R-96 - 55 A RESOLUTION OF THE CITY OF SEBASTIAN, INDIAN RIVER COUNTY, FLORIDA, GRANTING AN EXTENSION TO SECTION 4.(8) OF RESOLOUTION NO. 96-24, A SPECIAL USE PERMIT AND MINING PERMIT TO RICHARD FEY FOR A SAND MINE ON APPROXIMATELY 11 ACRES OF LAND; PROVIDING FOR SEVERABILITY; PROVIDING FOR REPEAL OF RESOLUTIONS OR PARTS OF RESOLUTIONS; CONFLICTS; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City Council on February 22, 1995, approved Resolution 95-09, which granted a special use and mining permit to Richard Fey on approximately 11 acres of land located off Old Dixie Highway for a one year period; and WHEREAS, the City Council on February 14, 1996 approved Resolution 96-24, granting an extension for Resolution 95-09 to February 7, 1997; and WHEREAS, Resolution 96-24, requires the landowner to submit to the City a survey under the seal of a Florida Registered Land Surveyor six (6) months from the date of the resolution which will display the topography of the site. WHEREAS, Richard Fey has requested a thirty day extension of the six momh requiremem. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SEBASTIAN, INDIAN RIVER COUNTY, FLOIRDA, as follows: SECTION 1. APPROVAL: The City of Sebastian hereby approves a 30 day extension of the requiremem of submitting a topography survey of the site under seal of a Florida Registered Land Surveyor from six momhs to seven months as required in Section 4. (8) of Resolution 96-24. Said survey shall be submitted to the city on or before September 14, 1996. SECTION 2. SEVERABILITY: If any section or pan of a section of this Resolution is declared invalid or unconstitutional, the validity, force and effect of any other section or part of a section of this resolution shall not thereby be affected or impaired unless it clearly appears that such other section or part of a section of this Resolution is wholly or necessarily dependent upon the section or part of a section so held to be invalid or unconstitutional. SECTION 3. CONFLICTS: All Resolutions or parts thereof in conflict herewith are, to the extent of such conflict, superseded and repealed. SECTION4. EFFECTIVE DATE: This Resolution shall take effect immediately upon is adoption. ~o/uThe foregoing Resolution was moved for adoption by Councilmember ~ .
