~BILITY~ AND PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, Carl R. Julian, Trustee, (hereinafter sometimes
referred to as the "Owner"), is the owner of a certain tract of
real property located in the city of Sebastian, Indian River
County, Florida~ and,
WHEREAS, the Owner has requested that the City Council of
the City of Sebastian approve extending the time period for the
Owner to submit a Preliminary Development Plan for a PUD(R)
Residential Planned Unit Development~ and,
WHEREAS, the city Staff has review the Owner's request for
extension submitted by the Owner and has recommended approval~ and,
WHEREAS, the city Council has determined that the approving
an extension of time for the submission of a Preliminary
Development Plan by the Owner for the St. Sebastian Planned Unit
Development until April 30, 1991, is in the best interest of the
City of Sebastian to protect the health, safety and welfare of its
residents.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF SEBASTIAN, INDIAN RIVER COUNTY, FLORIDA, that:
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF SEBASTIAN, INDIAN RIVER COUNTY, FLORIDA, that=
Section 1. APPROV&L OF EXTENSION OF TIME TO SUBMIT
PRELIMINARY DEVELOPMENT PLAN. The time limit for Carl R. Julian,
Trustee to submit a Preliminary Development Plan to the City for
the PUD(R) Residential Planned Unit Development, known as St.
Sebastian PUD(R) Residential Planned Unit Development, which
consists of a tract of real property owned by the Owner,
approximately 316 acres in size, located in the north central area
of the City of Sebastian, Indian River County, Florida,
approximately one-quarter mile west of US Highway 1, also
designated as State Route 5, north of Main Street, east of Airport
Drive East, and west of Gibson Street, is hereby extended until
April 30, 1991.
Section 2. CONFLICT. Ail resolutions or parts of
resolutions in conflict herewith are hereby repealed.
Section 3. SEVERABILITY. In the event a court of
competent jurisdiction shall hold or determine that any part of
this Resolution is invalid or unconstitutional, the remainder of
the Resolution shall not be affected and it shall be presumed that
the City Council of the City of Sebastian did not intend to enact
such invalid or unconstitutional provision, it shall further be
assumed that the city Council would have enacted the remainder of
this Resolution without said invalid and unconstitutional
provision, thereby causing said remainder to remain in full force
and effect.
Section 4.
EFFECTIVE DATE. This ReSolution shall take
effect immediately upon its adoption.
The foregoing Resolution was moved for adoption by Councilman
~L~'J.~ . The motion was seconded by Councilman
and, upon being put to a vote, the vote
was as follows:

The Mayor thereupon declared this Resolution duly passed and
