R-98-36 A RESOLUTION OF THE CITY OF SEBASTIAN, INDIAN RIVER COUNTY, FLORIDA, APPROVING AND AUTHORIZING THE CITY MANAGER TO EXECUTE, APPLY FOR AND ADMINISTER, AND THE OTY CLERK TO ATTEST, ON BEHALF OF THE CITY OF SEBASTIAN, A FLORIDA DEPARTMENT OF ENVIRONMENTAL PROTECTION SPEGAL W ATERW A Y PROJECTS PROGRAM (SWPP) GRANT FOR THE MAIN STREET BOAT RAMP EXTENSION; PROVIDING FOR REPEAL OF RESOLUTIONS OR PARTS OF RESOLUTIONS IN CONFLICT HEREWITH; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City Council of the City of Sebastian deems it in the best interest of the public health, safety and welfare to extend the Main Street boat ramp; and WHEREAS, the City of Sebastian has an opportunity to obtain a grant from the Florida Department of Environmental Protection for the extension of the Main Street boat ramp; and WHEREAS, the Florida Department of Environmental Protection requires a Resolution from the City authorizing a designated representative to apply for and administer the grant on behalf of the applicant. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SEBASTIAN, INDIAN RIVER COUNTY, FLORIDA, that: Section 1. AUTHORIZATION FOR CITY MANAGER. The City Council of the City of Sebastian hereby approves and authorizes the City Manager to execute, apply for and administer, and the City Clerk to attest, on behalf of the City of Sebastian, a Florida Department of Environmental Protection Special Waterway Projects Program (SWPP) grant for the Main Street boat ramp extension. Section 2. CONFLICT. All resolutions or parts of resolutions in conflict herewith are hereby repealed. Section 3. EFFECTIVE DATE. The repairs shall consist of replacing the structural members and decking of a 350 foot fishing dock facility. The project will also include repairing a concrete boat ramp that is undermined and wearing from use and exposure. Finger piers along the boat ramp will be extended an additional 1 0 feet on both sides ofthe ramp. AND, Florida Inland Navigation District financial assistance IS required for the program mentioned above, NOW THEREFORE, be it resolved by the Ci ty of Sebastian (Name of Agency) that the project described above be authorized, AND, be it further resolved that said City of Sebastian (Name of Agency) make application to the Florida Inland Navigation District in the amount of 50 % of the AND, be it further resolved by the City of Sebastian (Name of Agency) City of Sebastian (Name of Agency) " ,1 actual cost of the project in behalf of said that it certifies to the following: 1. That it will accept the terms and conditions set forth in FIND Rule 66B-2 F.A.C. and which will be a part of the Project Agreeinent for any assistance awarded under the attached proposal. 2. That it is in complete accord with the attached proposal and that it will carry out the Program in the manner described in the proposal and any plans and specifications attached Form No. 90-11 Rev. 10-14-92 (1) /1 thereto unless prior approval for any change has been received from the District. 3. That it has the ability and intention to finance its share of the cost of the project and that the project will be operated and maintained at the expense of said City of Sebastian (Name of Agency) for public use. 4. That it will not discriminate against any person on the basis ofrace, color or national origin in the use of any property or facility acquired or developed pursuant to this proposal, and shall comply with the terms and intent of the Title VI of the Civil Rights Act of 1964, P. L. 88-352 (1964) and design and construct all facilities to comply fully with statutes relating to accessibility by handicapped persons as well as other federal, state and local laws, rules and requirements. 5. That it will maintain adequate financial records on the proposed project to substantiate claims for reimbursement. 6. That it will make available to FIND if requested, a post-audit of expenses incurred on the project prior to, or in conjunction with, request for the final 10% of the funding agreed to by FIND.
