REGULAR MEETING
SEPTEMBER 9~ 2003
Meeting was call to order by Chairman Fox at 7:00 P.M.
The Pledge of Allegiance was said.

APPROVAL OF MINUTES: Regular Meeting of 8/12/03.
MOTION by Wolfe/Garland
I make a motion that the Board approve the minutes of 8/12/03.
A voice vote was taken. 7 - 0, motion carried.
OLD BUSINESS: None.
NEW BUSINESS: Experior Exam
Spallone, Ross, M./Residential Contractor
Mr. Spallone was sworn in by Chmn. Fox.
Mr. Taylor asked Mr. Spallone if he was a Florida resident at the present time. Mr.
Spallone said not at the present time. He did say that he had Florida experience. He
worked here in the late 70's, then for five months last year with a builder on the west
coast and is currently employed by Dupont Builders.
Mr. Taylor noted that all of his experience in their packet was from New York. Mr.
Spallone said that licenses were not required and that there was a letter from New York
stating this and also from the county in which he resided. He said they were regulated by
Code Enforcement.
Mr. Taylor felt he could not approve the application without some documented Florida
experience. The Board Secretary explained that by Board ruling in the past that the
experience from the 70's was too far back and since he currently still has an active
business in New York that that was what she asked for to prove experience.
Mr. Spallone noted that at the current time that he is a superintendent of residential
construction for Dupont Builders.
In regards to New York, Mr. Spallone told the Board that most of his work was
remodeling but that he did do some construction of new residences.
Mr. Garland felt that more proof of construction, such as letters from his suppliers, letters
from people he had worked for or done construction for should be part of his application.
Mr. Schmitz felt that the Board needed verification for the work done in Florida and that
Mr. Spallone had knowledge of the Florida Building Codes.

I make a motion that the Board not approve Mr. Spallone's application but leave the
window open to re-apply when he has verification of the proper experience.

BOARD MATTERS: Discussion: Complete Electric
The Board Secretary told the Board that each member had received a copy of the papers
they had received at the August meeting. It was noted that the Board was questioning the
verification of experience that was signed by Mr. Guidroz for Robert Glenn Walker at a
previous meeting.
Mr. Guidroz was present at the meeting with Attorney Warren Dill.
Attorney Dill told the Board that presently there is serious almost hateful dislike for
Garrett by Edison Electric. He explained that in 1999, Garrett hired Russ Ensell as his
general manager. Prior to that, Russ was general manager for Edison Electric. Garrett
had heard through a sales representative that Russ was looking to move, find new
employment. Having heard this, Garrett got in touch with the sales representative who
acted as a liaison between him and Russ. At that time he hired Russ. When he was hired
there were 11 other electricians working for Edison Electric that were not happy there
and wanted to leave along with one secretary. Garrett ended up hiring all 12 people.
Since that time there has been an issue between these two firms. Attorney Dill noted that
Garrett did not go soliciting these people, they came to him.
In January, 2001, Glen Walker went to work for Edison Electric. He worked there for
about a year. Even though he was very good friends with Garrett, at that time he lived in
Merritt Island and it was too far to come to work for Garrett. He eventually moved to
Palm Bay. When he did he left Edison and came to work for Garrett adding further fuel
between the relationship between the two companies.
Attorney Dill noted that there were various errors in the letters the Board has that can be
substantiated and documented if necessary.
When Glen was applying for his exam he asked Edison Electric for a letter of verification
which they refused to give him. Garrett knowing Glen all these years knew Edison
Electric and knew what Glen had done for Edison Electric. When Glen told Garrett about
this problem, Garrett verified his employment.
Garrett never intended to do anything improper. He had known Glen for years and knew
he had the experience and qualifications to act as an electrical contractor. The only error
Garrett made was one in judgment when he put down on the verification sheet January,
'98 to February 2003 for Glen's time of experience.
Garrett has known Glen since 1992. Glen has worked for and along side Garrett since that
time. Chmn. Fox asked if he has known him or worked for him since (inaudible).
Attorney Dill said Garrett has known Glen since 1988 but that Glen Walker has worked
for Garrett from time to time since 1992. This was the error in judgment he made. Glen
had the experience and Garrett knew he had the time and experience. Because Garrett
was in a hurry to get this application in to be put on the agenda, rather than trying to
figure out all of the old dates, he just quickly put down some years because he knew Glen
had the experience. It was never his intent to put somebody out there, allow somebody to
sit for an exam that didn't know what they were doing.
Some of the time Glen worked with Garrett since 1992 was during the summers, some of
the time was full time, some of the time was off and on when Garrett needed some
assistance.
Attorney Dill passed out four letters to the Board, which he read into the minutes. One of
the letters was from Dave McCoy who worked for Edison and worked with Glen. He
noted that the point behind these letters is to show the experience factor.
The next three letters were from electrical contractors in Indian River County, Sebastian,
that have worked with Glen Walker since 1992. These letters substantiate what Garrett
put down on the application to take the Master Electrician Exam. These Electrical
Contractors are documenting the experience from 1992 to 1997 that Mr. Walker has. The
point is that this man does have the experience and qualifications to take the examination.
It was noted that the men who wrote these letters were employed by G & B Electric.
This was Garrett's electrical company up until four years ago when he started a whole
new company.
The Board Secretary asked Garrett if he owned G & B and if Glen was employed by him.
Garrett was asked to come to the microphone. Chron. Fox swore him in.
Again the Board Secretary asked if he owned G & B when Glen was employed by him at
that time. Garrett answered yes. She noted that actually he should have put down on his
application that he was employed by G & B. The time being shown is still the same
amount of time, just not in the time span you are saying. Garrett answered yes.
Mr. Garland noted that the Board did not have knowledge of this. What we saw was
another company and Brevard County saying that Glenn did not work for him in those
years. That made the paperwork we had at the meeting when he was approved to take the
test no good.
Garrett explained that it was not his intention to do that. He only had two days to get his
paperwork to Kathy for the meeting.
Mr. Taylor asked that since Garrett had a state license, what type of penalty could the
Board assess. The Board Secretary explained that the only thing the Board could do was
to stop his permit pulling privileges.
Mr. Garland felt that this was just something that happened and could find no reason to
pursue this since he gotten a full explanation.

15 MINUTES TO THE PUBLIC:
Richard Waltermire stated that he was an electrical contractor in Indian River County but
that he did not get a high enough score to work in Sebastian. He explained that the
supervisor that he had at the school district where he worked up until two weeks ago has
not come through with the letters he needed to take the test to work in Sebastian. He
explained that he had two letters from the school district but not a letter from the
contractor with his license number on it since he did not work for the school as a
contractor. He noted that he was an electrician for the school district and ran a service
truck for them for nine years.
He told the Board that he has been a journeyman in Sebastian for 10 years. He stated that
he worked for Tripp Electric for 5 years and 4 months. There is a letter on file in the
Building Department showing this.
The Board told Mr. Waltermire to complete an application and come to the meeting in
October for approval.
There was a lengthy discussion concerning people coming from out of state to be
approved to be tested for licensing in the state of Florida. Experience from out of state is
acceptable but each applicant must be dealt with on a case to case basis. This is
determined by the Board from the information on the application.
It was noted that Meredith Fox and Scott Taylor have submitted letters stating they were
not seeking reappointment to the Construction Board. The Board Secretary told them
that she enjoyed working with them and would miss them.
There being no further business, the meeting adjourned at 8:45 P.M.
