ROLL CALL: Chairman VanBuskirk Mr. Neglia Mr. Simmons Mrs. Barczyk Mr. Seeley Ms. Schofield Mr. Manuel Unexcused Absences: Mr. Cosco Mr. Griffin Also Present: Rich Stringer, City Attorney Police Capt. Dave Puscher Code Enforcement Officer Antoine Van Meir Donna Cyr-Williams, Secretary Jeanette Williams, Recording Secretary APPROVAL OF MINUTES: 2/19/03 Meeting Voice vote on the motion carded 7-0. NOTICED HEARINGS: FALSE ALARM VIOLATION - PERMIT #2264 - APPEAL OF FINE MR. & MRS. LEWIS MEDEIROS - 558 ACACIA AVENUE Section 39-39 Code of Ordinances Mr. & Mrs. Medeiros were not present. The City Attorney advised the Board to table this hearing until the next meeting. MOTION by Neglia/Barczyk "I'll make a motion that we continue this until the next code enforcement board meeting which is April 16t~.'' Voice vote on the motion carded 7-0. Code Enforcement Board Meeting March 19, 2003 Page Two VIOLATION HEARING - CASE #2002-27104 ANTONIO & REGINA DEPAIVA - 1597 RIDGELY LANE Section 66-3 (12) Code of Ordinances Chairman VanBuskirk sworn in Officer VanMeir. The Code Enforcement Officer stated that he delivered notice to Mr. Depaiva and subsequently spoke to Mr. Depaiva who had since complied with his vehicle. The Officer further stated that the original violation was high lawn grass which is also currently in compliance. The Officer advised that Mr. Depaiva is a repeat code violator. Officer VanMeir presented pictures of the vehicle violation. Chairman VanBuskirk confirmed that the vehicle was in compliance at the time of the meeting. The City Attorney advised the Board that they could make a motion that Mr. Depaiva was in violation but currently in compliance and issue no fmc. MOTION by Neglia/Barczyk "I'd like to make a motion on violation case #2002-27104, Mr. Lewis Medeiros 558 Acacia Avenue, oh wrong one, I'm sor~--I'm sorry, 1597 Ridgely Lane, fmc him in violation of that section and with no fmc issued but if he was to come in violation again, he would be a repeat violation and then he would subject to fmcs of $500.00 a day." CHAIRMAN'S MATTERS Chairman VanBuskirk reported that he attended the City of Vero Beach's code enforcement meeting which was a smaller scale than Indian River County's. The Chairman than introduced new alternate member, Robert Manuel and asked everyone to pray for our troops overseas. 7. MEMBER'S MATTERS Ms. Schofield asked that an alarm techifician present the workings of alarm systems to the Board. Mrs. Barczyk asked about the code enforcement synopsis indicating the two officer's zones. Officer VanMeir described the code enforcement zones and procedures. Mr. Seeley asked about the following up of code enforcement fmcs. Ms. Cyr-Williams stated that information on paid fines could be provided in the future. Code Enforcement Board Meeting March 19, 2003 Page Three 8. CODE ENFORCEMENT OFFICER'S MATTERS Capt. Puscher stated that there have been recent concerns about the activities in Wal-Mart's parking lot. He went on to state that the Department is working with a Micco resident on this matter in addition to other activities in the parking lot. Capt. Puscher additionally stated the frae amount is up to approximately $3,000. so far this year. 9. ATTORNEY'S MATTERS The City Attorney stated that Wal-Marts nationwide are having a problem with trackers parking overnight. He further stated that Wal-Mart has a designated area in their site plan for special events that they follow per the code. Mrs. Barczyk asked why the Workforce Development van was parked in the front City Hall parking lot and Capt. Puscher advised that police department mining was taking place in the van on a temporary basis. 10.
