HomeMy WebLinkAbout01242003 1225 Main Street [] Sebastian, Florida 32958 Telephone (772) 589-5330 [] Fax (772) 589-5570 City Council Information Letter January 24, 2003 Canal Seawall Policy Development Initiative As both staff and representatives from Camp, Dresser and McKee recently discussed the possibility of incorporating canal maintenance and improvement efforts into the City's long term stormwater management plan, please be advised that specific tasks have been recently assigned to both the Departments of Engineering and Finance in an effort to initiate respective policy recommendations. Activities in this regard include survey review and data compilation as necessary to ascertain whether dilapidated seawalls are public and/or privately owned, as wells as performing cost analysis so as to be able to communicate applicable funding arrangements. Recommendations regarding these matters will be offered publicly in the coming months, commensurate with the Fiscal Year 2003/2004 budget process. Public Facilities Waterin.q Plan As the City of Sebastian Department of Public Works is currently working to plant seedlings in various park facilities, notably both the Barber Street Sports Complex (BSSC) and Riverview Park, it becomes necessary to utilize respective irrigation systems for effective germination. As such, by authority vested in me by Sebastian City Code Section 102-80, please be advised that the City Manager's Office has recently authorized irrigation use during the day at BSSC from January 22nd through January 28th. AS referenced in the attached memorandum as compiled and delivered by both Terry Hill and Chris McCarthy, full seed germination is anticipated to be completed by Tuesday, January 28th, during which time staff will resume administration of watering activities via the normal restriction schedule. City Council Information Letter January 24, 2003 Page 2 Presentation to Florida Historic Preservation Board Sebastian Historic District Earlier this week, I received word from the Florida Department of State relative to the status of our proposal to establish a historic district in Sebastian. I am pleased to report that the initial review process was successful, resulting in a presentation to the Florida Historic Preservation Board of Directors in Tallahassee to be scheduled to take place later in March 2003. At this time, myself, a representative from the Department of Growth Management, as well as Anna Jackson are anticipated to offer this presentation in an effort to secure the designation. If any member of City Council has an interest in joining us, I will be more than happy to make travel arrangements accordingly: Out of Office Please be advised that I will be out of the office during the latter part of next week to accompany my wife to an education workshop in Gainesville. When establishing new seed it is absolutely imperative that you keep the seedlings wet for good germination. The weather forecast is also calling for frost this weekend and it may be necessary to water the seedlings to help melt any frost that may occur. We would like your approval for a watering plan that calls for us to water depending on the weather, periodically throughout the day from January 22 through January 28, 2003. The seed should be germinated by January 28 and we can return to our current water restrictions that pertain to new plants. "An Equal Opportunity Employer" Celebrating Our 75th Anniversary § 102-58 SEBASTIAN CODE (b) At the end of the franchise period, the city shall not be required to pay to the utility any amount for goodwill and the appraised value shall be based entirely upon physical assets only. (c) If the board of appraisers cannot agree as to the price to be paid by the city, then the city may file appropriate condemnation proceedings under Florida law. Any franchise granted by the city shall include this requirement. (Code 1980, § 27-25) Sec. 102-59. Penalty for violations of article. Violation of this article and/or operating a utility without first obtaining a franchise from the city in compliance with this article, shall constitute a violation of this Code, and upon conviction, shall be punishable as provided in section 1-10 of this Code. Each day that violation occurs shall be considered a separate violation. (Code 1980, § 27-26) Secs. 102-60--102-75. Reserved. ARTICLE IV. WATER RESTRICTION PLAN Sec. 102-76. Short title. This article shall be known as the "City of Sebastian Water Restriction Plan." (Code 1980, § 30-1) Sec. 102-77. Definitions. The following words, terms and phrases, when used in this article, shall have the meaning ascribed to them in this section, except where the context clearly indicates a different meaning: Water means water taken from: (1) Any public water system; (2) Any groundwater system, including shallow and deep water wells drawing water from the Florida aquifer; or (3) Any surface water system. The systems enumerated are intended to include, but are not limited to, any system that uses any groundwater or interconnected surface waters for a water source, irrespective of whether the system is publicly or privately owned. Water shortage emergency means a declaration by the city council that a water shortage exists. (Code 1980, § 30-2; Ord. No. 0-99403, § 1, 6-23-99) Supp. No. 22 CD102:10 UTILITIES § 102-80 Sec. 102-78. Applicability. The provisions of this article shall apply to all individuals, legal entities and their agents who use water, as defined in this article, within the city. (Code 1980, § 30-3; Ord. No. 0-99-03, § 2, 6-23-99) Sec. 102-79. Enforcement. (a) Every city police officer shall be authorized and empowered to enforce the provisions of this article through a noncriminal citation, with jurisdiction vesting in the county court upon failure of the violator to pay the same. However, where the offense is designated a misdemeanor, the officer shall issue a Notice to Appear before the county court. (b) Additionally, the city code enforcement officers are authorized to enforce the provisions of this article under the citation method of Code section 2-194. (c) The following enforcement notification guidelines shall be in effect for this article and shall supersede any conflicting provision of Code section 2-194: (1) If personal contact is made with the violator, the officer shall require immediate compliance; (2) If personal contact cannot be made with anyone having ownership or control of a residence found to be in violation of this article, the enforcement personnel shall leave a notice of violation posted on the front door thereof requiring compliance within 24 hours; (3) If the notice remains posted undisturbed at said location 24 hours later, a second notice of violation shall be sent by certified mail with return receipt to said address; and (4) If said violation continues more than 24 hours after delivery of the second notice, the violator shall be cited. Notwithstanding any provisions of this subsection to the contrary, if enforcement personnel has proof the premises is actively occupied, the requirement of a mailed second notice is waived. The city manager shall have the authority to permit a reasonable use of water in any case necessary to maintain adequate health and sanitation standards as set forth in the county health code or when needed to perform maintenance and repair on an irrigation system. These permits may be issued with conditions, shall be issued free of charge and shall only be issued upon the showing of good cause for the uses requested. Additionally, a permit may be issued when necessary for the economic viability of a business venture, subject to the terms and conditions set forth above, for a fee of $20.00 for a permit of limited duration or on an annual basis for a fee of $50.00. (Code 1980, § 30-5; Ord. No. 0-99-03, § 4, 6-23-99) Supp. No. 24 CD102:ll § 102-81 SEBASTIAN CODE Sec. 102-81. General restrictions. Outdoor irrigation by any maimer is prohibited bet~veen the hours of 9:00 a.m. and 5:00 p.m., year-round. However, air conditioning systems utilizing water source heat pumps shall be permitted to utilize the discharge water of said system for irrigation purposes at any time notwithstanding any provision of this article to the contrary. (Code 1980, § 30-6; Ord. No. 0-99-03, § 5, 6-23-99; Ord. No. O-99-12, § 1, 9-8-99; Ord. No. 0-01-01, § 1, 1-24-2001) Sec. 102-82. Implementation of emergency restrictions. The city council may by resolution enact further curtailments and restrictions of water uses upon a declaration at any time of a water shortage emergency by the city council, said emergency restrictions shall have the force of law and shall remain in effect until such time as the city council shall declare such emergency to be at an end. (Code 1980, § 30-19; Ord. No. 0-99-03, § 6, 6-23-99; Ord. No. 0-99-12, § 2, 9-8-99; Ord. No. O-01-01, § 2, 1-24-2001) Sec. 102-83. Landscape irrigation restrictions, residential and commercial--Exist- ing installations. Parcels with odd-numbered addresses are only permitted to irrigate on Monday, Wednesday and Saturday. Parcels with even-numbered addresses or no addresses are only permitted to irrigate on Tuesday, Thursday and Sunday. (Code 1980, § 30-7; Ord. No. 0-99-03, § 7, 6-23-99; Ord. No. O-99-12, § 3, 9-8-99) See. 102-84. Same--New installations. Landscaping installations on residential or commercial parcels that have been in place for 30 days or less shall not be subject to the three day a week limitation of section 102-83. (Code 1980, § 30-8; Ord. No. 0-99-03, § 8, 6-23-99; Ord. No. O-99-12, § 4, 9-8-99) Sec. 102-85. Essential use restrictions. There shall be no restrictions on firefighting or medical uses. Use restrictions for ~ublic facilities. Custodians of publicly owned facilities may submit a water use plan to the city manager that, while considering the manpower restraints of the entity, balances the same against the policies of water conservation such as evaporation avoidance and spreading out the times and Supp. No. 24 CD102:12
