As previously reported, staff is working with Holland-Sheltair to negotiate a
long term lease and construction agreement for new t-hangar development
at Sebastian Municipal Airport. As referenced in the attached memorandum
as compiled and delivered per my direction by Airport Manager Jason
Milewski, final terms for a respective contract are being finalized. As such, it
is currently anticipated that recommendations for your consideration will be
offered during your July 10th meeting, to include a possible presentation by
representatives of Holland-Sheltair to discuss the partnership further, as well
as entertain specific questions and/or concerns any of you may have.
F ronmental Assessment
Please be advised that initial assessments have been performed relative to
potential hazardous environmental conditions along Sebastian's riverfront.
Currently, no impediments are immediately imminent. However, Foster
Wheeler Environmental Corporation ProjectManager William Fleck's initial
review of potential site conditions included evidence of underground storage
tanks located in the far eastern section of the former CAVCORP property
(now city owned property primarily employed for boat and automobile
parking). Interestingly, environmental assessment reports compiled in circa
1991 suggest that soil excavation and tank removal efforts were performed
in accordance with federally mandated standards, and therefore no
concerns expressed since that time. As such, Foster and Wheeler will
forward a proposal to the State of Florida Department of Environmental
Protection to seek authorization for further investigation, including
ascertainment of other problem areas in the vicinity. Mr. Fleck will forward a
copy of the aforementioned proposal to my office once compiled and
delivered to Tallahassee. I will therefore share the report with each of you

when it becomes available. Soon after, a respective public presentation will
be scheduled during an upcoming City Council meeting.
As some of you may have read in recently published area newspaper
articles, the Sebastian Police Department's K-9 fundraising campaign has
become far more successful to date than originally anticipated. In fact, a
substantive award totaling $1,200 from the Wal-Mart Neighborhood Heroes
Grant Program was presented to Chief Davis a few days ago to benefit the
program. Due to the tremendous success of this effort, the establishment of
the K-9 unit will now be incorporated among the various police oriented
goals and objectives via the Fiscal Year 2002/2003 Proposed Budget.
Appropriately, specific logistics to outline administration of the program will
be publicly communicated during the August 21st proposed budget
workshop, to include explanations regarding training activities, equipment
use and general deployment response.
Animal Control Home Q~reement
Early last week, Chief Davis attended a meeting with representatives from
both the Indian River County Animal Control Division and Humane Society
to discuss additional ideas to help alleviate existing problems and concerns
associated with vicious dog presence in our community. It was decided that
the attached notice would be delivered to owners of pets that were either
involved in bites/attacks and/or demonstrate aggressive behavior. This
arrangement is an effort to direct compliance of potential quarantine
guidelines for animals subject of a bite and/or other aggressive behavior
investigation. This requirement also dictates additional guidelines to be
followed, including updated rabies vaccination, storage in home kennel
facility as well other restraining requirements. Essentially, this notice places
respective animal owners on notice and serves as an additional measure to
be taken prior to a pet being formally classified as a dangerous animal.
Hopefully, this effort will prove to be an effective step to help prevent future
attacks.

Bud et for Filbert Park Develo ment
As previously reported and directed, the city owned Filbert Street parcel is
programmed to become one of the first new passive oriented neighborhood
parks in the community, to possibly include of portion of land designated for
stormwater retention, as being deemed possibly beneficial by the
community's stormwater consultants Camp, Dresser and McKee. As a
result of this possibility, the City of Sebastian will not be able to participate in
the State of Florida Land and Water Conservation Fund (LWCF) to help
finance improvements to the property (interestingly, it turns out that LWCF
will provide funding only for small scale community conservation initiatives
and not for park land use). Fortunately however, an allocation from the
current year's Discretionary Sales Tax Fund totaling $150,000 is available to
initiate construction of Filbert Park. As such, the recommendation to begin
this project in Fall 2002 will remain.

Holland-Sheltair Update
I am pleased to report that there has been a great deal of progress in negotiations with Holland-
Sheltair, Inc. for a possible long-term lease of Airport property. Though we are still finalizing the
business terms of the agreement, they have completed theft' due diligence on the site and are very
interested in formalizing a partnership with the City.
This proposed arrangement could lead to a very significant increase in revenues for the Airport
Enterprise Fund. Additionally, this may set a favorable precedent for future public-private sector
partnerships, including further arrangements with Holland-Sheltair, Inc.
With a great deal of assistance from the City Attorney, Airport staff has worked meticulously to
ensure each segment of the proposed lease agreement was revised and/or rewritten to ensure a
clean and concise document which best suits the interests of each party. Provided there are no
unanticipated obstacles, we anticipate finalizing the terms of our partnership soon and expect to
present you with a detailed agreement in approximately two to three weeks.
Please let me know if you have any questions or concerns regarding these issues. As always, I'll
keep you informed of any further progress.

We received a $1,200 Grant this morning from Greg McCarty toward the purchase of a K-9. The funds are
coming in faster than I anticipated and being received from citizens outside of Sebastian. We will not be able to start
the program until we have trained at least two new police officers (probably October).

During the last meeting of the Animal Control Task Force there were
suggestions and proposed changes to procedures and the Animal
Control Ordinance. At that time it was suggested another meeting be
scheduled to discuss additional issues as well as review the
proposed changes.

I understand that this animal is the subject of a bite investigation. As the
owner or keeper I am fully responsible for maintaining the following
quarantine guidelines as required by Florida State Statute. I also
understand that failure to follow the guidelines will result in seizure of

It is the responsibility of the Indian River County Animal Control Division to take all proper
precautions to prevent animals fi.om injuring persons, animals, or property; and m enforce animal
care and control laws of the State of Florida and Indian River County.
Your pet has recently completed the mandatory quarantine period for biting a person Although
this may not seem like a serious incident, your animal appears to be demonstrating signs of
aggressive behavior which may cause it to be classified dangerous in the future should such

your dog as dangerous, you should take steps now to correct situations that may contribute to its
misbehavior. It is highly recommended that the animal be neutered/spayed if this has not already
been done.
In order to prevent any more problems or incidents you must adhere to the following
requirements within twenty-four (24) hours of your receipt of this letter:
When Outside of your home," ' "must be confined by means of secure, adequate
fencing or a secure heavy duty chain, the length of which must be within the perimeter of
your property. There must be shelter and water available at all times.
When offyour property the dog shall be walked by means cfa heavy duty leash, no more
than 6' in length, by a competent adult capable of handling the dog.

SOME POINTS OF AGGKESSIVE BEHAVIOR IN DOGS
A review of the current literature suggests that some pet owners may be so involved with their
pets that they are not forceful enough to assume a dominant or leadership role over their pet.
Additional problems can arise when owners have a ve__e low level ofinvolyement with their dogs,
especially when they ai'~ le~ continuously isolated from social contact with the family.
Dogs think of owners and the owner's family as members of their pack. h is
natural~forthe issue of who dominates or comrols the pack to come up.
Obedience Trainin - is ye irn~,ortant to ensure that owners will_be the dominant
~s in control However, obedience training does no good if the
dog is allowed to roam free.
Unruly. dogs that start controlling their owners at an early age, as a young puppy
or young adult, may create serious problems when they become adults. Early
neutering of these dogs may control this unruliness. Also, it is never mo late for
obedience ~aining.
Aggression toward the owner, the family or friends should never be tolerated from
the family pett' 'Cots and dogs belonging to neighbors are not fair game.
Aggressive behavior toward a baby, or child in the family is probably due to
competition for affection The dog should be given affection only when the baby
or child is present. The dog quickly understands that it will get affection only
when the baby or child is present and hopefully change his aggressive behavior.
Don't let the dog sleep in the parents' bedroom. This sends a signal to the dog
that it may rank above the children in social stares. Let only the children give the
,rears and tidbits.
Aggressively defending territory is natural, but praising for guarding territory only
makes it worse. The dog should be conditioned to like people when they come to
visit. This.may be accomplished by rewarding it with affection only when visitors
arrive.
Dogs Whogrov¢l or snip at their 0wfi~rs may do this to have thek way; owners
whoare-bitten because of~his are often the ones who have spoiled or pampered
their-~'~l:/ite they were puppies or young adults. Early obedience training can
prevent tlfi~along with maintaining control of the animal.
BOTTOM LINE: Obedience Training is Money Well Spent to teach owners the
responsibility of controlling their pets and the methods on how this is
accomplished. Pets must no be allowed to roam and be a menace to the PUBLIC
HEALTH AND SAFETY of people and their pets in the neighborhood.
