A RESOLUTION OF THE CITY OF SEBASTIAN, INDIAN RIVER
COUNTY, FLORIDA, AUTHORIZING A PROJECT FOR WATER MAINAND
WATER EXTENSION LINES FOR THE AREA EAST OF U.S. i TO THE
INDIAN RIVER RUNNING FROM THE CITY'S SOUTHERN BOUNDARY TO
ITS NORTHERN BOUNDARY; EQUALIZING, APPROVING, CONFIRMING
AND LEVYING SPECIAL ASSESSMENTS ON PROPERTY SPECIALLY
BENEFITTED BY THE PROJECT TO PAY THE COSTS THEREOF;
PROVIDING FOR THE PAYMENT AND COLLECTION OF SPECIAL
ASSESSMENTS BY THE METHOD PROVIDED FOR BY CHAPTER 170,
FLORIDA STATUTES; PROVIDING FOR SPECIAL ASSESSMENT LIENS
TO BE MADE OF RECORD; PROVIDING FOR SEVERABILITY;
PROVIDING FOR REPEAL OF RESOLUTIONS OR PARTS OF
RESOLUTIONS, CONFLICTS; AND PROVIDING FOR AN EFFECTIVE
DATE.
WHEREAS, the city Council of the city of Sebastian, Florida
has determined that the improvements herein described are necessary
to promote the public welfare of the city and have elected to
defray the cost thereof by special assessments against certain
properties to be specially benefitted;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF SEBASTIAN, INDIAN RIVER COUNTY, FLORIDA, that:

AUTHORITY FOR THIS RESOLUTION. This Resolution is
to Chapter 170, Florida Statutes.
FINDINGS: The City hereby finds and determines as
A. The City is authorized under Florida law to provide
public water projects within the city limits of the City of
Sebastian; and
B. The city is authorized by Chapter 170, Florida
Statutes, to levy special assessments to pay the cost of any
such project.
C. It is necessary to the public health, safety and
welfare that the city provide the project. The project is the
Riverfront Water Project which is to provide public water
service with water mains, laterals, valves, fire hydrants and
other water distribution facilities to parcels located east of
U.S. 1 to the Indian River running from the City's southern
boundary to its northern boundary, hereinafter referred to as
"project" the nature and location of which are described in
Resolution R-94-47, and more specifically described in the
plans and specifications on file in the office of the City
Clerk, the cost of such project to be assessed against lands
specifically benefitted by such project; and
D. The provision of said project and the levying of
such special assessments serve a proper, essential, and valid
public purpose; and
E. By Resolution R-94-47 adopted by the city, the city
determined to provide the project and defray the cost thereof
by making special assessments

F. As directed by Resolution R-94-47, said Resolution
was published as required by Section 170.05, Florida Statutes,
and a copy of the publisher's affidavit of publication is on
file with the City Clerk; and
G. A preliminary assessment roll was prepared and filed
with the City as required by Section 170.06, Florida Statutes;
and
H. As required by Section 170.07, Florida Statutes,
upon completion of the preliminary assessment roll, the
Council adopted Resolution R-94-48 fixing the time and place
of a public hearing at which owners of the property to be
assessed and other persons interested therein may appear
before the City Council and be heard as to (i) the propriety
and advisability of making the improvements, (ii) the cost
thereof, (iii) the manner of payment therefore, and (iv) the
amount thereof to be assessed against each property specially
benefitted property and providing for the mailing publication
of notice of such public hearing; and
I. Notice of such public hearing has been given by
publication and by mail as required by Section 170.07, Florida
Statutes, and affidavits as to such publication and mailing
are on file in the office of the City Clerk.
J. At the time and place specified in the Resolution
and notice referred to in Paragraph I above, the City Council
met as an Equalization Board, conducted such public hearing
and heard and considered all complaints as to the matters
described in Paragraph H above, and based thereon, has made
such modifications in the preliminary assessment roll as it
deems desirable in the making of the final assessment roll;
and
K. Having considered the cost of the project and all
complaints and evidence presented at such public hearing, the
City finds and determines:
(i) That the estimated cost of the project is specified
in Exhibit "A" hereto and the amount of the cost is
reasonable and proper;
(ii) It is reasonable, proper, just and right to assess
the cost of such project against the properties
specifically benefitted thereby using the methods
determined by the City Council, which results in the
special assessment set forth on the final assessment roll
identified as Exhibit "B" to the Resolution and as so
marked and filed with the City Clerk; it is hereby
declared that the project will constitute a special
benefit to all the parcels of real property listed on
said final assessment roll and that the benefit, in the
case of each such parcel, will be in excess of the
special assessment thereon; and
(iii) It is desirable that the special assessment be
paid and collected as herein provided.
SECTION 3. FINAL AUTHORIZATION OF THE CITY PROJECT: The
project described in Resolution R-94-47, as more specifically
described by the plans and specification on file at the office of
the City Clerk at 1225 Main Street, Sebastian, Florida, are hereby
authorized and approved and the proper officers, employees and
agents of the City are hereby authorized and directed to take such

further action as may be necessary or desirable to cause the same
to be constructed.
SECTION 4. ESTIMATED COST OF IMPROVEMENTS: The total
estimated cost of the project and the cost to be paid by special
assessment on all specially benefitted properties are set forth in
Exhibit "A" which is attached hereto and made a part hereof by this
reference.
SECTION 5. EQUALIZATION, APPROVAL, CONFIRMATION AND LEVY OF
SPECIAL ASSESSMENTS: The special assessments for the project on
the parcels specially benefitted by the project, all as specified
in the final assessment roll marked as Exhibit "B" which is
attached to this Resolution, are hereby equalized, approved,
confirmed and levied. Promptly following the adoption of this
Resolution, those special assessments shall be recorded by the City
Clerk in a special book, to be know as the "Improvement Lien Book."
The special assessment against each respective parcel shown on such
final assessment roll and interest thereon, as hereafter provided,
shall be and shall remain a legal, valid and binding first lien on
such parcel until paid; such lien shall be coequal with the lien of
all state, county, district, municipal or other governmental taxes
and superior in dignity to all other liens, titles and claims.
SECTION 6. FINALIZATION OF SPECIAL ASSESSMENTS: When the
project has been constructed or otherwise provided to the
satisfaction of the City, the City shall adopt a resolution
accepting the same and determining the actual cost thereof, as
required by Sections 170.08 and 170.09, Florida Statutes. The City

shall credit to each special assessment for the project the
difference between the special assessment as hereby made, approved
and confirmed and the proportionate part of the actual cost of the
project to be paid by special assessment, as finally determined
upon completion thereof, but in no event shall the final amount of
any such special assessment exceed the amount of benefits
originally assessed hereunder. Such credits shall be entered in
the Improvement Lien Book. Once the final amount of the special
assessments for all of the improvements have been determined, the
term "special assessment" shall, with respect to each parcel, mean
the sum of the cost of the project.
SECTION 7. PAYMENT OF SPECIAL ASSESSMENT AND METHOD OF
COLLECTION:
A. Ail special assessments shall be payable in no more
than ten (10) equal yearly installments of principal plus
interest charged at a rate of eight percent (8%) per annum
charged on the sum of the unpaid principal. The first
installment payment of principal and interest shall be made
within twelve (12) months from the due date. The due date
shall be forty-five (45) days from the date of the adoption of
a resolution affirming the special assessments after the
City's acceptance of the project.
B. The City will record the special assessments and
this Resolution, which describes the properties assessed and
the amount of the special assessments on the public records,

which shall constitute prima facie evidence of the validity of
the special assessments.
SECTION 8. SEVERABILITY: If any section or part of a section
of this Resolution is declared invalid or unconstitutional, the
validity, force and effect of any other section or part of a
section of this Resolution shall not thereby be affected or
impaired unless it clearly appears that such other section or part
of a section of this Resolution is wholly or necessarily dependent
upon the section or part of a section so held to be invalid or
unconstitutional.
SECTION 9. CONFLICTS: Ail Resolutions or parts thereof in
conflict herewith are, to the extent of such conflict, superseded
and repealed.
SECTION 10. EFFECTIVE DATE: This Resolution shall take
effect immediately upon its adoption.

BEFORE ME, the undersigned Notary Public, personally appeared
ARTHUR L. FIRTION as Mayor of the City of Sebastian, Indian River
County, Florida, and KATHRYN O'HALLORAN, as Clerk of the City of
Sebastian, Indian River County, Florida, who were duly sworn, state
and certify as follows:
1. That Arthur L. Firtion is the duly elected Mayor of the
City of Sebastian, Florida.
2. That Kathryn O'Halloran is the duly appointed City Clerk
of the City of Sebastian, Florida.
3. That the address of the City of Sebastian, Florida is
1225 Main Street, Sebastian, Florida 32958.
4. On the 28th day of September, 1994, the City Council of
the city of Sebastian, Florida adopted Resolution R-94-53 which has
been simultaneously recorded with the Clerk of the Circuit Court in
the Public Records of Indian River County in O.R. Book __, Page
Resolution R-94-53 levied a special assessment lien on
certain properties for a public water project known as the
"Riverfront Project."
5. The City of Sebastian, Indian River County, Florida
claims a special assessment lien under the provisions of Resolution
R-94-53 on the real property described in Exhibit "A" which is
attached hereto and made a part hereof by this reference. The post
