A RESOLUTION BY THE CITY COUNCIL OF THE CITY OF
SEBASTIAN, INDIAN RIVER COUNTY, FLORIDA,
AUTHORIZING THE PREPARATION OF AN ORDINANCE
AND REQUISITE PUBLIC HEARINGS APPROPRIATE FOR
THE ESTABLISHMENT OF A MORATORIUM ON
CONSTRUCTION AND LAND DEVELOPMENT REQUESTS
INCLUDING BUT NOT LIMITED TO COMPREHENSIVE
PLAN AMENDMENTS, REZONING OF REAL PROPERTY,
SITE PLANS AND BUILDING PERMITS; ESTABLISHING
THE PURPOSE OF THE MORATORIUM; ESTABLISHING
AN EFFECTIVE GEOGRAPHICAL AREA; ESTABLISHING
AN EFFECTIVE DATE AND ESTABLISHING A
TERMINATION DATE OF THE PROPOSED MORATORIUM.
WHEREAS, the City Council of the City of Sebastian, Indian River County, Florida,
received and accepted a study entitled the "Riverfront Plan"from an advisory committee; and,
WHEREAS, the defined area of the Sebastian Riverfront study area is the incorporated area
of the City of Sebastian lying between the Florida East Coast Railroad and the Indian River Lagoon;
and,
WHEREAS, the "Riverfront Plan" recommended the establishment of certain land use
designations, architectural design standards, modified landscape requirements and sign regulations;
and,
WHEREAS, the City Council is in the process of amending its local govemmem
comprehensive plan and preparing proposed ordinances to adopt certain restrictions and regulations;
and,
WHEREAS, there exists certain time restrictions necessary for the adoption of said
comprehensive plan amendments and any proposed regulations as may considered; and,
WHEREAS, the establishment of a moratorium is necessary in order to establish a unified
plan for this area in furtherance of the general health, safety and welfare of the public within the
affected area may occur;
NOW, THEREFORE BE IT RESOLVED by the City Council of the City of Sebastian,
Indian River County Florida that:
~ AUTItORIZATION. The City Attomey is authorized to prepare an appropriate
ordinance providing for the establishment of an appropriate moratorium on construction and land
development requests until the Local Government Planning Act amendment and land development
ordinances are complete.
Section 2. PURPOSE. The City Council hereby declares that the purpose for the
moratorium is based on the need to restrict development requests until such time as proposed
regulations have been adopted to protect the general health, safety and welfare of the public with the
affected area.
Section 3. AREA. The geographical area affected is defined as that area within the
municipal corporate limits of the City of Sebastian lying between the Florida East Coast Railroad
and the Indian River Lagoon.
Section 4. HEARINGS. The first public hearing and reading shall be held on Wednesday,
November 5, 1997, at 7:00 PM, and the second public hearing and reading shall be held on

Wednesday, November 19, 1997 at 7:00 PM.

to a vote, the vote was as follows:

The Mayor thereupon declared this Resolution duly Passed and adopted this 22nd day of October,
