HomeMy WebLinkAboutR-93-23RESOLUTION NO.: R-93-23 A RESOLUTION OF THE CITY OF SEBASTIAN, INDIgeN RIVER COUNTY, FLORIDA, ADOPTING WATER AND WASTEWATER UTILITY RATES; PROVIDING FOR REPEAL OF RESOLUTIONS OR PARTS OF RESOLUTIONS IN CONFLICT HEREWITH; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City of Sebastian, Indian River County, Florida owns and operates a municipal water and wastewater utility; and WHEREAS, the city has previously established rates with respect to said utility by Ordinance No. 0-92-15 of the City of Sebastian; and WHEREAS, ordinance No. O-92-15 provides that water and wastewater utility rates may, from time to time, be amended by resolution of the City Council; and WHEREAS, the Indian River County Take-Over Agreement with Nelson Hyatt dated July 11, 1989, requires a $10.00 per month surcharge for Park Place customers; and WHEREAS, the Interlocal Utilities Agreement with Indian River County dated April 15, 1992 assigned the County's interest in the Hyatt agreement to the City; and WHEREAS, the rates adopted pursuant to Ordinance No. O-92-15 did not include the $10.00 per month surcharge for Park Place customers. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SEBASTIAN, INDIAN RIVER COUNTY, FLORIDA, that: 5~tiOn 1~ UTILITY RATES FOR WATER AND WASTEW~TER SERVICES TO CUSTOMERS SERVICED WITHIN THE CORPORATE CITY LIMITS OF THE CITY OF SEBASTIAN. The City hereby adopts water and wastewater rates as set forth in Exhibit "A" to this Resolution. Section 2. CONFLICT. Ail resolutions or parts resolutions in conflict herewith are hereby repealed. of Section $. SEVERABILiTY. In the event a court of competent jurisdiction shall hold or determine that any part of this Resolution is invalid or unconstitutional, the remainder of the Resolution shall not be affected and it shall be presumed that the City Council of the City of Sebastian did not intend to enact such invalid or unconstitutional provision. It shall further be assumed that the City Council would have enacted the remainder of this Resolution without such invalid and unconstitutional provision, thereby causing said remainder to remain in full force and effect. Section 4. EFFECTIVE DATE. This Resolution shall take effect as of May 1, 1993. Paragraph 6 ~ "Impact Fees" is changed to read: After f~/~/f~/~/~/6f/~/~6~ July 11, 199~ HYATT or his successor shall be obligated to pay impact fees to the COUNTY, at the rate then current, for each unit which thereafter requires a Certificate of Occupancy. Units which have had a Certificate of Occupancy issued to them before ~6~ Jq~y 11, 1997, must have an impact fee paid when that unit is resold, without regard to the f~96~/~Z~R/~/~66/~6~6d 1997, date. ~/~6~/6~ Immediately after such sales are closed, ~EZZ~R HYATT or HYATT's successor in title shall ~6~66~ pay, or collect ~n~.pay, the impact fee ~/~/~ to COUNTY. On all other closings.,.. HYATT shall require that each new purchaser of a unit in the Park execute a disclosure form acknowledging that the new Durchaser has been informed that impact fees will have to be paid when the unit it resold. 2.
