Proposal Revision - Boys and Girls Club
Pursuant to direction provided during your meeting last week, please be
advised that I had an opportunity to meet with the Board of Directors of the
Boys and Girls Club of Indian River County, Inc. to discuss the prospect of
leasing a portion of the 9.34 acre property behind the municipal complex
authorized for acquisition (closing anticipated to transpire during the week of
October 1st). lam pleased to report that they "enthusiastically support" this
proposal, whereby arrangements would also include construction of
additional public outdoor recreational facilities and amenities as necessary
to accommodate a growing community (per comprehensive plan
requirements, capital improvement programming, etc.). As such,
arrangements are underway to revise a proposed lease agreement between
the City of Sebastian and the Boys and Girls Club of Indian River County,
Inc., anticipated to be presented for your consideration during your October
24th meeting. In addition, a conceptual site plan will soon be showcased, as
the agreement will specifically outline a legal description for leased portion
of the property.
Skydive Sebastian
You all may have received by now a letter from the Law Firm of
Buckingham, Doolittle and Burroughs on behalf of Skydive Sebastian
regarding their position relative to the Sebastian Municipal Airport Master
Plan and possible alternatives for relocation of the designated landing area
(drop zone). The intent of my response letter to one of the company's
primary shareholders, Mr. James lannaccone was not only to clarify the City
of Sebastian's stance, but to also once again communicate our willingness
and direction to solicit business proposals and alternatives that are in the
best interest of both parties. This effort obviously must be facilitated under
amicable conditions, as threats and seeking attorneys against the City is

counterproductive in this regard. As you reference my response letter, you
will be able to ascertain specific efforts to work with Skydive Sebastian
accordingly. Hopefully, we can still work together to resolve this matter as
soon as possible, via the proper aforementioned conditions. I will keep all of
you posted accordingly, as we are planning to recommend adoption of the
revised/updated Sebastian Municipal Airport Master Plan towards to close of
2001.
Proposed Name Chan.qes for County Road 512
I am pleased to report that the Office of the City Manager has received a
tremendous response from residents, suggesting proposed name changes
for County Road 512/Fellsmere Road. We received 165 responses since
the delivery of the summer edition of the Sebastian Pelican Brief last month.
An original plan was to schedule an agenda item to this effect for your
September 26th meeting. However, due to the anticipated lengthiness of
next week's session, I feel that it will be more productive to address this
matter sometime in October. Executive Assistant Jean Tarbell compiled the
attached spreadsheet that outlines the tentative tally. I personally
appreciate the fact thai many citizens are interested in this proposal. Please
prepare yourselves accordingly.
Proposal to Florida Recreation Development Assistance
Program
You will notice in your September 26th City Council Meeting Agenda a
recommendation to authorize submittal of a Florida Recreation
Development Assistance Program (FRDAP) grant proposal for the current
application cycle. During your last meeting, you authorized execution of a
recently awarded FRDAP grant agreement to help finance acquisition of
additional riverfront property. The purpose of the new proposal will be to
seek financial assistance for additional/actual improvements. Although a
final site plan has yet been authorized, we still have the ability to submit a
respective grant application, as it is our hope that up to $200,000 will be
awarded sometime next summer.

Keep Indian River County Beautiful Collection Campai,qn
Please be advised that the City of Sebastian Department of Public Works
has been directed to work with Keep Indian River Beautiful Inc. to implement
a telephone book collection campaign in an effort to recycle a maximum
number of unused books. Massive collections of recyclable books will
alleviate unnecessary disposal at the Indian River County Landfill. Our
involvement will simply be to position a dumpster in a visible section of the
community (likely adjacent to Riverview Park) between October 1st and
December 1st. No problems are anticipated.
Out of the Office
Just a reminder I will be out of the office beginning this morning to represent
the City of Sebastian at the 87th International City Management Association
(ICMA) Annual Conference. I will return to City Hall Wednesday morning.
This particular session of ICMA is special, as opportunities wilt be available
to address the issues of terrorism and security, as applicable to local
governments. In addition, I was recently appointed to serve a three-year
term on ICMA's Government Affairs and Policy Commission, whereby my
inaugural meeting will take place all day Sunday. Executive Assistant Jean
Tarbell will maintain my itinerary and contact information, should for any dire
reason its becomes necessary to reach me. Wish me luck!

Dear Mr, lannaccone:
After receiving the letter as compiled by Mr. Solomon Zoberman representing the Law
Firm of Buckingham, Doolittle and Burroughs, LLP yesterday, I felt that it became
appropriate to write this correspondence to help clarify the City of Sebastian's position
relative to its relationship with Skydive Sebastian of South Florida, Inc., as welt as our
community's effort's to enhance Sebastian Municipal Airport.
The City of Sebastian pddes itself on implementing projects and programs that will
ultimately enhance facilities and public properties to improve the quality of life for
residents and corporate citizens. Accordingly, the necessary compilation of a newly
proposed Sebastian Municipal Airport Master Plan supports this endeavor with respect
to airport operations and management. To that end, city administration is responsible for
making recommendations that will enhance the airpod in terms of infrastructure,
economic development, and most importantly, community compatibility. Interestingly
however, this position is not at all a recent proposition. For instance, the 1993 Sebastian
Municipal Airport Master Plan and Community Compatibility Study incorporated the
reactivation of Runway 9-27. This necessary endeavor involves numerous changes to
the airport's infrastructure, including the redesignation of the airport's skydiving landing
area. The current revisions to the Master Plan are consistent with both the former Master
Plan and Community Compatibility Study. Accordingly, the Lease Agreement between
the City of Sebastian and Skydive Sebastian was authorized to include provisions to this
effect.
Quite honestly, I was surprised as to the stance taken by your organization, being that all
the necessary logistics have been publicly outlined for many years. However, city
officials were always amenable to working with all tenants of Sebastian Municipal Airport
to communicate respective goals and objectives, as well as ascertain possible
suggestions and/or proposed alternatives from concerned parties. Our specific efforts to
work with your organization included our meeting that took place Thursday March 15,
2001 with you, Airport Manager Jason Milewski and Skydive Sebastian General
Manager Vic Modera to discuss related issues. This meeting concluded with direction
for Skydive Sebastian to provide us with suggestions in an effort to outline alternatives
for consideration. As such, both Mr. Milewski and I felt that this meeting was productive,
as we anticipated a more amicable partnership. What followed however was a series of

false accusations made to the press and throughout the community, lack of any further
communication with the Office of the City Manager, as well as other evidence of
adversarial behavior in general, including attempts to lobby City Council members
directly, solicitation of Federal Aviation Administration intervention, allegations of unjust
demands for increased rents, and direct threats to "stop this master plan". Aisc, a
meeting that was scheduled to take place Wednesday August 8, 2001 with me to include
both you and Mr. Moriera never transpired because neither of you showed up. In
essence and once again, city administration was always willing, able and available to
discuss applicable matters with officials from Skydive Sebastian of South Florida, Inc.
To date however, for reasons unknown and beyond our realm, no recommendations
have yet been offered.
In addition to the posture chosen by Skydive Sebastian, the lack of communication has
apparently led to a misinterpretation of many facts. Specifically, issues such as the
location of the proposed T-hangar development and unjust increases in rent need to be
clarified. As was discussed and presented to City Council dudng their July 25, 2001
regular meeting, the proposed T-hangar development does not preclude any possibility
of relocating Skydive Sebastian's facilities, as opportunities still exist, should there be
any indication that there is interest to do so. Additionally, the City of Sebastian never
arbitrarily demanded an increase in rent. Back rent on the leasehold was past due to the
City because of Skydive Sebastian's failure to pay on time per terms of the second lease
agreement. This was a condition of the transfer of the lease as directed by City Council
and completely unrelated to the Master Plan and/or the City's redesignation of its
skydiving landing area. These and many other misunderstandings can easily be
elucidated by maintaining open and constant communication.
In summary, the City of Sebastian has and still remains open and receptive to
substantive suggestions and recommendations from Skydive Sebastian in effort to
facilitate altematives to best address both sound business principles and the focus of
policies contained in the Sebastian Municipal Airport Master Plan. However, in order to
ensure fruitful dialogue and direction in this regard, it is highly imperative that the
speculative and adversarial position of Skydive Sebastian of South Florida, Inc. come to
a close. Therefore, you may feel free to contact my office by calling (561) 388-8203
