June 14, 2002 Use Tax Recovery Efforts You will recall a previous authorization to contract with Municipal Tax Consulting for the recovery of use taxes from the State of Florida for sales taxes paid by contractors on government projects performed by the City of Sebastian. Via this arrangement, fees for successful recovery efforts would have totaled 1/3 payment to Municipal Tax Consulting. Unfortunately however, as referenced in the attached memorandum by Director of Finance Mark Mason, a recent change in state statues disallows such recovery efforts. As such, the aforementioned contract has essentially become null and void. Updates to the Florida De artment of Law Enforcement As part of the State of Florida's program to enhance security measures via directives from the federal level, please be advised that the Florida Department of Law Enforcement has recently contacted staff here at Sebastian City Hall to collect information for various large scale events scheduled in the coming months. General direction in this regard is to provide specific contact and logistical information for each event, including schedule of activities. As such, the attached facsimile document was delivered to the FDLE office in Fort Pierce earlier this week, to encourage and direct a higher level of security. As you can imagine, security efforts for the upcoming Pelican Island 100th Anniversary Celebration will be extremely augmented due to anticipated participation from high level officials from both state and federal officials. I will of course keep you abreast as to the progress of respective efforts on a continuous basis. City Councillnformation LeEer June 14,2002 Page 2 Trolle Serw'ce for S ecial Events In response to the increasing attendance of outdoor special events sponsored and hosted by the City of Sebastian, arrangements were recently made to offer trolley transport services beginning with this year's Independence Day Celebration. As such, individuals who park at significant distances from venues can be shuttled via routes to be established for proper accommodations. Essentially, the City will rent a trolley, to include a driver, from the Indian River County on Aging. Arrangements are also being made for offsite designated parking at the former Beall's Department Store just southeast of the Sebastian Corporate Limits on United States Highway One. Operations will be conducted between the hours of 6:30 a.m. to 4:30 p.m., with the first transport anticipated to be patrons of the VIP Breakfast beginning during the 7:00 a.m. hour. The trolley service will also become available during the Pelican Island 100th Anniversary Celebration, with transport arrangements anticipated to be made available Saturday March 15, 2003, circa 10:00 a.m. until 8:00 p.m. Hopefully, this effort will be very much appreciated by patrons of large-scale city-sponsored outdoor events. City Participation in Independence Da Parade In response to Mayor Barnes' inquiry Wednesday evening relative to Independence Day Parade participation, please be advised that the City of Sebastian's contribution to this year's event will include a police honor guard presence as well as displays from Sebastian Municipal Golf Course. Staff is working diligently to assemble classic automobile(s) to cater municipal dignitaries. However, should any of you wish to make individual arrangements for vehicles and/or floats, Lion's Club Chair Jerry Osmundson is available to assist your needs accordingly. Any of you may therefore feel free to contact Mr. Osmundson by calling 589-1447 to make arrangements. Mason, CPA, Director of Finance0~i~---'-'~ June 14, 2002 Recovery of Use Taxes On September 26, 2001, the City Council authorized a contract with Municipal Tax Consulting for the recovery of use taxes from the State of Florida for sales tax paid by contractors on government projects performed for the City of Sebastian. The contract provided for payment to Municipal Tax Consulting for 1/3ra of any recovery as a fee. Municipal Tax Consulting performed there analysis on the City's capital projects and prepared requests to be submitted to the State of Florida for recovery. The requests totaled approximately $200. In February of 2002, Florida statutes changed regarding these recovehes. They are no longer allowed. The requests made by Municipal Tax Consulting were not made in time and the State denied reimbursement. Therefore, there will be no recovery of use taxes paid by the City to any contractor for capital projects.
