Status of Boat Dock Facilit Construction Permittin
City Engineer Dave Fisher and Kimley-Horn Staff Engineer Michael Kiefer
are currently negotiating with representatives of the United States Army
Corp of Engineers and the Florida Department of Environmental Protection
relative to the status of the City of Sebastian's modified permits to construct
both boat dock and fishing pier facilities per direction offered during your
June 26, 2002 workshop. I am pleased to report that we expect finalization
meetings with both agencies during the next couple weeks. As such,
arrangements are currently being made to initiate bid documents and to
identify qualified contractors to offer respective proposals to the City for
review and consideration. This process will also involve soliciting proposals
to develop all other parks and recreation facilities, including projects
referenced in the 2002/2003 Parks Development Schedule, as well as
construction of little league ball fields at both Sebastian Elementary School
and Pelican Island Elementary School. I therefore hope to offer expenditure
and contract authorization recommendations for all of these facilities in the
coming weeks.

Yesterday afternoon, staff from the Departments of Engineering, Public
Works and Growth Management met with representatives from Indian River
County Division of Environmental Planning relative to the importance of
initiating enhancement projects to benefit conservation property in the
vicinity of the Sebastian Municipal Complex area. This arrangement, as you
may recall, was most recently discussed during your July 24, 2002 regular
meeting, resulting in the attached letter executed by Mayor Walter Barnes
requesting the status of said improvements. As previously discussed,

various enhancements are required per a joint grant agreement with the
State of Florida Communities Trust (FCT) between the City of Sebastian
and the Indian River County Board of County Commissioners executed in
cima 1995. At this time, the Indian River County Department of Community
Development's position is to work with the City of Sebastian to collaborate
potential grant seeking opportunities to implement applicable improvements
to the property. As such, a draft development plan will soon be forwarded to
City Hall for our review and approval. I will point out however that the
County is obliged to provide outdoor recreational facilities including nature
trails, picnic areas, a gazebo, an information kiosk and limited parking at the
conservation site, to also include a respective continuous maintenance
program - all of this even without the collaborative efforts discussed during
yesterday's session, pursuant to requirements issued by FCT as a condition
of acceptance of funding to acquire and establish conservation areas in our
community. City officials will therefore continue to clarify and confirm this
position. When the draft plan does become available, I will be more than
happy to share it with you.
Countywide Telecasts of Sebastian City Council MeetinR,~;
Earlier this week, I received a telephone call from Indian River County
General Services Administrator Thomas Frame relative to the status of the
City of Sebastian's request to have regular prerecorded City Council
meetings periodically broadcasted countywide. At this time, the County's
position is to not allow such telecasts due to the recent position having been
taken by the City of Vero Beach. However, as the recently approved merger
between AT&T Broadband and Comcast currently anticipates offering
additional technological upgrades throughout Indian River County, county
administrators feel they have the ability to negotiate and establish a
government channel for their exclusive use, to begin operations in the
coming months. I have therefore been told that should this arrangement
successfully come to fruition, the City of Sebastian's request will be granted.
I have a meeting scheduled to take place early next week with newly
appointed Comcast Corporation executives to initiate discussions relative to
such plans. At that time, I will have the opportunity to further ascertain the
possibility of this project. I will therefore provide an overall update relative to
applicable enhancements in Sebastian in next weeks report, as well as
schedule a presentation during an upcoming regularly City Council meeting.

As the School Board of Indian River County wishes to host meetings here in
Sebastian at least once a year, please be advised (as referenced in the
attached letter from School Board Chairman Steven Mohler) that
arrangements have been made to offer Sebastian City Council chambers for
their meeting scheduled to take place Tuesday January 28, 2003 at 7:00
p.m. This arrangement is simply consistent with the School District of Indian
River County's effort to periodically afford Sebastian citizens the opportunity
to more conveniently voice concerns relative to various educational policy
matters throughout the community. Please feel free to inform interested
individuals if the opportunity to do so arises.

Dear Honorable Stanbridge:
During our regular meeting last Wednesday July 24~, discussion was initiated relative to
the status of improvements required to be made to the conservation property acquired
via partnership established with Florida Communities Trust in October 1995. As
referenced in the attached lnterlocal Agreement between Indian River County and the
City of Sebastian, specific enhancements include outdoor recreational facilities
comprising nature trails, picnic areas, a gazebo, an information kiosk and limited parking
on the project site, as well as continuous maintenance of the property and facilities
respectively. To date, our staff has not been advised as to the status of progress
aocordingly. As such, I wish to request your assistance in ascertaining a possible
timeframe to accomplish these activities.
As always, our staff is available to work with indian River County to productively
implement projects and program that will offer mutual benefits to the COmmunity. Should
you and/or any other representative of Indian River County require assistance from the

_~i~._ , 1995 by and between INDIAN RIVER COUETY, FLORIDA. a
political subdivision of the State of Florida, by and through ~ts
Board of County Commissioners, hereinafter referred to as COUNTY
and the CITY OF SEBASTIAN, FLORIDA, a municipal corporation of the
State of Florida, hereinafter referred to as CITY, for the purpose
of providing an agreement for the division of responsibility for
the Sebastian Highlands Scrub Project.
WI TNE S SETH :
WHEREAS, the coUNTy, the CITY and the Florida Community Trust
(FCT) have entered into a tri-partite agreement for the acquisition
of land for the Sebastian Highlands Scrub Project (FCT Project No.
94-032-P4A); and
WHEREAS, FCT requires the adoption of an interlocal agreement
between the local governments which delineates the areas of
responsibility for each entity,
NOW, THEREFORE, in consideration of the mutual terms,
conditions, promises, Covenants and premises hereinafter set forth
herein, the COUNTY and the CITY agree as follows:
The COUNTY shall provide the following:
i. Outdoor recreational facilities including nature trails,
picnic areas, a gazebo, an information kiosk and limited parking on
the project site, and general on-going maintenance of such
facilities.
2. A Vegetative survey to ensure the protection, restoration
and preservation of the natural resources on the project site.
3. Periodic surveys of listed species, and develop
informational signs relating to the protection of listed animal
species.
4. Implementation of a site Habitat Conservation Plan.
5. Removal of nvaslve exotic vegetation.

6. Mechanical Cleaning or prescribed burning regime
implemented to maintain natural fire-dependent Vegetative
communities.

The County shall assume and discharge
all the fiscal and
management responsibilities imposed on FCT Recipients Under the
Conceptual Approval Agreement with FCT for FCT Project No. 94-032-
P4A.
The County will also perform duties as
follows:
Provide FCT an acql/isition plan·
Furnish required notices, obtain appraisals,
conduct negotiations with property Owners.
and
(3) Acquired title to the project property in the name
of Indian River County.
Provide the local matching funds for the FCT
project.
(5) Develop and obtain approval of the project plan.
(6) Implement the management and maintenance of the
project property.
The CITY shall provide police protection to the area
consistent with its policies.
By execution of this Agreement, neither the COUNTY nor the
CITY will be deemed to have waived any rights or remedies they may
have available under the laws of the State of Florida.
This Agreement shall be executed in duplicate and each fully
executed contract shall be deemed an original instrument.
A copy of this Agreement and all sUbsequent amendments hereto
shall be recorded in the Public Records of Indian River County,
Florida, upon its execution by all parties hereto.
This Agreement may be amended only in writing with approval by
all parties executing this Agreement.
IN WITNEss WHEREOF, the parties hereto have caused this
Interlocal Agreement tO be executed by their duly authorized
officials on the day and ysar first above %~ritten.
