R-97-74 A RESOLUTION OF THE CITY OF SEBASTIAN, INDIAN RIVER COUNTY, FLORIDA, APPROVING THE PRELIMINARY PLAT FOR A REPLAT OF A PORTION OF SEBATIAN HIGHLANDS UNIT 17; PROVIDING FOR REPEAL OF RESOLUTIONS OR PARTS OF RESOLUTIONS IN CONFLICT HEREWITH; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, Cornerstone Select Homes has applied for approval of a preliminary plat for a replat of a portion of Sebastian Highlands Unit 17, and WHEREAS, the Planning and Zoning Commission has recommended approval of the preliminary plat for a replat of a portion of Sebastian Highlands Unit 17, NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SEBASTIAN, INDIAN RIVER COUNTY, FLORIDA, that: Section 1. PRELIMINARY PLAT APPROVAL. The preliminary plat for a replat of Lots 1 through 14, Block 582, together with lots 15 through 28, Block 583, together with that portion of Appleburg Street South of the south right-of-way of Thunderbird Drive, according to the plat of Sebastian Highlands Unit 17, as recorded in Plat Book 8, Pages 46 through 46P, Public Records of Indian River County, as prepared by BSE Consultants, Inc., April 23, 1997, is approved with the following conditions: 1. The final plat shall be approved within twelve months. 2. On Sheet 1 of 2, include the City Engineer Signature under the certificates of approval. 3. On Sheet 2 of 2 change the names of Girard Ave., Sunburst. North Street, and Thunderbird Drive to Sunburst Circle, and Girard Court to Sunburst Court. 4. On Sheet 2 of 2, note 8, change City of Sebastian to Indian River County. 5. On Sheet 2 of 2, add note showing right-of-way access from Appleburg and Sunburst Court (Girard Court) to stormwater management pond. 6. A 15 foot right-of-way easement to Schuman Waterway between lots 13 an 14 is required, in addition to the easement for access to the waterway for maintenance. The pond design needs to include a 20 foot stabilized earthen driveway around the perimeter particularly around the north, east, and south sides. This will allow maintenance equipment to access adjacent areas where sedimentation is most likely to occur. Section 2. hereby repealed. CONFLICT.
