AUGUST 21, 2002
Chairwoman Barczyk called the meeting to order at 2:15 p.m.
The Pledge of Allegiance was recited.

"I make a motion that we approve the minute.
NOTICED HEARINGS:
VIOLATION HEARING CASE g2001-0023990
WILLIAM WARREN STEVENS - 1421 THORNHILL LANE
Section 66-3 (1 - 11 - 12) Code of Ordinances
Code Enforcement Officer Lindquist was sworn in by Chairwoman Barczyk and presented Case #2001-0023990.
He stated that this case began with Officer Hovasse in November 2001 and on April 17th, 2002 Mr. Stevens was
directed to correct his violations within 100 days which ended on July 26, 2002. Code Enforcement Officer
Lindquist inspected the property on July 29, 2002 and was told by Mr. Stevens that the rain prevented him from
correcting his violations earlier. Code Enforcement Officer Lindquist asked the board to give Mr. Stevens a 20 day
extension. Code Enforcement Officer Lindquist then presented power point pictures of Mr. Stevens property taken
on 11/7/01, 4/17/02, 7/29/02 and 8/20/02.
Subsequent to the slide show discussion followed on the garage on Mr. Stevens' property and Code Enforcement
Officer Lmdqmst was asked for the Cty s recommendat~o . He replied that Mr. Stevens does pass inspection at this
time.

Chairwoman Barczyk sworn in Mr. Stevens who stated an engine is gone and the Thunderbird will be removed also
from his property. Mr. Stevens also stated that he applied for permits to re-pave his driveway and to build a deck in
his breezeway. He further stated that telephone poles laying alongside his house will be used to pave the new
driveway.
Bob Kicia of 1392 Thornhill Lane questioned the number of unlicensed vehicles that are allowed on the property.
Code Enforcement Officer Lindquist replied only one unlicensed vehicle is allowed. Discussion followed on a
trailer currently in front of the house. Mr. Kicia asked if there is a time limit for the building permits which Mr.
Stevens received a few days ago. The City Attorney replied that permits are good for a year but work should be in
progress during that year.
Discussion followed on the items under the breezeway. The City Attorney clarified that Mr. Stevens was not in
compliance in July when the order was due and the order pertains to junk and debris, not storage.
Mrs. Barczyk stated the Board should go by the officer and his pictures.
Diane Collins, owner of 1401 Thornhill Lane, expressed concerns raised by her realtor relative to rats, mice and
mosquitoes.
MOTION by Cosco/
"I make a motion that we in case g2001-0023990 go along with the city's recommendation and give Mr.
Steven how many days did you suggest (Mr. Lindquist-tbe 100 days ended on the 26th of July, so it'd be the five
days plus) (Mr. Stringer-it's easiest just to say-to prohibit math problems-it's easiest to say extend the time of
compliance through such and such a date) (Mr. Lindquist since I took the pictures yesterday, I'd recommend the 19th
of August I mean of September) (Mr. Stringer- he's saying he's in compliance, as of yesterday, he's was in
compliance) (Mr. Lindquist-I misunderstood what you all were doing, I thought he was making a motion to because
of the rain and everything to extend that) Mr. Cosco-oh scratch that."
Mr. Cosco withdrew his motion.
MOTION by Cosco/Barczyk
"All right, I make another motion that we find Mr. Stevens was in noncompliance and as of this date he is
in compliance and if he is found to be in non-compliance again under the same violations, then he would be subject
to potential fines."
Mr. Stringer stated the five-year time frame begins the date of the first order.

"I'd like to make a motion that we fine this gentleman, Mr. Stevens, $25 a day for the 24 days that he
wasn't in compliance."

7. CHAIRMAN'S MATTERS
Chairwoman Barczyk thanked the Code Enforcement officer for the workshop material. Advised the Board that she
asked the City Attorney to review basic motions she received from the St. Lucie County Code Enforcement Board
for future use. The City Attorney stated these motions would be included in their next packets.
She asked if Chief Davis could come next month and give a thumbnail sketch of how it works having police over
code enforcement and how they react and what type of codes are looked for and how that process is given to the
board. It was the consensus of the Board.
8. MEMBERS MATTERS
Mr, Cosco asked how the last fine could be reduced, The City Attorney stated after compliance a reduction could be
requested by someone who voted in favor of the motion at the next meeting. He also stated that council could
change the debt since it has left the Board's process.
Chairwoman Barczyk asked about fining for administrative cost. The City Attorney stated he would look into her
concern.
9. CODE ENFORCEMENT OFFICER'S MATTERS
The Code Enforcement Officer stated there may be a couple of cases to be heard next month. Mr. Seeley asked if he
could ride with the officer, and he was invited to do so.
10. CITY ATTORNEY'S MATTERS
The City Attorney reminded the Board that having a nuisance is a violation of the code but with a nuisance
abatement the City can mow the yard and send the bill to the homeowner and the bill can be attached to homestead
property.
