R-92-35 A RESOLUTION OF THE CITY OF SEBASTIAN, FLORIDA, SEEKING LEGISLATION THROUGH THE INDIAN RIVER COUNTY LEGISLATIVE DELEGATION WHICH WILL REMOVE COMMUNICATION RESTRICTIONS BETWEEN ELECTED OFFICIALS AND THEIR CONSTITUENTS iMPOSED BY RECENT COURT DECISIONS FROM THE DISTRICT COURTS OF APPEAL OF THE STATE OF FLORIDA; PROVIDING FOR DISTRIBUTION AND EFFECTIVE DATE. WHEREAS, recent Court decisions have completely halted communication between elected officials and their constituents regarding important community matters including rezonings, variances, conditional use grants, code enforcement inquiries, and similar quasi-judicial matters; and, WHEREAS, these decisions impact written, telephone, and personal contacts between elected officials and their constituents; and, WHEREAS, elected officials have become timid in their responses to their constituents by reason of the potential damage which will result to elected officials and the political entities that they represent; and, WHEREAS, the United States Constitution has always envisioned free, open, sterile, and uncontaminated communication between elected officials and their constituents; and, WHEREAS, legislation is urgently needed in the State of Florida to restore and reopen communication channels between elected officials and their constituents. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SEBASTIAN, FLORIDA, as follows: Section 1. That the Indian River County Legislative Delegation study recent decisions in the District Courts of Appeal of the State of Florida toward the end that: a. Decisions be consistently interpreted until reversed or modified by legislative pronouncement. b. Decisions and their impact be understood. c. Legislation be advanced which reopens free, sterile and uncontaminated communication channels between elected officials and their constituents. d. Immediate action to be taken conscientiously protect elected officials who are listening and communicating with their constituents in good faith to advance the best interests of their communities and the great State of Florida. Section 2. Distribution. That the deep-seated concerns of the City Council of the City of Sebastian, Florida, be shared with Governor Lawton Chiles, Members of the House of Representatives from Indian River County, Florida, and serving as a part of the Indian River County Legislative Delegation, senators serving as a part of the Indian River Legislative Delegation, the County Commissioners of Indian River County, each municipal entity within Indian River County, the Florida League of Cities, the news media, and such others as deemed proper. Section 3. Effective Date.
