HomeMy WebLinkAbout09172003 CEB CITY OF SEBASTIAN CODE ENFORCEMENT BOARD COUNCIL CHAMBERS 1225 MAIN STREET, SEBASTIAN, FL 32958 MINUTES OF REGULAR MEETING SEPTEMBER 17, 2003 Chairman Van Buskirk called the meeting to order at 2:00 p.m. The Pledge of Allegiance was recited. Michael Beyer Tracy Hass, Director Growth Management APPROVAL OF MINUTES: 7/16/03 Meeting The minutes were approved by a voice vote 7-0. ELECTION OF NEW VICE-CHAIRMAN: This was moved to the Chairman's Matters. NOTICED HEARINGS: A. VIOLATION HEARING - CASE # 2003-6429 W1NN DIXIE & RUTH GUEST HOUSE INC. - 995 SEBASTIAN BLVD. SECTION 54-2-7-14a LAND DEVELOPMENT CODE Code Enforcement Meeting September 17, 2003 Page Two Chairman Van Buskirk swore in Code Enforcement Officer Van Meir. Officer Van Meir stated that there has been numerous calls generated by citizens to the Code Enforcement office as well as the City Manager regarding the parking of Semi Tractor trailers, Moving Van and other large trucks in the WINN DIXIE parking lot. Code Enforcement has been in contact and working with the tenant WINN DIXIE and property owner Ruth Guest House Inc. about the problem. Because it is private property, the City does not have the authority to tow vehicles that are in violation. Chairman Van Buskirk swore in Sgt. Beyer. Sgt. Beyer stated that the Officers have been giving "Red Notices" as a warning of the illegal parking but it is the responsibility of the tenant and owner of the proper to initiate the towing. "No Parking" signs must be posted by the tenant / owner. Chairman Van Buskirk swore in Tracy Haas, Manager of Growth Management. Mr. Haas stated that it was a site plan issue and a code issue. Parking is strictly for patrons, not for storage of vehicles. Mr. Griffin asked where, if any, was there parking for these types of vehicles in the City. Mr. Haas stated that there was nothing within the city limits. Discussion followed at length on where the Semi-Tractor Trailers could park as an alternative to the WINN DIXIE parking lot. Officer Van Meir recommends finding WINN DIXIE & Ruth Guest House Inc. "in violation" and set a fine for future violations. Attorney Stringer asked what the purpose of the fine was for. Officer Van Meir stated that he felt it would be a useful to encourage the tenant & owner to keep in compliance of the ordinance. Also, it was suggested that WINN DIXIE post the property with "No Trespassing after hours" or "No Over Night Parking - Subject to Towing" signs. Discussion continued as to the fine amount and how many days WINN DIXIE had to come into compliance. It was decided that WINN DIXIE & Ruth Guest House Inc. had 30 days to get situated before the motion would take effect. MOTION by Neglia/Cosco "I motion to find WINN DIXIE & Ruth Guest House Inc. case # 2003-6429 in violation of 54-2-7-14a and to come into compliance within 30 days or a fine of $100.00 per incident per store and owner would be imposed." ROLL CALL: Mr. Neglia -aye Mr. Cosco -aye Mrs. Barczyk -aye Mr. Griffin -aye Chairman Van Buskirk -aye Ms. Schofield -aye Mr. Manuel -aye MOTION CARRIED 7-0 It was suggested that Stuckey's on 195 be an alternative parking area for the tractor trailers and other vehicles. CHAIRMAN'S MATTERS It was explained that vacancies in a vice-chairman position are not replaced mid-term, so the senior member of the board would be acting chairman in the absence of the Chairman. It was noted that Mr. Cosco is the senior-most member serving. MEMBER'S MATTERS Mrs. Barczyk asked what the difference between unoccupied new homes and residential property was when it comes to grass and weeds being over 10 inches. Officer Van Meir stated that until the final Certificate of Occupancy is issued it is not considered under improved property. Attorney Stringer stated his interpretation of the ordinance is that all improved property falls under the code. Code Enforcement Meeting September 17, 2003 Page Three Mr. Neglia brought up problem of Key West Hotel parking of recreational vehicles in every direction; it looks bad, is this allowed. Tracy Haas, Growth Management Manager said that commercial property is different from residential property and it is allowed. Mr. Neglia asked about motorcycles parking on both sides of the street at Earl's Hideaway on Indian River Drive, is this allowed. Code Enforcement Officer Lindquist said he would look into the matter. 10. 11. 12. CODE ENFORCEMENT OFFICER'S MATTERS Officer Lindquist stated that Code Enforcement was trying to be pro-active but their jobs are turning into re-active. Officer Lindquist also stated that most re-active calls are neighbors complaining about their neighbors. CITY ATTORNEY MATTERS The City Attorney let the board know that the revision to Section 54-2-7.20 "Display of building numbers" of the Land Development Code was passed giving violators 14 days to comply instead of 30 days.
