A RESOLUTION OF THE CITY OF SEBASTIAN, FLORIDA
ELECTING TO USE THE UNIFORM METHOD OF
COLLECTING NON-AD VALOREM SPECIAL ASSESSMENTS
FOR SOLID WASTE COLLECTION SERVICES; STATING A
NEED FOR SUCH LEVY; PROVIDING FOR THE MAILING
HEREOF; PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the City of Sebastian, Florida is contemplating the imposition of
assessments for the provision of solid waste collection services to improved residential
properties; and
WHEREAS, if such assessments are implemented the City intends to use the
uniform method for collecting non-ad valorem special assessments for the cost of
providing solid waste collection services to improved residential properties within the
incorporated area of the City as authorized by section 197.3632, Florida Statutes, as
amended, because this method will allow such special assessments to be collected
annually commencing in November 2003, in the same manner as provided for ad valorem
taxes; and
WHEREAS, the City held a duly advertised public heating prior to adoption of
this Resolution, proof of publication of such heating being attached hereto;
NOW, THEREFORE BE IT RESOLVED:
Section 1. Commencing with the calendar year beginning on January 1, 2003
and with the tax statement issued in November of said Year, the City intends to use the
uniform method of collecting non-ad valorem assessments authorized in section
197.3632, Florida Statutes, as amended, for collecting non-ad valorem assessments for
the cost of providing solid waste collection services. Such non-ad valorem assessments
shall be levied within the incorporated area of the City, and the area subject to the
assessment shall be all land within the corporate limits of the City of Sebastian as
constituted under the law.
Section 2. The City hereby determines that the levy of the assessments is needed
to fund the cost of solid waste collection services within the incorporated area of the City.
Section 3. Upon adoption, the City Clerk is hereby directed to send a copy of
this Resolution by U.S. mail to the Flor/da Department of Revenue, the Indian River
County Tax Collector, and the Indian River County Property Appraiser by January 10,
2003.
Section 4. This Resolution shall be effective upon adoption.
The foregoing Resolution was moved for adoption by Councilmember
Hajcher . The motion was seconded by Councilmember Barczyk and, upon
being put into a vote, the vote was as follows:

The Mayor thereupon declared this Resolution duly passed and adopted 11th day of
December 2002.

NOTICE OF INTENT TO USE UNIFORM METHOD OF
COLLECTING NON-AD VALOREM ASSESSMENTS
The City of Sebastian, Florida, on behalf of itself or a successor created by home
rule or under general law (the "City"), hereby provides notice, pursuant to section
197.3632(3)(a), Florida Statutes, of its intent to use the uniform method of collec6ag
non-afl valorem special assessments to be levied within the incorporated area of the City
for the cost of providing sc]id waste collection services. The City will consider the
adoption of a resolution electing to use the uniform method of collecting such
assessments authorized by section 197.3632, Florida Statutes, at a public hearing to be
held at 7:00 p.m., December 11, 2002 at City Hall, 1225 Main Street, Sebastian, Florida.
Such resolution will state the need for the levy and will contain a legal description of the
boundaries of the real property subject to the levy. Copies of the proposed form of
resolution, wkich cont~n~ the legal description of the real property subject to the ]evy,
are on file at the Office of the City Clerk, 1225 Main Street, Sebastian, Florida. A.11
interested persons are invited to attend.

any matter relating to the consideration of the resolution at the above-referenced public
hearing, a record of the proceeding may be needed and in such an event, sush person may
need to ensure that a verbatim record of the public hearing is made, which record
includes the testimony and evidence on which the appeal is to be based. Ym accordance
