Recently, a discussion with SJRWMD officials transpired in my office relative to various stormwater related issues, namely the master planning exercise, status regarding adoption of a stormwater utility, as well as permitting processes to construct the aforementioned park. This presentation will be most appropriate at this time, as it will serve as an opportunity to outline a substantive project to be implemented resulting from the establishment of a stormwater utility. In addition, commentary will be provided to further clarify management responsibilities to be absorbed by the City of Sebastian after the park and respective facilities have been constructed. Reinstatement of Sebastian Well Monitoring Pro.qram Per interest expressed (and direction for that matter) during your July 25th meeting, City Engineer Ralph Brescia has initiated arrangements to reinstate a well monitoring program in the City of Sebastian. Reinstatement is appropriate terminology in that such a program apparently existed several years ago, resulting in the presence of monitoring wells at the Filbert Street Property, as well as at Sebastian Municipal Airport. According to Ralph, a formal request to SJRWMD to reinstall infrastructure to administer a well monitoring program may be imminent in the near future (of which formal authorization by the Sebastian City Council may be required). I will keep all of you abreast accordingly, as respective recommendations will also be forwarded. City Council Information Letter August 10, 2001 Page 2 Cable System Acquisition by AT&T Broadband It's official! The Sebastian Area cable system asset exchange between Charter Communications and AT&T Broadband has been fully accomplished. As referenced in the attached letter from Director of Local Government Affairs Michael Tanck, formal efforts are underway to enhance operations and service provision in the coming months, beginning with numerous marketing and educational campaigns in our community and vicinity. In his words, the company hopes to begin" a new, mutually beneficial partnership with us and our residents..." Personally as your city manager and a citizen of this community, I welcome AT&T Broadband to the challenge of making this happen. Meanwhile, concerned individuals may feel free to contact Mr. Bob Stevens by calling 567-3473. Mr. Stevens is the representative for this area assigned to facilitate customer complaints. Accordingly, arrangements will be made to keep you all informed regarding respective changes (i.e. other area personnel, offices, etc. - obviously typical transitions after such business mergers/acquisitions have been completed). Maintenance Pro.qram for Schumann Drive Medians Please find the attached memorandum from Director of Public Works Terry Hill informing the assignment of Park and Recreation Division staff member Robert Thompson to Schumann Drive Median and Schumann Park maintenance responsibilities. This program (as having been previously communicated publicly) will be quite similar to the maintenance effort established for United States Highway One (US 1) medians. This arrangement will begin next week, as necessary tree/plant and shrubbery replacements, watering, trimming and mulch application will be facilitated accordingly. As such, no specific budgeted line item is outlined in the Fiscal Year 2001/2002 Proposed Budget specifically for Schumann Drive. However, annual maintenance costs for this program have been incorporated into the Parks and Recreation Division maintenance budget, which is anticipated to remain constant. Clarification Re.qardin.q Connections for New Restroom-~ During recent City Council meetings, questions were raised relative to plumbing connections for the new restrooms currently under construction. City Council Information Letter August 10, 2001 Page 3 Since returning to the office, I had an opportunity to personally ascertain respective arrangements. The Yacht Club restroom will likely incorporate a capacity expansion to the existing drain field (being that adequate space appears available at the existing drain field site to accommodate more capacity for additional restrooms). Both Hardee Park and the Barber Street Sports Complex restrooms have been connected to an existing Indian River County Department of Utilities area water supply. Other arrangements are of course underway to finalize construction of all three restrooms in the very near future, although much to my disappointment, not exactly consistent with time frames as communicated by CAMCO President Paul Palestrini during your July 25th meeting. Please be advised that much thought is being established by city administration so as to prevent such delays on future projects. Feel free to contact me individually should any of you require additional clarification. Meanwhile, I anticipate notifying all of you soon enough relative to grand opening dates for all three facilities. Clarification of Temporary Recreational Vehicle Use In effort to address Councilman Barczyk's concern raised Wednesday evening relative to individuals residing in recreational vehicles during new home construction, I have directed both Building Official George Bonacci and Director of Growth Management Tracy Hass to compile the attached memorandum in effort to clarify respective use arrangements. Section 54-2- 7.13 (d) of the Sebastian Land Development Code allows trailers to be used temporarily as a dwelling in connection with construction in all zoning districts after a building permit for permanent new home construction has been issued. As such, an individual may be permitted to position a temporary trailer on a respective construction site. Accordingly, all setback requirements must be complied, as well as necessary utilities must be provided to any temporary trailer under this arrangement. Any of you may feel free to contact me should further clarification regarding this matter becomes necessary. Otherwise, no applicable violations are apparent at this time. Update - Sebastian Government Channel Please be advised that necessary equipment to initiate videotaping services via partnership with Sebastian River High School (SRHS) is anticipated for delivery during the week of August 20th. AS such, connections and support infrastructure is to be also established immediately after delivery, to result in City Council Information Letter August 10, 2001 Page 4 an anticipated start date of circa September 12th. Mr. Reginald Reynolds, SRHS Television Production Coordinator is therefore being contacted so as to initiate assignments to students involved in this project. In addition, arrangements are underway at City Hall to establish round the clock programming (if you will) to coincide with the aforementioned time frame (various City of Sebastian advertisements, notices, updates, etc., as well as more periodic replays of previously recorded City Council meetings and workshops). Update - Appointment of Director of Human Resources After delivery of your last Information Letter (July 20th), I had an opportunity to mention to some of you individually that Mr. Robert Miles would in fact, not be joining the City of Sebastian to serve as Director of Human Resources due to his acceptance of a counteroffer from Public Sector Personnel Consultants. I am please to report at this time however that the City Manager's Office is back on track with a recruitment process to ultimately appoint another highly qualified human resources professional. Since returning to the office earlier this week, two new interviews transpired with finalist selected to compete for an offer. As such, my confidence in a selection of a good solid individual has once again been restored. I will therefore share with you my decision for selection, as I anticipate making another offer of employment later this month. In reference to the above subject matter, it has been determined that provisions within the land development regulations permit individuals to live within recreational vehicles during home construction. Per section 54-2-7.13 (attached), you will find that trailers used temporarily used as a dwelling in connection with construction may be located temporarily in all zoning districts after a building permit has been issued and during periods of construction. The trailer must be removed after the issuance of a certificate of occupancy is issued. Typically, a homeowner/builder will place their request in writing with the building department, and after the building permit for home construction has been issued, the requester is permitted to place a temporary trailer on the construction site. However, all setbacks must be complied with and all utilities must be provided to the temporary trailer. In no other such event does the city otherwise permit a recreational vehicle to be used for residential, office or commercial purposes. Hopefully this has provided clarification of the temporary trailer issue, and if you need any further information, please let us know. § 54-2-7.12 SEBASTIAN LAND DEVELOPMENT CODE regulation adopted pursuant to the provisions of chapter 163, Florida Statutes, pertaining to airport land use compatibility, may apply to the board of adjustment for a variance from the zoning regulations in question. At the time of filing, the applicant shall forward a copy of his application for variance by certified mail, return receipt requested, to the Florida Department of Transportation (the "department"), Aviation Office, M.S. 46, 605 Suwannee Street, Tallahassee, Florida 32399-450. The department shall have 45 days from receipt of the application, its right to comment is waived. The board of adjustment may proceed with its consideration of the application only upon the receipt of the department's 'comments or waiver of that right as demonstrated by the filing of a copy of the return receipt with the board showing that the 45 days have elapsed. Addition- ally, no application for a variance may be considered unless the applicant shows evidence that the requirement for notice of construction or alteration under Title 14, Code of Federal Regulations, Part 77, has been complied with. (2) A variance may only be allowed where a literal application or enforcement of the regulations provided in this section would result in practical difficulty or unnecessary hardship and where the relief granted would not be contrary to the public interest but would do substantial justice and be in accordance with the spirit of the regulations provided herein. Provided, however, a variance may be allowed subject to any reasonable conditions that the board of adjustment may deem necessary to effectuate the purposes of this section. (3) In granting a variance under this section, the board of adjustment shall, as a specific condition, require the owner to mark and light the structure or growth to indicate to aircraft pilots the presence of an obstruction. Such marking and lighting shall conform to the specific standards established by chapter 14-60, Rules of the Department of Transportation and Federal Aviation Administration Advisory Circular 70-7460-1H, as amended. Recreational vehicles as described herein may be parked, stored or placed on any improved lot in any residential district, provided that: (1) T~e recreational vehicle is owned, rented or leased by the person residing on the same ~fmproved lot on which the recreational vehicle is located. (3) The recreational vehicle is not used for sleeping, housekeeping, or living quarters while parked on any improved lot. As mentioned publicly during a recent City Council meeting, coordination is underway with Florida, Power and Light (FPL) to install necessary infrastructure to facilitate new lighting. We were finally able to schedule a site meeting to include FPL representatives to initiate respective tasks, including new conduit installation. As such, recommendations are anticipated in the coming week, s to authorize a respective contract. ~ Area im rovement Pro ram The Fiscal Year 2001-2002 Proposed Budget and Capital improvement Program recommends funding to finance initiation of the Louisiana Avenue Area improvement Program, to ultimately result in substantive improvements such as drainage enhancements, lighting and possible sidewalk installation. Earlier this year, authorization was granted to submit a funding proposal to the Florida Small Cities community Development Block Grant (CDBG) program, in effort to secure outside funding to ultimately implement this effort. Statewide CDBG applications were recently reviewed and evaluated for eligibility. Ironically, a penalty was placed against the City
