HomeMy WebLinkAbout12-17-1999City Council Information Letter December 17, 1999 Page 2 commence with working with Indian River County (IRC) and the United States Fish and Wildlife Commission (USFWC) to assemble all relevant logistics, including authorization to remove the "scrub-jay designation" from 317 vacant residential lots in Sebastian. According to IRC Director of Planning Robert Keating, we can all work to release all lots by this coming spring. A working meeting will transpire next week, so as to begin the process of assembling any formal agreements necessary between the City of Sebastian, IRC and USFWC. For good measure, attached you will find a copy of Resolution No. 2000-05, which governs the School District's participation in the program. Summary/Status: Sebastian Municipal Airport Operations Attached you will find for your edification, a copy of a Request for Proposal (RFQ) recently advertised and delivered in effort to recruit an airport consulting firm to assist the City of Sebastian in compiling a required Airport Master Plan (AMP). You will recall deliberations during last summer's budget process relative to airport operations and personnel. Goals and objectives outlined conform to the AMP serving as the key tool to govern assignment and financing of staff. In addition, the AMP will set the motion for future industrial land use, infrastructure improvements, and outside grant procurement to help fund such activities annually (e.g. Florida Department of Transportation [FDOT] Aviation Section Appropriations, the same source that will finance $240,000, or 80% towards AMP expenses). Meanwhile, various improvements are currently being performed at the airport, via resources from the Department of Public Works (DPW) and Terry Hill's leadership (including runway and field maintenance as well as 'flow well" improvements). RFQs are to be delivered by Monday, January 3, 2000. Interviews will then be scheduled for selection purposes. A Joint Participation Agreement from FDOT will be presented to City Council in the coming weeks, as this contract will govern financing for the AMP, and ultimately begin a productive intergovernmental relationship. As far as airport tenants like Skydive Sebastian, both the City Manager's Office and DPW will continue to work cooperatively to resolve complaints as issued by residents and encourage overall good business citizenship. As such, feel free to refer any complaints and/or specific inquires to our offices; as we will continue to develop and implement substantive management practices. This particular setup is better aesthetically, as well as a most effective means of providing electricity for a gazebo to be installed by the Garden Club in the coming months. Indian River County School District Meetin,q at Sebastian City Hall Please find the attached letter as delivered by Ms. Judy Stang, Executive Assistant to the School Board requesting permission to utilize City Hall to conduct School Board meetings on January 25, 2000 and June 27, 2000 respectively, at 7:00 p.m. Both meetings will take place in City Hall Council Chambers (of course, where else), whereby residents of the City of Sebastian and North Indian River County are welcome to attend. Unless any objections exist, the School District of Indian River County will soon issue public notice relative to this matter. Sebastian Area-Wide Habitat Conservation Plan As mentioned during Wednesday evening's City Council meeting, the School Board of Indian River County unanimously approved participation in the Sebastian Area-Wide Habitat Conservation Plan (the necessary authorization required to begin the process of implementing the overall program in our community). DEVELOPMENT COSTS The City of Sebastian shall not be held liable for any expenses incurred in connection with the preparation of a response to this RFQ or cost associated with interview for same. 3. General Before starting work, the Consukant shall procure and maimaln minimum levels of insurance as spec'riled by this section. B. Coverage Except as otherwise stated, the amounts and types of insurance shall conform to the following minimum requirements: 1) Worker's Compensation - Coverage to apply for all employees for Statutory Limits in compliance with the applicable state and federal laws. In addition, the policy must include: a) Employer's Liability with a limit orS 1,000,000 each accident and disease. 2) Commercial General Liability - Coverage must be afforded on a form no more restrictive than the latest edition of the Commercial General Liability Policy, On an occurrence basis, filed by the Insurance Services Office and must include: I~animum limits of $1,O00,O00 per occurrence combined single limit for Bodily Injury Liability and Property Damage Liability. b) Premises and Operations. c) Independent Contractors. Such coverage shall be maintained for a period of three (3) years following completion and acceptance of any work performed under this agreement. In the event the Consultant fails to secure and maintain such coverage, Consultant shall be deemed the insurer of such professional liability insurance and shall be responsible for all damages suffered by the City as a result thereof, including attorney's fees and costs. 5) Additional Insured - The City is to be specifically included as an additional insured. Consultant's insurance including that applicable to the City as an Additional Insured shall apply on a primary basis and any other insurance maintained by the City shall'be in excess of and shall not contribute with Consultant's insurance. Consultant's insurance shall contain a severability of interest provision, providing that, except with respect to the total limits of liability, the insurance shall apply to each Insured or Additional Insured in the same manner as if separate policies had been issued to each. 6) Notice of Cancellation and/or Restriction - Each policy must be endorsed to provide the City with a minimum of forty-five (45) days notice of cancellation and/or restriction. 7) Certificates of Insurance - Certificates of insurance evidencing the insurance coverage specified in this section shall be filled with the City before operations are begun~ The required certificates of insurance not only shall name the types of policies provided, but also shall refer specifically to this Contract and section and the above paragraphs in accordance with which insurance is being furnished, and shall state that such insurance is as required by such paragraphs of this Contract. If the initial insurance expires prior to the completion of the work, renewal certificates of insurance and required copies of policies shall be furnished thirty (30) days prior to the date of their expiration. 6. CONTENTS OF THE FIRMS STATEMENT OF QUALIFICATIONS Each firm which desires to apply for consideration shall submit five (5) copies of their Statement of Qualifications. The Statement of Qualifications shall describe the firms qualifications more specifically for the work as proposed in this RFQ. Items to be included in the finns Statement of Qualifications are contained in the attached evaluation form (exhibit). Statements should clearly identify each section listed therein. Resumes' ofstaffmembers who would be assigned to this project are required. A list of past projects ora similar nature, contact person, and phone number is also required. 7. NON-LOBBYING AGREEMENT Firms interested in submitting a response to this RFQ, agree not to contact City Council Members or any employee(s) or agent of the City at any time during the solicitation period and selection process with the intent of attempting to influence or sway toward a desired action pertaining to this project and RFQ Violators shall be disqualified. 8. SELECTION AND EVALUATION PROCEDURES The Consultant Selection Committee "committee" will review all Statements of Qualifications received utilizing the Professional Services Evaluation Form marked "exhibit" to rank and short list the firms. Interviews may then be scheduled with the committee for final ranking and selection. 9. PRICE & CONTRACT NEGOTIATION Price & Contract Negotiation may take place only after the selection and evaluation process has been completed starting with the number one ranked firm. Upon successful negotiation the City Council must approve and authorize any agreement negotiated. 10. CITY COUNCIL ACTION City Council action is final. After successful negotiations have taken place, City Council will be asked to approve. Their action is final. 11. The 1989 Florida Legislature passed Senate Bill 458 creating Sections 287.132 - 133, Florida Statutes, effective July 1, 1989. Section 287.132(3)(d), Florida Statutes, requires the Florida Department of General Services to maintain and make available to other political entities a "convicted vendor" list consisting of persons and affiliates who are disqualified from public and purchasing process because they have been found guilty of a public entity crime.
