HomeMy WebLinkAboutReservations for Right of WaysRESOLUTION On Motion of Councilman, i[~eC~J ......... r , the following seconded by Councilman, .~ Resolution was adopted by the City Council of the CITY OF SEBASTIAN, Indian River County, Florida, in regular session on ' the ' ='' ~n day of ~ 1964. WHEREAS, Chapter 18296, Laws of Florida, commonly known as the "Murphy Act", contains a provision that all deeds issued by the Trustees of the Internal Improvement Fund of the State of Florida pur- suant to authority granted under said Chapter require that reservations for road rights-of-way be made therein, and WHEREAS, Trustees' Deeds No. 286, 334 and 336, respective- ly, conve~ng certain lands more particularly described in said Deeds, l~ng and being within the city limits of the City of Sebastian, Indian River County, Florida, contain such road right-of-way reservation, and WHEREAS, an application has ~been made by General Development Corporation, a Delaware corporation, having a place of business in the County of Dude and State of Florida, and lawfully authorized to transact business in the State of Florida, for the release of the said reservations which are in excess of the State Road Department's recommendation for road rights-of-way as the same pertain to a portion of RoselandRoad lying within Sections 11 and 14, of Township 31 South, Range 38 East; and as to a proposed county road adjacent to the East line of Section 18 and the West line of Section 29, Township 31 South, Range 39 East; and WHEREAS, minimum road rights-of-way requirements have been verified by the County Engineer of Indian River County; NOW, THEREFORE~ BE IT RESOLVED by the City Council of the CITY OF SEBASTIAN, Indian River County, Florida, that as to Trustees~ Deeds No. 286 and 334, referred to above, all of the road right-of-way reservation in excess of forty (40) feet from the center line of Roseland Road, and all of the said reservation contained in Trustees' Deed No. 336, referred to above, be released to General Development Corporation, a Delaware corporation, as abutting proper- ty owner, in accordance with the Florida Statutes for releasing of rights-of-way to such property owner. BE IT FURTHER RESOLVED that certified copies of this l~esolution be forwarded~to the Trustees of the Internal Improvement Fund~ Tallahassee, Florida, and the Florida State Road Department, P. O.
