A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
SEBASTIAN, INDIAN RIVER COUNTY, FLORIDA, ESTABLISHING 'NO
PARKING' (OR RESTRICTED PARKING) AREAS PURSUANT TO 0-9?-
$5~ PROVIDING FOR REPEAL OF INCONSISTENT PROVISIONS~
PROVIDING FOR SEVERABILITY~ PROVIDING FOR ]tN EFFECTIVE
DATE.
WHEREAS, the 0-97-55 authorizes the City Council, by
resolution, to establish "no parking" (or "restricted parking")
zones within the City of Sebastian; and
WHEREAS, the city Council finds that it is the best interest
of its citizens to establish certain specific "no parking" (or
"restricted parking") zones within the City of Sebastian, as
provided herein, in furtherance of the public health, safety and
welfare.
NOW, THEREFORE, BE IT RESOLVED BY the City Council of the
city of Sebastian, Florida, as follows:
Section 1: The City Council hereby establishes "no parking"
(or "restricted parking") zones within the boundaries of the City
of Sebastian as illustrated in Exhibit "A", which is attached hereto
and incorporated herein by this reference. As provided in the City
of Sebastian Code of Ordinances, it shall be unlawful for any
person to park, store or leave any motor vehicle in the designated
"no parking" zone.
Section 2: The City Manager is hereby authorized to take the
appropriate steps, including the placement of appropriate signage,
to carry out the directives set forth herein.
Section 3: If any section or part of a section of this
Resolution is declared invalid or unconstitutional, the validity,
force and effect of any other section or part of a section of this
Resolution shall not thereby be affected or impaired unless it
clearly appears that such other section or part of a section of
this Resolution is wholly or necessarily dependent upon the section
or part of a section so held to be invalid or unconstitutional.
section 4: This Resolution shall prevail over all other
Resolutions which are in conflict with this Resolution. If any
clause, section or other part or application of this Resolution
shall be held by any Court of competent jurisdiction to be
unconstitutional or invalid, such unconstitutional or invalid part
or application shall be considered as eliminated and in no way
affecting the validity of the remaining portions or applications
remaining in full force and effect.
Section 6: This Resolution shall go into effect immediately
upon its passage and adoption and authentication by the signature
of the presiding officer and the Clerk of the City Council.

EXHIBIT "A"
PROHIBITED PARKING FOR A PORTION OF THE
RIGHT-OF-WAY FOR INDIAN RIVER DRIVE
All parking within the right-of way east of the east edge of
the pavement of Indian River Drive lying between Harrison
Street and Fellsmere Road is prohibited.
