RESOLUTION NO. R-99-41
A RESOLUTION OF THE CITY OF SEBASTIAN, INDIAN RIVER
COUNTY, FLORIDA, ENCOURAGING CONSIDERA TION OF
mSTORIC SIGNIFICANCE OF SITES IN VARIANCE
DETERMINATIONS; PROVIDING FOR CONFLICT; PROVIDING
FOR EFFECTIVE DATE.
WHEREAS, the City of Sebastian has designated its Riverfront Area along the
Indian River as a Community Redevelopment Area and an area of special concern; and
WHEREAS, one of the problems facing the Riverfront is balancing the parking
needs of the property owners with the adopted goal of protecting and projecting the City's
historic image as an Old Florida fishing village; and
WHEREAS, parking concerns are especially troubling for the historic business
area in the vicinity of the Main Street and Central Avenue intersection; and
WHEREAS, the City will be well-served to give heightened consideration to the
historic significance of buildings in the Riverfront Area when administrating the provisions
of the Land Development Code; and
WHEREAS, such consideration is consistent with the variance criteria provisions
of Land Development Code sections 20A-I1.2.D.2(a) Public interest upheld and 20A-
11.2.D.3(a) Existence of special conditions or circumstances, (b) Conditions not created
by applicant, (d) Hardship conditions exist, and (f) Not injurious to public welfare or
intent of ordinance.

NOW THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE
CITY OF SEBASTIAN, as follows:
Section 1.
REQUEST TO BOARD OF ADJUSTMENT.
The City
Council of the City of Sebastian hereby requests that the Board of Adjustment give great
weight to the historic significance of a building in determining a variance request during
redevelopment of the site, so as to encourage preservation and enhancement of these
historic structures and their character.
Section 2.
CONFLICTS.
All resolutions or parts of resolutions in
conflict herewith are hereby repealed.
Section 3.
EFFECTIVE DATE. This resolution shall take effect immediately
