Development Proposal from Lambert Realty
Earlier this week, I met with Mr. Dick Lambert and a potential buyer of his
property located in Sebastian Boulevard triangle slated for a building
moratorium as presented by City Attorney Rich Stringer during your last
meeting. I am pleased to report that Mr. Lambed is pursuing a sale to an
investor who is interested in constructing a farmers market retail
establishment, to conform with the County Road 512 Overlay District
requirements for retail establishments, as well as conformity with standards
to be proposed for redevelopment within the triangle. As such, a separate
site planning process to this effect will be initiated in the coming weeks for
review and consideration. From a city-planning standpoint, such a proposal
works much better than the development of convenient stores, car washes
and car maintenance facilities. This position was thoroughly clarified to Mr.
Lambert, as he has positioned himself to work with the City of Sebastian
amicably. Copies of the respective site plan (as well as a written scope
outlining dynamics of a farmers market) will be provided to you individually
immediately after it is delivered to our offices.
Electrical Infrastructure Installation Reconfi,quration
As referenced in the attached memorandum as compiled and delivered by
City Engineer David Fisher, a meeting has been scheduled to take place
Thursday April 25th between city officials, residents of Orange Avenue and
representatives from the Florida Power and Light Company (FPL) to discuss
options for the routing of new feeder power lines throughout various
residential neighborhoods in Sebastian. As previously reported, the city
became involved in this matter after it was revealed that FPL was initiating
plans to position feeder lines in the front of homes on various streets in
Sebastian, aesthetically impacting respective areas. Mayor Barnes is being
invited to attend the meeting as a number of concerned residents contacted

him directly about this matter several weeks ago. The City Council will
therefore have an opportunity to publicly review and offer direction regarding
possible options for new feeder line installation during the regularly
scheduled May 8th meeting.
Airport Improvement
Administration
Agreement - Federal Aviation
Earlier this week, Airport Manager Jason Milewski received the attached
letter from Federal Aviation Administration (FAA) Program Manager Matt
Thys, notifying the City of Sebastian of approval to bid Sebastian Municipal
Airport's airfield fencing program. As previously reported, FAA has
programmed funding for this and other enhancements in our community.
Essentially, the City of Sebastian is being directed to proceed with a formal
bid procedure: After a respective contract is awarded, funds will be directly
transferred to the Airport Enterprise Fund (FAA's funding process is a lot
different from that of the Florida Department of Transportation Aviation
Section in that no Joint Participation Agreements are executed between
agencies. Our acceptance of FAA funding is contingent upon a successful
award of a contract to implement respective projects and programs.
Accordingly, FAA grant allocations are therefore to be formally incorporated
into respective quarterly budget amendments).
Passive Park Development Workshop
As future park development plans are being finalized by staff to be
presented to both the Parks and Recreation Advisory Committee and City
Council, a workshop will be hosted in the City Council Chambers Monday,
April 29th beginning at 5:30 p.m. to give interested residents an opportunity
to provide input relative to features to be included in park development. As
such, the attached public notice will be advertised next week in an effort to
encourage attendance. Citizens will be able to offer advice relative to the
locations of bocce courts, shuffleboard decks, picnic tables, and other
amenities for future enjoyment. It is anticipated that the first larger scale
passive park development program will be to benefit the Filbert Street
Parcel beginning this fall, to include some of the aforementioned amenities.
The overall development plan will also be presented commensurate with the
Fiscal Year 2002/2003 Proposed Budget review process.

Pelican Island Centennial Celebration
As of earlier this week, the Vero Beach office of the United States Fish and
Wildlife service began circulating the attached flyer advertising the Pelican
Island Centennial Celebration scheduled to begin during the weekend of
March 14, 2003 at Riverview Park. As noted on the flyer, numerous
activities and acknowledgements are anticipated, including possible plans to
encourage a presidential visit to Sebastian to deliver a proclamation for the
Year of the National Wildlife Refuge. Obviously, the City of Sebastian will
be a direct participant and service provider for the celebration, as respective
goals and funding objectives are to be incorporated into the Fiscal Year
2002/2003 Proposed Budget.

Meeting - New FPL Feeder Lines / Routing Options
We have scheduled an informal meeting to exchange fudher information with FPL on Thursday afternoon,
April 25, 2:00 PM, in Council Chambers. This is not a public meeting although some concerned citizens
from the Orange Avenue neighborhood have been invited to attend.
Currently there appear to be four (4) options for the routing of the proposed new feeder lines which are
needed to meet the City's growth requirements. (Options #1, #2, and #3 below also provide some remedies
to current outage rates experienced in Sebastian Highlands. Option #4 does not address current outages ~n
the Highlands.)
Generally stated, the routing options are:
1. The current proposed overhead route in the front yards on Orange and Fleming to Vocelle.
(Aesthetic problems and homeowner complaints.)
2. The same mute on Orange and Fleming to Vocelle, but underground, not overhead. (Problems
involving required switch boxes - to be explained further by FPL in the meeting.)
The same route on Orange and Fleming to Vocelle, but in the rear easement behind the homes,
not in front. (Problems regarding risk management - to be further explained by FPL in the
meeting,)
A new route down the existing Transmission Corridor to CR-512, going underneath CR-512 to the
alley and then westward to the southwest corner of Fleming at CR-512. (Problem with this one is
that it does not address the current outages in Sebastian Highlands.)
The proposed scenario for resolution of this issue is to discuss fully at the subject informal meeting on April
25, then have a formal presentation by FPL at the Council Meeting on May 8 which would enable more
public input. City Council would then decide by vote as to which option to approve.
This is not an isolated event. More such decisions will be fodhcoming in the near future involving FPL's
need to meet ongoing growth requirements in the City. This is a good opportunity to address the overall
issues involved and educate both staff and citizens regarding trade-offs required.

As mentioned during our conversations, I submit to you the names of two Orange Ave.
residents, that are "on guard" concerning our opposition to this project, that some view as a hazardous
health factor and certainly that it would deface our properties and also diminish their value.

The defacing and diminishing of property value is self-evident. What is less evident is the
health hazard of being" trapped" between the two maguetic fields that this would bring on since
there is akeady an existing power line in the back of our houses ( where it should be ) where FPL has
a right of way that we do not object to.
These houses are our homes, we can not move them, but a power line in the ptanmng stage can
be "relocated" elswhere, in a more suitable place.
Depending to whom you are talking to, also depending what "interest" someone is trying to
defend, magnetic fields around electrical conductors project said induce in their surroundings, doing
more or less damage to hnmans, animals, trees etc..
Coming out of my home and having a power line in the back and another in the fl:ont of it
would not be the place I would choose to live with the "remai~fing" knowledge I have concerning
electricity, as a retired teacher o£that subject in vocational schools.
There was supposed to be a meeting before April 10th between FPL, some municipal
authorities, you Mr. Fisher mhd I was invited to participate with the understanding that it would be
possible for me to question and express our view and concern relative to that proposed electrical high
voltage power line.
Since that meeting did not happen ,and I know- you really tried, FPL defaulted, mhd since I am
not able to attend the City council meeting May 8th, that seems to be the meeting where the decision
will be made, I would like to entrust you with the responsability to safegard our imerest and concern

and keep the municipal authorities well informed so they are able to malce a clear choice amongst the
FPL proposals.
I have enjoyed dealing with you, Sir, you are a capable person and when you said you would
return a telephone call, you did, and you were always courteous in all our conversations, this in
public service surely did please me, it gave me the feeling that you care about people and that
taxpayers are people and we the people of Orange Ave. put our thrust in you to safegard our best
interest concerning this matter.

Your construction plans and specifications, dated March 26, 2002, for Airport
Improvement Program project 3-12-0145-03-2002 (pending) are approved for bid
advertisement.
Our approval to advertise is based upon the certifications and assurances that you will
make upon execution (acceptance) of the grant offer and not upon a comprehensive
review of the plans and specifications by our office. The certifications and assurances
you are required to comply with are contained in the "Terms and Conditions of
Accepting Airport Improvement Program Grants" dated September 1, 1999.
We offer the following comments on the subject plans and specifications:
On sheet F-4, the fence location on the South side of Runway 4-22 is located at
the edge of the primary surface. Should the airport pursue a non-precision
approach as identified on the Airport Layout Plan, this fence will penetrate the
transitional surface identified in Federal Aviation Regulation, Part 77.25(e).
After you have evaluated the bids you may award the contract to the iow responsive
bidder without further Federal Aviation Administration authorization provided the
conditions listed below were met. The airport owner is responsible for complying with
federal, state, and local requirements as they relate to contract award and construction
work. Please send us a copy of the certified bid tabulation and recommendation of
award with your grant application after the bids are opened.
1 ) The airport owner compiled with the "Terms and Conditions of Accepting Airport
Improvement Program Grants" - see Sponsor Certification for Equipment/Construction
Contracts and FAA Order 5100.38A, Chapter 8.

2) A lower bidder was not disqualified, i.e., unresponsive, not responsible, etc.
The Office of Federal Contract Compliance Program (OFCCP), U.S. Department of
Labor, monitors contractor Equal Employment Opportunity (EEO) requirements. You
are required to notify them within 10 working days of an award of a contract subject to
41 CFR Part 60-4. The office of jurisdiction and the information to be included in the
notification are enclosed.
You may issue a "Notice-To-Proceed" after a pre-construction conference is held.
Except for projects with airport entitlement funds only, construction work done prior to
the acceptance of the grant offer is ineligible for federal participation. Please give us
two weeks advance notice to the pre-construction conference and a copy of the "Notice-
To-Proceed" when it is issued. If you have any questions, you can reach me at (407)

The City of Sebastian Parks and Recreation Committee will host a public workshop at
their regularly scheduled meeting at 5:30 p.m. on Monday, April 29th, 2002. The
purpose of the workshop is to share preliminary park plans and ideas with interested
citizens of Sebastian and to obtain their input to the planning process. Chris McCarthy,
Parks and Recreation Director, will present an overview of future passive neighborhood
park locations and amenities (such as picnic/game shelters, shuffleboard and bocce
courts, etc.) currently under review; and Burt Jones, Engineering Department, will
present conceptual plans for several parks for which grant funding support is being
sought,
Any person who decides to appeal any decision made by the Committee with respect to any matter considered at this
workshop will need a record of the proceedings and may need to ensure that a verbatim record of the proceedings is
