R-96-64 A RESOLUTION OF THE CITY OF SEBASTIAN, INDIAN RIVER COUNTY, FLORIDA, SUPPORTING AN APPLICATION FOR A HISTORICAL RESOURCES GRANT-IN-AID, AUTHORIZING THE MAYOR TO SIGN A CIVIL RIGHTS ASSURANCE OF COMPLIANCE, AUTHORIZING'THE CITY MANAGER TO SIGN AND SUBMIT THE GRANT-IN-AID APPLICATION, AND PROVIDING FOR REPEAL OF RESOLUTIONS OR PARTS OF RESOLUTIONS IN CONFLICT HEREWITH; PROVIDING FOR SEVERABILiTY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City of Sebastian is required to update the City's comprehensive plan; and WHEREAS, the City of Sebastian desires to include a historical preservation element as an optional element in the updated comprehensive plan; and WHEREAS, the Florida Department of State has announced the availability of funds through a Historical Resources Grant-in-aid program for the preparation of said historical preservation element; and WHEREAS, the City of Sebastian desires to utilize funds through said Historical Resources Grant-in-aid to complete a historical preservation element; and WHEREAS, the Riverfront Advisory Committee has recommended that the City Council support an application for said Historical Resources Grant-in-aid, NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SEBASTIAN, INDIAN RIVER COUNTY, FLORIDA, that: Section 1. SUPPORT. The City Council hereby supports the application for a Historical Resources Grant-in-aid in the amount of $3,000 to be matched by the City. Section 2. CIVIL RIGHTS ASSURANCE OF COMPLIANCE. The Mayor of the City of Sebastian, Indian River County, Florida, is hereby authorized to sign the civil rights assurance of compliance, attached hereto as Exhibit "A". Section 3. AUTHOlilZATION. The City Manager is hereby authorized to sign and submit to the Florida Department of State the application for a Historical Resources Grant-in-aid in the amount of $3,000 to be matched by the City. Section 4. CONFLICT. conflict are hereby repealed. All resolutions or parts of resolutions in Section 5. SEVERABILITY. In the event a court of competent jurisdiction shall hold or de~ermine that any part of this resolution is invalid or unconstitutional, the remainder of the Resolution shall not be affected and it shall be presumed that the City Council of the City of Sebastian did not intend to enact such invalid or unconstitutional provision. It shall be further be assumed that the City Council would have enacted the remainder of the Resolution without said invalid and unconstitutional provision, thereby causing said remainder to remain in full force and effect. Section 6. upon final passage. EFFCTIVE DATE. OF COI~PLZANC~ City of Sebastian (hereinafter called "Apphcant-Recipient") hereby agrees that it will comply with Title VI of the Civil l~dghts Act of 1964 (P.L. 88-352) and all requirements imposed by or pursuant to the Depamnent of the Interior Regulations (43 C.-wR 17) issued pttrsuant to that rifle, to the end that, m accordance with Title VI of the Act and the Regular/ohs, no person in the United States shall, on the ground of race, color, or national origin be excluded from participation in, be demed the benefits of, or be othenvise subjected to discrimination under any program or activity for which the Applicant- Recipient receives financial assistance from the Honda Department of State and hereby gives assurance that it will immediately take any measures to effectuate this agre~nent. The Applicant-Recipient also agrees to comply with Section 50¢ of the Rehabilitation Act of 1973 and the Age Discrimination Act of 1975 and all requixements imposed by or pursuant to the Department of the Interior Regulations (43 C~R 17) issued pursuant to these rifles, to the end that. no person in the umted States shaft, on the grounds of disability or age be excluded from parucipauon in. be denied the benefits of, or be otherwise subjected to discrimination under any program or activity, for which the Applicant- Recipient receives financial assistance Rom the National Park Service and hereby gives assurance that it will immediamly take any measures to effectuate this agreement. If any real property or strucun~ thereon is provided or improved with the aid of Federal financial assistance extended to the Applicant-Recipient by. the Florida Department of State, this assurance obligates the Applicant-Recipient, or m the case of any transfer of such property, any transferee for the period dunng which the real property, or structure is used for a purpose involving the provision of similar services or benefits. If any personal property is so provided, this :mmrance obligates the Applicant-Recipient for the period dunng which it retains ownership or possession of the property. In all other cases, this assurance obligates the Applicant- Recipient for the period during which the Federal financial assistance is extended to it by the Florida Department of State. This assurance is given in consideration of and for the pm'pose of obtaining any and ail Federal granta, loans, contracts, property discounts or other Federal financial assistance extended after the date hereof to the Applicant-Recipient by the bureau or office, including inmallment payments al%r such date on account of'arrangements for Federal financial assistance which ,sere approved before such date. The Applicant-Recipient recognizes and agrees that such Federal financial assistance will be extended in reliance on the representations and agreements made m this assurance, and that the United States shall reserve the right to seek judicial enforcement of this assm'ance. This asmaance is binding on the Applicant-Recipient, its successors, transferees, and assignees, and the person or person~ whose signature appear below are authorized to sign this assurance on behalf of the Applicant-Recipient.
