A RESOLUTION OF THE CITY OF SEBASTIAN. INDIAN RIVER
COUNTY. FLORIDA. WHICH PROMOTES AND ENCOURAGES THE
FLORIDA STATE LEGISLATURE IN PASSING A NEW LAW REQUIRING
TRIHALOMETHANE (THE) CONTROL FOR ALL POTABLE DRINKING
WATER SYSTEMS SERVING THE GENERAL PUBLIC WHEREIN THE
THM'S EXCEED THE ESTABLISHED ENVIRONMENTAL PROTECTION
AGENCY MAXIMUM CONTAMINANT LEVEL (MCL)~ PROVIDING FOR
REPEAL OF RESOLUTIONS OR PARTS OF RESOLUTIONS IN CONFLICT
HEREWITH~ AND PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS. the City of Sebastian has a private utility company
within its boundaries which currently serves 1,242 customers with
potable water; and
WHEREAS. the indian River County Environmental Health
Department has, during the course of two consecutive years, twice
determined that the finished water in the private utilities
distribution system was found to contain trihalomethane (THM's) in
the amount exceeding the current standard as established by the
U.S. Environmental Protection Agency; and
WHEREAS. the current U.S. Environmental Protection Agency
Disinfection-By-Product rule does not require water systems serving
fewer than 10,OOO people to implement THM control; and
WHEREAS, customers served by the water system and members of
the general public perceive the water to be undrinkable because
cancer causing agents have been found in the water as reported by
the Environmental Health Department in the local news media.
NOW, THEREFORE. BE IT RESOLVED by the City Council of the City
of Sebastian. Indian River County, Florida. that:
Section I. The City of Sebastian expressly promotes and
encourages the Florida State Legislature to pass new legislation
requiring all potable water systems serving the general public,
where THM's exceed the Environmental Protection Agency's maximum
contaminant level, to implement THM control. Furthermore, that the
Florida State legislature empower the Florida Department of
Environmental Protection to develop acceptable guidelines for
economical implementation of THM control systems, as well as
permitting, testing, and reporting requirements, and that the
Department of Environmental Protection be given inspection and
enforcement powers under its regulatory authority. It is the City
of Sebastian's conscientious desire to have the State Legislature
enact a new law on TMM control during the next regularly scheduled
session of the State Legislature.
Section 2. Repeal. All Resolutions or parts of Resolutions in
conflict herewith are hereby repealed.
Section 3. Effective Date. This resolution shall become
immediately effective upon its adoption.
