A RESOLUTION OF THE CITY OF SEBASTIAN, INDIAN
RIVER COUNTY, FLORIDA, TO ENTER INTO A PLANT A
TREE TRUST FUND GP, U_NT MEMORANDUM OF AGREEMENT
WITH THE STATE OF FLORIDA, DEPARTMENT OF
AGRICULTURE AND CONSUMER SERVICES; PROVIDING
FOR SEVERABILITY; PROVIDING FOR REPEAL OF
RESOLUTIONS OR PARTS OF RESOLUTIONS,
CONFLICTS; AND PROVIDING FOR AN EFFECTIVE
DATE.
WHEREAS, the City of Sebastian, Florida, wishes to beautify
certain public properties within its city limits through the
planting of native trees; and
WHEREAS, the City of Sebastian, Florida, wishes its citizens
to benefit from the environmental and recreational benefits
associated with community trees; and
WHEREAS, the City of Sebastian, Florida, wishes to enter into
an agreement with the Department of Agriculture and Consumer
Services to allow for reimbursement of Plant A Tree Trust Funds for
tree planting;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF SEBASTIAN, INDIAN RIVER COUNTY, FLORIDA, the followlng:
SECTION 1. The Department of Community Development is hereby
authorized to submit to the Department of Agriculture and Consumer
Services a proposal/application for a Plant A Tree Trust Fund tree
planting grant to plant and maintain native trees.
SECTION 2. The Director of Community Development is hereby
authorized to send copies of this Resolution to the Department of

Agriculture and Consumer Services and all other persons as directed
by the City Council.
SECTION 3. REPEAL: All Resolutions or parts of Resolutions
in conflict herewith are repealed.
SECTION 4. SEVERABILITY: If any section or part of a
section of this Resolution is declared invalid or unconstitutional,
the validity, force and effect of any other section or part of a
section of this Resolution shall not thereby be affected or
impaired unless it clearly appears that such other section or part
of a section of this Resolution is wholly or necessarily dependent
upon the section or part of a section so held to be invalid or
unconstitutional.
SECTION 5. CONFLICTS: All Resolutions or parts thereof in
conflict herewith are, to the extent of such conflict, superseded
and repealed.
SECTION 6. EFFECTIVE DATE: This Resolution shall take effect
immediately upon its adoption.

This Resolution was duly passed and adopted by the City
Council of the City of Sebastian, Indian River County,
Florida, at its regular meeting on the 2~ day of
1995.
