New Tenants - Airport Lease Ne.qotiations
During the last several weeks, the City of Sebastian has been working
diligently to pursue new tenants to initiate the Sebastian Municipal Airport
Industrial Complex concept. I am pleased to report that efforts are paying
off in that we are positioned to recommend to City Council two agreements
for authorization; Greens+ (corporate name, Orange Peel Enterprises, Inc.),
a growing health food/vitamin manufacturer and Orth Aero Services, an
aircraft related services company looking to assemble a new base of
operations. Essentially, both companies were originally looking to assemble
facilities in at other Treasure Coast Area airports. However, because the
City of Sebastian is able to offer more competitive packages (lease fees,
more industrial land availability, etc.), we were able to "win them over". A
proposed agreement to lease three (3) acres, with right of first refusal for 3
additional acres for Orth Aero Services is included in your May 10th meeting
agenda, whereby company president Robert Orth will be available to
introduce himself as well as to inform you more about the organization. We
are now finalizing a proposed agreement with Greens+, whereby it is
anticipated that a proposed agreement for five (5) acres is to be presented
for your May 24th meeting (you may also have an opportunity to sample
products respectively). I personally must thank Councilmember Joe
Barczyk, who earlier this year first met with officials from Greens+ during his
travels throughout the County. He informed me of the company, which
presented the opportunity to explore said partnership.

School Resources Officer Pro,qram
Partnership with Indian River County School Board
Last week, a meeting transpired with School District of Indian River County
Superintendent Dr. Roger Dearing, Police Chief Randy White and myself to
discuss logistics associated with a financial partnership for the Sebastian
School Resource Officer Program. You will recall the program having been
reinstated earlier this year, with a police officer positioned to service both
Pelican Island and Sebastian Elementary Schools. As such, Dr. Dearing
agreed to recommend to the school board a 50% cost share agreement for
this arrangement in our community, an anticipated $20,000 to $25,000
allocation to the Sebastian Police Department. Attached is a draft
agreement to govern the arrangement, which is to be presented for your
authorization after the School District's budget process is concluded.
Florida Department of Transportation (FDOT)
Improvements to United States Hi.qhway One (US1)
Please be advised that the previously mentioned community awareness
workshop relative to the FDOT US 1 improvement initiative, is scheduled to
take place Tuesday May 23rd, 3:30 p.m. to 6:30 p.m. As such, citizens and
Sebastian business owners will have an opportunity to view conceptual
plans for enhancements, as well as discuss logistics with respective FDOT
project managers. Establishments located along US 1 in Sebastian will be
notified as the meeting is to be advertised by the FDOT Public Information
Office. Feel free to join us if your schedule permits.
Proposed Fund Raiser Initiative for Riverview Park
Local realtor Linda McLain presented a proposal earlier this week to sponsor
a fundraiser to replace playground equipment at Riverview Park. Her
company, Ed Sclitt Coldwell Banker has committed to facilitating the benefit,
whereby a bank account is to be established with the hope of beginning a
playground enhancement program later this year. As such, you may see
flyers and/or pamphlets posted and distributed throughout the community
marketing the effort.

John Danise Tennis Clinic - Schumann Drive Courts
As previously reported, local tennis professional and coach Mr. John Danise
is programming clinics to transpire in the coming weeks at the Schumann
Drive facility. Attached is the initial schedule, provided for good measure.

AGREEMENT BETWEEN
THE SCHOOL BOARD OF INDIAN RIVER COUNTY, FLORIDA
AND
THE CiTY OF SEBASTIAN POLICE DEPARTMENT
FOR
THE SCHOOL RESOURCE OFHCER PROGRAM (SRO)
THIS AGREEMENT, made and entered into this XXay of ,2000, by and between THE SCHOOL
BOARD OF INDIAN PdVER COI. B'qTY, FLORIDA, (hereinafter referred to as the SCHOOl. BOARD), and THE
CITY OF SEBASTIAN POLICE DEPARTMENT, (hereinafter referred to as the DEPARTMENT).
WITN 'F~qSETH:
The School Board and the Department desire to provide law enforcement, counselinga
and law-related educational service programs to the schools located within rhe City of
Sebastian, as defined in F.S.S. 230.2318 and F~S~q. 233.0663.
tt is mutually agreed that a continuation of the School
Resource Officer Program for the school system of Indian River County, is in the best
interest of the student population, the ~ndian River County School board, the City of
Sebastian Police Department, and the citizens of Indian River County, Florida as
hereinafter described; and
The School Board and the Department recognize the potential outstanding benefits of
the School Resource Officer Program to the citizens of Indian River County, Florida,
and paeticldarly to the students of the school system of Indian River County, Florida;
NOW THEREFORE, in consideration of the mutual promises and covenants herein comained, the
School Board and the Department hereby agree as follows:
ARTICLE I
A School Resource Officer Program is hereby established in the school system oflndian River County,

Rights and Dmies of the Department
The Department shall provide a School Resource Officer who will equally divide his/her time
between the two elementary schools located within the city limits of Sebastian.
The Sheriff's Office will continue to be responsible for providing the DARE Program in
elementary schools.
The SRO shall be assigned to the schools on a full-time basis of eight (8) hours on those days
and during those hours that school is in a sessiom The SRO may be temporarily reassigned
to other police duties by the Department during school holidays, vacations or during a period
of any law enforcement emergency.
Duties of School Resource Officer, as defined in F.S.S. 230.2318 are:
1. The School Resource Officer shall abide by school board policies and shall consult with
and coordinate activities through the school principal or his/her designee. The SRO shall
be responsible to the law enforcement agency in all matters relating to employment.
Activities conducted by the school resource officer, which are part of the regular
instructional program of the school, shall be under the direction of the principal or his/her
designee.
2. To perform law enforcement functions within the school setting.
3. To identify and prevem, through counseling and referral, delinquent behavior, including
substance abuse.
4. To foster a better understanding of the law enforcement function.
5. To develop positive concepts of law enforcement.
6. To develop a better appreciation of citizen rights, obligations, and responsibilities.
7. To provide information about crime prevention.
8. To provide assistance and support for crime victims identified within the school setting,
including abused children.
9. To promote positive relations between students and law enforcement officers.
10. To enhance knowledge of the fundamental concepts and structure of law.

When requested by the principal or his/her designee, the SRO may attend any school-
related activity (i.e., faculty, parent meetings, special functions, etc.). The duty must be
approved by the SRO's police supervisor, if overtime is required.
The SRO shall make himself/herself available for conferences with students, parents, and
faculty members in order to assist them with problems. When in a counseling capacity, the
SRO will be subject to all confidentiality issues pursuant to Chapter 39, F.S.S. and confidentiality
rules and ethics as accepted and defined in state laws and professional standards. The duty must
be approved by the SRO's police supervisor, if overtime is required.
The SRO shall become familiar with all community agencies which offer assistance to
youths and their families, snch as, mental health clinics, drug treatment centers, etc. The
SRO shall make referrals to such agencies, when necessary, thereby acting as a resource
person to the students, faculty, and staffofthe school.
The SRO shall develop expertise in presenting various subjects to the students.
The SRO shall assist the principal or his/her designee in developing plans and strategies to
prevent and/or minimize dangerous situations which may result from student unrest and
emergency situations.
Should it become necessary to conduct formal law enforcement investigative interviews
with the students, the SRO shall adhere to rules and guidelines set forth in the Florida
State Statutes.
The SRO shall take law enforcement action as required. As soon as practicable, the SRO
shall make the principal or his/her designee aware of such action. At the principal's or
his/her designee's request, the SRO shall take appropriate law enforcement action against
intruders and unwanted guests who may appear at the school or related school functions.
The primary function of the SRO is not a campus Law Enforcement Officer. The SRO
shall give assistance to other police and/or deputy sheriffs in matters regarding his school
assignment, whenever necessary. The SRO will also act, when necessary, as a liaison
between his/her school and other government agencies (i.e., law enfomt, HRS, State's
Attorney, etc.).
The SRO will submit reports and statistical data, as necessary.
The SRO shall not act as a school disciplinarian, as disciplining students is a school
responsibility. However, if the principal or his/her designee believes an incident is a
violation of the law, the principal or designee shall contact the SRO and the SRO shall
then determine whether law enforcement action is appropriate. School Resource Officers
are not to be assigned lunchroom duties, security posts, hall monitors, truancy, or other
monitoring duties. If there is a problem area, the SRO may assist the school tmtil the
problem is solved.
The SRO will perform duties outside the school as needed (i.e., court, training,
depositions, vacation, etc.).

22. The SRO will perform his/her duties in the police department's regular duty uniform.
Civilian clothes may be worn with the approval of the SRO's police supervisor.
23. All law infractions will be reported to the SRO by all school personnel.
ARTICLE III
Rights and Duties of the School Board
The School Board shall provide to the full-time SRO the following materials and facilities which are
deemed necessary for the performance of his/her duties.
A secure and private office located as close to the principal's or designees office as possible. The
SRO will be the only one assigned to the office due to the sensitive and confidential information
maintained within. The office will be voice secure for purposes of interviews and counseling. The
office will contain the following materials and equipment.

Air conditioning.
Personal computer with school record accessibility and modem to Police Department and,
if available Sheriff's Office programs needed in performance of the SRO fimction.
Desk and chair.
4-drawer legal locking file cabinet.
6-shelf hook shelf.
2 visitor chairs for counseling and interviews.
1 work table.
Office supplies as requested.
1 phone line for computer modem.
1 phone line for private phone with answer machine/telephone for school Crime Watch
Program with long distance and WATTS line capabilities.

It is imperative that SRO's he able to communicate with school personnel on their radio
frequencies. If the SRO's school is utilizing a frequency band not compatible with the
SRO's issued radio, the school will provide the SRO with a radio.
ARTICLE IV
Financing of the School Resource Office Program
The School Board and the Department agree to share in the overall costs associated with the
School Resource Officer Program. The School Board agrees to provide for 50% of the overall
costs of the SRO Program. The amount funded will be negotiated each year prior to July 1st.
Any vehicle or equipment leased, rented, or donated to the Department for usc in the SRO
Program shall become an asset of the Department and; therefore, will be subject to the
Department's rules, regulations, and policy governing use.
C. Once the vehicle or equipment has been designated for use by the SRO, it will be used expressly by
the designated SRO or the Department.
Employment Status of School Resource Officer
School Resource Officer shall remain an employee oftbe City of Sebastian Police Deparment and shall not
be an employee of the School Board. The School Board and the Department acknowledge that the School
Resource Officer shall remain responsive to the chain of command of the City of Sebastian Police Department.
ARTICLE VI
Appointment and Training of School Resource Officers
Appointment of School Resource Officers will be made solely by the Department in accordance
with Department Office policy.
School Resource Officers will receive training in the following schools, if available:
Attorney General's Basic SRO Program.
Additional Attorney General's training to ftflfill SRO Practitioner
requirements.
ATF's G.R.E.A.T. Instructor's Course.
The Indian River County School District should nmke a reasonable effort to sccure state
funding for the annual FASRO (Florida Association of School Resource Officer's)
Conference. If such funding is not available, the expense incurred will be shared equally by
the two entities (lodging, food, registration amd travel). Expenses to the District shall not
exceed $500. annually for this conference.
ARTICLE VII
Dismissal of School Resource Officer; Replacement
In the event the principal of the school, to which the SRO is assigned, feels that the particular
SRO is not effectively perforating his or her duties and responsibilities, as outlined in F.S.S.
230.2318, the principal shall bring their concerns to the attention of the Department. If the
problem(s) can not be otherwise resolved, the SRO may be reassigned and replaced.
If the Department so desires, the principal shah meet with the SRO and his/her immediate
supervisors to mediate or resolve any problems which may exist. At such meeting,
specified members of the staffofthe school may be required to be present.
If, within a reasonable amount of time aRer commencement of such mediation, the
problem cannot be resolved or mediated, then the SRO shall be removed fi'om the program
at the school and a replacement shall be obtained.
3. In the event mediation is not sought by the Department, then the SRO shall be removed
from the program at the school and a replacement shall be obtained.
The Department may reassign a SRO based upon agency rules and regulations.
In the event of the resignation, dismissal, or reassignment ora SRO, or in the case of long-term
absences by a SRO, the Department will provide a temporary or permanent relief, as soon as
possible.

SRO Schedule
A. The SRO will be assigned from the beginning of the school year to the end of the school year.
B. The SRO will perform his/her duties at his/her assigned campus under normal conditions. Any
duty must be approved by the SRO's police supervisor, if overtime is required.
ARTICLE IX
Hold Harmless Agreement
The City of Sebastian agrees to defend, indemnify, and hold the School Board, it's employees, and agents
harmless fi'om any claim, demand, suit, loss, cost, expense, or damage which may be asserted, clahned, or
recovered against, or from the School Board, its agents or employees by reason of any damage to property or
personal injm'y including death sustained by any persons whomsoever, and which damage, injury, or death arises
out of, or is incident to, or in any way connected with, the performance of this agreement and the perfornmnce by
the SRO in his/her law enforcement duties.
ARTICLE X
Termination of Agreement
This agreement may be terminated by either party upon a sixty (60) day written notice that any other party
has failed to substantially perform in accordance with the terms and conditions of this Agreement. This
Agreement may be terminated without cause by either party upon a ninety (90) day written notice. Termination of
the Agreement may only be accomplished as provided herein. In the event this Agreement is terminated,
compensation will be made to the Depmln~nt for all services performed to the date of termination. The School
Board shall be entitled to prorated refi~nd for that period of time when SRO services are not provided because of
termination of this Agreement.
ARTICLE Xi

Good Faith
The School Board, the Department, their agents, and their employees agree to cooperate in good faith in
fulfilling the terms of this Agreement. Unforeseen difficulties or questions will be resolved by negotiation between
the Superintendent's Office and the Department.
ARTICLE XH
Modification
This document constitutes the full understanding of the parties and no terms, conditions, understandings or
agreements purporting to modify or vary the terms of this document shall be binding unless hereafter made in
writing and signed by the party to be charged.
ARTICLE XIII
Non-Assignment
This Agreement, and each and every covenant herein, shall not be capable of assignment unless the express
written consent of the School Board and the Department is obtained.
ARTICLE XIV
Merger
This Agreemem constitutes a final written expression of all the terms of this Agreement and is a complete
and exclusive statement of those terms.
IN WITNESS WHEREOF, the parties have caused this Agreemem to be signed by their duly authorized
officers.

Good Day, Mr. McCarthy,
It is with great pleasure I submit our first proposedprograming for Schuman Tennis
Complex. We plan to offer our first clinics on Saturday May 13.2000. I will
provide tentative add-om, or canceling of programs at least a month prior to the
new, or deleted program. The following will be the first programs offered:
Saturday, May 13, Adult Doubles, 9:30 to 1 I:AM, every other Saturday.
Monday, May 15, Senior Doubles, 9:00 to 10:30AM, each Monday.
Monday, May 15, Adult Beginners, USA, 6:00 to 7:PM, for six weeks.
Tuesday, May 16, USA, Adult Beginners, 9:00 to 10:30, for six weeks.
Tuesday, May 16, Hot Shot Tennis,[5 to7 yr Olds] 5:30 to 6PM each Tuesday.
Tuesday, May 16, Junior Beginners, 6:00 to 7PM each Tuesday.
Friday, May 19, Advanced Junior Beginners 5:30 to 6:30 for six weeks.
In June we will move our Junior USTA Local Excellence Training Program to
Schuman and we will conduct them in the afternoons on;
Mondays 4:30 to 5:30, LET white,[pre high school aged]
Wednesdays 1:30 to 3:00 LET blue,[high school age]
Wednesdays 3:30 to 5:00 LET white
Thursdays 3:00 to 4:30 LET blue
In July we will most likely moved these programs to morning hours. Naturaly, we
will move, or add programs as the publick demands grow.
By the tenth day of each month the John Danise School of Tennis will submit a
check, [for two percent of all USTA programs and three percent of all other
programs,or lessons] along with the proper accounting of all programs and private,
or group lessons given at Schuman Tennis Complex.
